ADOPT A RESOLUTION OF INTENTION TO ANNEX TERRITORY TO A MUNICIPAL IMPROVEMENT DISTRICT AND LEVY ANNUAL STORM DRAINAGE MAINTENANCE ASSESSMENTS (DISTRICT 6)

RECOMMENDATION
It is recommended that the City Council approve a Resolution of Intention to:
1. Provide intent to annex assessor’s parcel number 177-020-78, owned by Applied Aerospace Structures Corporation, into the Western Pacific Industrial Park Assessment District for the maintenance and operation of storm drainage improvements.
2. Specify that the public interest would be served by annexing the parcel into the Western Pacific Industrial Park Assessment District and levying annual assessments for the costs to maintain and operate the storm drainage improvements.
3. Preliminarily approve the Proposed 2027-2028 Fiscal Year Budget, the schedule of parcels and assessment amounts for the 2027-2028 fiscal year, and Amendment No. 12 to the Amended Assessment Diagram for the Western Pacific Industrial Park Storm Drainage Basin Maintenance District (Attachment A).
4. Set the Public Hearing date on December 8, 2026, and direct the City Clerk to mail public notice to the affected property owners by October 23, 2026, at least forty-five days before the hearing date.
It is also recommended that the City Manager be authorized to take appropriate and necessary action to carry out the purpose and intent of this resolution.

Summary
To comply with Stockton Municipal Code Chapter 13.20 Stormwater Quality Control Criteria Plan (SWQCCP), the Applied Aerospace Structures Corporation (AASC) development must install, operate, and maintain a stormwater quality treatment device.
All property owners subject to assessment of the annual costs of the storm drain improvements submitted written consents for annexation to the City Clerk. Siegfried Engineering, Inc. of Stockton, California, serving as the Engineer of Work, prepared the attached Engineer’s Report and submitted it for preliminary review and approval, including the annual operation and maintenance cost estimates.
The owner of assessor’s parcel number 177-020-78 has agreed to annex into the Western Pacific Industrial Maintenance District as a condition of their building permit. This annexation does not increase the District’s overall maintenance, replacement, or reserve obligations, and the parcel will be assessed consistently with existing District requirements. The annexation also complies with Proposition 218, as the parcels within the District receive 100% special benefit from the storm drainage improvements and 0% general benefit.
Staff recommend that the City Council approve the proposed Resolution to schedule the Public Hearing on December 8, 2026.
DISCUSSION
Background
In 1985, the City Council approved the formation of Western Pacific Industrial Park Basin Assessment District by Resolution 85-0470. The District is responsible for maintaining the stormwater detention basin, including the discharge pumps and associated equipment that release stormwater into Duck Creek, as defined in the original report and the subsequent amendments to date.
On November 1, 2016, the Central Valley Regional Water Quality Control Board issued the City of Stockton a revised Stormwater National Pollution Discharge Elimination System (NPDES) Permit (Order No. R5-2016-0040-002). The NPDES Permit is a regulatory program under the Clean Water Act administered by the U.S. Environmental Protection Agency (EPA) and state agencies. It is designed to control water pollution by regulating point sources that discharge stormwater runoff into waters of the United States.
AASC assessor’s parcel number 177-020-78 (Attachment B) consists of an industrial building complex of approximately 10 buildings and associated site improvements. Recent expansion of the site, along with related City permit requirements, necessitates the parcel’s annexation into the District to participate in the ongoing maintenance of the stormwater drainage improvements.
Present Situation
The Conditions of Approval for any development project require Owners/Developers/Successors-in-Interest to install certain public stormwater quality improvements and provide operations and maintenance services for the proposed treatment features. As a result, and if approved, assessor’s parcel number 177-020-78 will be annexed into the Western Pacific Industrial Park Assessment District (Attachment C) to fund costs associated with operating, maintaining, and replacing the pump station.
Funding for Western Pacific Industrial Park Assessment District will be provided through an annual assessment based on the stormwater runoff from individual parcels. The proposed 2027-2028 maximum annual assessment for assessor’s parcel number 177-020-78 is $971.04. Subsequent assessments will be presented to the City Council for consideration annually.
The maximum annual assessment may increase each year by the greater of 3% or the change in the Consumer Price Index, as needed to meet rising maintenance costs.
The funds collected from property owners within a district may only be used for work on the basin serving that district, as the resulting benefits apply exclusively to properties located there. Each district’s funds are segregated and cannot be used to operate, maintain, or support stormwater activities or any other utility outside that district.
FINANCIAL SUMMARY
The City of Stockton makes no financial contribution to the Western Pacific Industrial Park Assessment District or any of the Districts. All costs are paid by the property owner/developer through the annual tax roll. The use of the funds collected within the Western Pacific Industrial Park Assessment District or within the various districts is restricted by Proposition 218 to pay only for the expenses related to the maintenance and operation of the specific storm drainage basin for which they were collected. The proposed FY 2027-2028 assessment for AASC parcel number 177-020-78 is $971.04.
This action has no impact on the General Fund or any other unrestricted funds.
