RECOMMENDATION

 

It is recommended that the City Council adopt a resolution to:

 

1.                     Authorize the granting of a permanent underground utility easement to Pacific Gas and Electric Company (PG&E) over a portion of a parcel owned by the City of Stockton located at 666 West Weber Avenue (APN 137-370-02) for new electrical facilities to serve New City Hall; and

 

2.                     Authorize the City Manager to take whatever actions are necessary and appropriate to carry out the purposes of the Resolution.

Summary

 

PG&E is proposing to acquire a permanent underground utility easement over a portion of a parcel owned by the City located at 666 West Weber Avenue (Attachment A - Vicinity Map, Attachment B - Aerial Map, and Attachment C - Easement Location).  The Public Works Department (PW) is requesting the easement to facilitate new electric services from PG&E for New City Hall located at 501 and 509 West Weber Avenue. 

 

DISCUSSION

 

Background

 

PG&E is proposing to secure a permanent underground utility easement from the City to perform electrical upgrades and provide new electric services from PG&E for New City Hall.  The proposed easement is located over a portion of a parcel owned by the City.  The parcel on which the utility easement is proposed to be granted was acquired by the City in 1990 for redevelopment. 

 

Present Situation

 

PG&E is proposing the City grant a permanent underground utility easement over a portion of a parcel owned by the City located at 666 West Weber Avenue (APN 137-370-02).  The proposed action will provide PG&E with the permanent rights required to install and provide new electric services from PG&E for New City Hall.

 

 

 

 

NOTIFICATION

 

The Public Works, Community Development, MUD, Police, and Fire Departments and local utilities were notified of the proposed granting of an easement at this site.  There are no utilities in the proposed easement area that would be impacted by the action.  On April 5, 2024, as required by the City Charter Section 510, a Notice of Intention to Grant or Sell Real Property interest was advertised in the legal notice section of The Record at least ten days prior to Council consideration of this action.

 

ENVIRONMENTAL CLEARANCE

 

It has been determined by the Community Development Department that this action/project is Categorically Exempt under California Environmental Quality Act (CEQA) and is granted a “general rule exemption” under Section 15061(B)(3) since there is no possibility that the activity in question would have significant effect on the environment and the activity is not subject to CEQA.  In accordance with Section 65402 of the Government Code, the Community Development Department further determined that this activity/project conforms to the City’s General Plan Policy Document, as amended.

 

FINANCIAL SUMMARY

 

All advertising costs necessary to process the grant and sale of easement interests to PG&E, approximately $500, will be paid from the Real Property Publicity & Advertising Account.
