REJECT BIDS FOR THE WEBER POINT EVENTS CENTER SHADE STRUCTURE REHABILITATION - PHASE 2 PROJECT

RECOMMENDATION

 

It is recommended that the City Council approve a motion to reject all bids received for the Weber Point Events Center Shade Structure Rehabilitation - Phase 2, Project No.  WP22033, pursuant to Stockton Municipal Code section 3.68.160(B).

 

It is also recommended that the City Manager be authorized to take appropriate and necessary actions to carry out the purpose and intent of this motion.

Summary

 

The project will replace the Weber Point Events Center shade structure, including the worn-out fabric membrane, “cat-eye” cables, small turnbuckles, aluminum clamp bars, and other miscellaneous hardware (Attachment A).  In addition, the temporary stabilization measures installed with the Phase 1 fabric removal will be disconnected, and all steel will be repainted.  The project was included in the 2021-26 Five-Year Capital Improvement Plan (CIP).

 

On February 9, 2023, the City received one bid for this project.  The bid from McFadden Construction, Inc. of Stockton, CA, failed to submit all the necessary subcontractor information at the time of the bid.  Pursuant to Stockton Municipal Code (SMC) section 3.68.160(B), staff recommends Council approve a motion to reject all bids received and rebid the project.

 

DISCUSSION

 

Background

 

The Weber Point Events Center was designed by Huntington Design Associates, Inc.  The completed construction of the facility in 1999 was a noted milestone in the overall redevelopment of Stockton’s downtown and waterfront areas, with the tension fabric structure serving as a major feature. 

 

Construction of the shade structure included a vinyl-coated polyester fabric membrane supported by a system of steel wire ropes and pipe masts with a drilled pier foundation.  The fabric membrane was custom-manufactured with an estimated lifespan of approximately 15 years.

 

In August 2021, Huntington Design Associates, Inc. was contacted by Public Works to inspect the fabric structure due to concerns over the fabric and cable-to-cable connections that had come apart.  City staff issued an emergency contract to re-attach parted cable connections. 

 

In October 2021, Huntington Design Associates, Inc. provided a findings and recommendations report, noting that the fabric membrane was in poor condition and should be replaced, along with attachment appurtenances.  The project was later funded and included with the adoption of the 2021-26 Five-Year CIP.

 

On December 21, 2021, the City retained Huntington Design Associates, Inc., to provide temporary stabilization measures and provide design services to prepare plans, specifications, and estimates for construction of the Weber Point Events Center Shade Structure Rehabilitation. 

 

In April 2022, the Weber Point Events Center Shade Structure Rehabilitation, Phase 1 work was completed to remove the fabric membrane and install temporary stabilization cables.

 

On July 26, 2016, Council adopted a Community Workforce and Training Agreement (CWTA).  The CWTA became effective August 25, 2016, and applies to all Public Works projects over $1 million that are bid after that date.  On July 16, 2019, by Motion No. 2019-07-16-1403, Council extended the CWTA term to August 25, 2024.  The CWTA was not applied to this project as the project cost is under $1 million.

 

Present Situation

 

On November 30, 2022, the Weber Point Events Center Shade Structure Rehabilitation - Phase 2 project was advertised for bids.  On February 9, 2023, one bid was received from McFadden Construction, Inc. of Stockton, CA, in the amount of $624,537; however, they failed to submit all the necessary subcontractor information at the time of the bid.  Public Works’ staff and the City Attorney’s Office reviewed the official bid documents and determined that McFadden Construction, Inc. failed to comply with the bidding requirements, which resulted in a non-responsive bid.  Staff recommends that the bid from McFadden Construction, Inc. be rejected.

 

To determine the reasons for not receiving other bids, staff surveyed other contractors who expressed an interest in the project but did not submit a bid.  Feedback received from other contractors revealed that the schedule, scope of work, and materials requirements, as presented on the specifications, provided restrictions for bidding.  The project specifications will be revised to create a more favorable bidding environment for contractors.  Staff recommends Council approve a motion to reject all bids received and rebid the project.

 

FINANCIAL SUMMARY

 

There is sufficient funding in the Weber Point Events Center Shade Structure Rehabilitation, Project No. WP22033, Account No. 4540-000-800007-300-000-30-45-000-000, for the rebid process.

 

There is no impact to the City’s General Fund or any other unrestricted fund as a result of taking the recommended action.
