RECOMMENDATION

 

It is recommended that the City Council adopt a resolution to transfer funds in the amount of $20,000 from the Bicycle Master Plan Program, Project No. WT17003, to the March Lane/East Bay MUD Bicycle and Pedestrian Path Connectivity Improvements, Project No. WT17022/Federal Project No. ATPCML-5008(179).

 

It is also recommended that the City Manager be authorized to take appropriate and necessary actions to carry out the purpose and intent of this resolution.

Summary

 

On July 27, 2021, by Resolution No. 2021-07-27-1222, Council awarded a Construction Contract in the amount of $2,784,744.42 to McFadden Construction, Inc., of Stockton, CA, for the March Lane/East Bay MUD Bicycle and Pedestrian Path Connectivity Improvements, Project No. WT17022/Federal Project No. ATPCML-5008(179).  This project has been fully constructed with only project closeout remaining (Attachment A - Vicinity Map). 

 

Balancing Contract Change Order (CCO) No. 5 was approved by Council on March 7, 2023, by Resolution No. 2023-03-07-1211, which was required to close out the project and make final payment to the contractor.  Although this previous resolution mentioned the need to transfer funding, it did not specify the amount of funds required and from which account these funds would be transferred.  This current resolution clarifies those details.

 

To fully fund the construction of the project, staff recommends transferring funds in the amount of $20,000 from the Bicycle Master Plan Program, Project No. WT17003, to the March Lane/East Bay MUD Bicycle and Pedestrian Path Connectivity Improvements, Project No. WT17022/Federal Project No. ATPCML-5008(179).

 

DISCUSSION

 

Background

 

On July 27, 2021, by Resolution No. 2021-07-27-1222, Council awarded a Construction Contract in the amount of $2,784,744.42 to McFadden Construction, Inc., of Stockton, CA, for the March Lane/East Bay MUD Bicycle and Pedestrian Path Connectivity Improvements, Project No. WT17022/Federal Project No. ATPCML-5008(179).  This project has been fully constructed with only project closeout remaining (Attachment A - Vicinity Map). 

 

The project reconstructed, widened, and improved the existing path along the East Bay MUD corridor between Brookside Road and Hillsboro Way for a distance of approximately 3.5 miles. The project also upgraded the path to current Class I Bicycle and Pedestrian (shared use) standards, installed intersection and midblock improvements, high visibility crosswalks, striping, gap closures, upgraded curb ramps to Americans with Disabilities Act standards, installed flashing beacons, and added wayfinding signage.

 

During construction, additional work was necessary to address unforeseen field conditions and accomplish the intended scope of the project. CCO Nos. 1 through 4, in the amount of $378,011.05, were previously approved under the administrative change order authority allowed under the original contract. CCO Nos. 1 through 4 approved additional work for replacing unsuitable soils and installing geogrid beneath new path where required, installing additional bollards to restrict vehicle access, and removing trees that would obstruct the new path alignment.

FINANCIAL SUMMARY

 

There are sufficient funds to transfer $20,000 from the Bicycle Master Plan Program, Project No. WT17003 (formerly PW1703), Account No. 4570-000-800007-300-000-30-45-000-000, to the March Lane/East Bay MUD Bicycle and Pedestrian Path Connectivity Improvements, Project No. WT17022 (formerly PW1722)/Federal Project No. ATPCML-5008(179), Account No. 4570-000-800007-300-000-30-45-000-000, sufficient funds will be available for project closeout.

 

There is no impact to the City’s General Fund or any other unrestricted fund as a result of taking the recommended action.
