RECOMMENDATION

 

It is recommended that the City Council adopt a resolution to:

 

1.                     Approve the filing of Notice of Exemption No. NOE27-22 under the California Environmental Quality Act (CEQA) for the Smith Canal Sanitary Pump Station Odor Control Unit Replacement Project, Project No. UW23021 (Exhibit 1 to the Resolution).

 

2.                     Approve the project Plans and Specifications for the Smith Canal Sanitary Pump Station Odor Control Unit Replacement Project, Project No. UW23021 (Exhibit 2 to the Resolution).

 

3.                     Award a $239,500.00 Construction Contract to Blocka Construction, Inc. of Pleasanton, CA, for the Smith Canal Sanitary Pump Station Odor Control Unit Replacement Project, Project No. UW23021 (Exhibit 3 to the Resolution).

 

4.                     Authorize the appropriation of Wastewater Utility funds in the amount of $60,000.00 from Fund Balance to Smith Canal Sanitary Pump Station Odor Control Unit Replacement, Project No. UW23021.

 

It is further recommended that the City Manager be authorized to take appropriate and necessary actions to carry out the purpose and intent of this resolution.

Summary

 

The Municipal Utilities Department (MUD) operates and maintains the Smith Canal Sanitary Pump Station located at 2130 Fontana Avenue in Stockton. The MUD conducted routine maintenance inspection of the pump station and discovered that the existing odor control unit has failed and is no longer functional. It was determined that a new unit is needed to prevent nuisance odors.

 

If approved by Council, this action will award a Construction Contract in the amount of $239,500.00 to Blocka Construction, Inc. of Pleasanton, CA, to replace the odor control unit at Smith Canal Sanitary Pump Station.

 

 

 

 

 

DISCUSSION

 

Background

 

The Municipal Utilities Department (MUD) operates and maintains the Smith Canal Sanitary Pump Station located at 2130 Fontana Avenue. The pump station collects wastewater and pumps it to the Regional Wastewater Control Facility. During a routine maintenance inspection of the pump station, the MUD staff discovered that the existing odor control unit was not functioning properly. It was determined that a new unit is needed to prevent odors from being released to the environment. As part of the 2022-27 Capital Improvement Program, a project was created to replace the odor control unit. Engineering staff prepared the plans and specifications for the project. The project design was completed and placed out to bid for the replacement of the odor control unit.

 

Present Situation

 

On December 19, 2022, the MUD advertised the project in the Stockton Record and published it to the City’s Bid Flash webpage. Additionally, a brief project description notice was mailed to 115 contractors holding a Class “A” license, and 3,185 notifications were sent through Ask Stockton. A non-mandatory pre-bid conference meeting was held on January 12, 2023, with five (5) prospective bidders in attendance. 

 

On Thursday, January 26, 2023, four (4) sealed bids were received and publicly opened by the City Clerk with the following results:

The bid received from the apparent low bidder, Blocka Construction Inc., is regular in all aspects, and compliant with the project specifications.

 

Staff recommends that the City Council award a Construction Contract in the amount of $239,500.00 to Blocka Construction, Inc. of Pleasanton, CA, for the Smith Canal Sanitary Pump Station Odor Control Unit Replacement, Project No. UW23021.

 

Local Employment Ordinance

 

The contract amount is over $100,000 and subject to the Local Employment Ordinance, which requires that “all City contracts for public works or improvements of estimated value or City subsidy of $100,000 or more shall contain provisions pursuant to which the contractor promises to make a good faith effort, with the assistance of local labor union hiring halls or community organizations designated by the City to employ qualified individuals who are, and have been for one year prior to the effective date of the contract, residents of Stockton in sufficient numbers so that no less than 50 percent of the contractor’s total construction workforce, including any subcontractor workforce, measured in labor work hours, is comprised of Stockton residents.” 

 

The Local Preference Ordinance, which states that “preference shall be given to the purchase of supplies, materials, equipment, and contractual services from local merchants, quality and price being equal,” does not apply to the project because all bidders are located outside of San Joaquin County.

 

The project is under $1,000,000 and not subject to the Community Workforce and Training Agreement.

 

Environmental Clearance

 

It has been determined that this project is categorically exempt from the requirements of the California Environmental Quality Act (CEQA) as specified under Article 19, Section 15302, Class 2 (c) of the CEQA guidelines as it involves the replacement or reconstruction of an existing public facility where the new structure will be located on the same site and will have substantially the same purpose and capacity as the structure replaced.

 

In addition, the proposed project is consistent with the Government Code Section 65402 and the 2040 Stockton General Plan (Land Use Policy 6.3) because it improves existing utility services to ensure that all neighborhoods have access to well-maintained public facilities and utilities that meet community service needs.

 

FINANCIAL SUMMARY

 

With this action, MUD Wastewater Utility funds in the amount of $60,000.00 will be appropriated from the Wastewater Utility Fund Balance to the Smith Canal Sanitary Pump Station Odor Control Unit Replacement, Project No. UW23021.

 

There is no impact to the City’s General Fund or any other unrestricted fund from this action.
