RECOMMENDATION

 

It is recommended that the City Council adopt a resolution to:

 

1.                     Approve the filing of Notice of Exemption No. NOE11-22 under the California Environmental Quality Act (CEQA) for the Regional Wastewater Control Facility (RWCF) Bioscrubber Repairs, Project No. UW21011 (Exhibit 1 to the Resolution).

 

2.                     Approve the project Plans and Specifications for the RWCF Bioscrubber Repairs, Project No. UW21011 (Exhibit 2 to the Resolution).

 

3.                     Award a $623,135 Construction Contract to TNT Industrial Contractors, Inc. of Sacramento, CA, for the RWCF Bioscrubber Repairs, Project No. UW21011 (Exhibit 3 to the Resolution).

 

It is further recommended that the City Manager be authorized to take appropriate and necessary actions to carry out the purpose and intent of this resolution.

Summary

 

The Municipal Utilities Department (MUD) operates and maintains the Regional Wastewater Control Facility (RWCF) which includes two (2) onsite biological odor control units (also known as bioscrubbers). The bioscrubbers treat the ventilated air from the headworks building for the reduction of odorous hydrogen sulfide gas (H2S) as well as other airborne constituents. The biological treatment contained within the bioscrubbers include filter media and fiberglass supporting structure. Upon inspection of Bioscrubber No. 1 by maintenance staff, it was discovered that the support structure for the filter media was broken and the bioscrubber tank was cracked. As part of the MUD Capital Improvement Program, a project was created to repair the bioscrubber.

 

If approved by Council, this action will award a Construction Contract in the amount of $623,135 to TNT Industrial Contractors, Inc. of Sacramento, CA, for the RWCF Bioscrubber Repairs.

 

DISCUSSION

 

Background

 

The MUD operates and maintains the RWCF which treats wastewater from the greater Stockton Metropolitan area. The headworks is the first treatment step for raw wastewater entering the treatment plant. The bioscrubbers are critical to provide adequate ventilation and H2S removal in the headworks. The biological treatment contained within the bioscrubbers include filter media and fiberglass supporting structure. Upon inspection of the Bioscrubber No. 1 by maintenance staff, it was discovered that the support structure for the filter media was broken and the bioscrubber tank was cracked. As part of the MUD Capital Improvement Program, a project was created to repair the bioscrubber.

 

Present Situation

 

On July 1, 2022, the MUD advertised the project in the Stockton Record and posted to the City’s Bid Flash webpage. Additionally, a notice with a brief project description was mailed to 103 contractors holding a Class “A” license and 3,445 notifications were sent through Ask Stockton.

 

A non-mandatory pre-bid conference meeting was held on July 14, 2022, with three (3) prospective bidders in attendance. On Thursday, July 28, 2028, three (3) sealed bids were received and publicly opened by the City Clerk with the following results:

The bid submitted by TNT Industrial Contractors, Inc. of Sacramento, CA, is regular in all aspects and compliant with the project specifications. In addition, staff has completed additional due diligence based on Project Specification Section 00100-16, and found no evidence regarding the bidder's financial resources, construction experience, or availability to perform the work that may impact the success of the project.

 

It is recommended that the City Council award a Construction Contract in the amount of $623,135 to TNT Industrial Contractors, Inc. of Sacramento, CA, for the RWCF Bioscrubber Repairs, Project No. UW21011.

 

Local Employment Ordinance

 

The contract amount is over $100,000 and subject to the Local Employment Ordinance, which requires that “all City contracts for public works or improvements of estimated value or City subsidy of $100,000 or more shall contain provisions pursuant to which the contractor promises to make a good faith effort, with the assistance of local labor union hiring halls or community organizations designated by the City to employ qualified individuals who are, and have been for one year prior to the effective date of the contract, residents of Stockton in sufficient numbers so that no less than 50 percent of the contractor’s total construction workforce, including any subcontractor workforce, measured in labor work hours, is comprised of Stockton residents.”

 

The Local Preference Ordinance, which states that “preference shall be given to the purchase of supplies, materials, equipment, and contractual services from local merchants, quality and price being equal,” does not apply to the project because none of the bidders is located within the limits of City of Stockton or San Joaquin County.

 

The project is under $1,000,000 and not subject to the Community Workforce and Training Agreement.

 

Environmental Clearance

 

It has been determined that this project is categorically exempt from the requirements of the California Environmental Quality Act (CEQA) guidelines as specified under Article 19, Section 15302, Class 2 (c) of the CEQA guidelines because it concerns replacement or reconstruction of an existing public facility where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced.

 

In addition, the proposed project is consistent with the 2040 Stockton General Plan (Land Use Policy 6.3) because it improves existing utility services to ensure that all neighborhoods have access to well-maintained public facilities and utilities that meet community service needs.

 

FINANCIAL SUMMARY

 

There are sufficient funds available in the Wastewater CIP account to award the Construction Contract in the amount of $623,135 to TNT Industrial Contractors, Inc. of Sacramento, CA, for the RWCF Bioscrubber Repairs, Project No. UW21011.

 

There is no impact to the City’s General Fund or any other unrestricted fund from this action.
