RECOMMENDATION

 

It is recommended that the City Council adopt a resolution:

 

1.                     Authorizing the granting of a levee easement dedication to Reclamation District 1614 over a portion of a parcel owned by the City of Stockton located at 2130 Fontana Avenue (APN 121-180-32) to facilitate the maintenance and operation of the levee.

 

2.                     Authorizing the City Manager to take appropriate and necessary actions to carry out the purpose and intent of the resolution.

Summary

 

Reclamation District 1614 has requested the dedication of a levee easement over a portion of a parcel owned by the City located at 2130 Fontana Avenue (Attachment A - Vicinity Map, Attachment B - Aerial Map, and Attachment C - Easement Location).  Reclamation District 1614 is requesting the levee easement so that they may have the exclusive power to construct, maintain, operate, and otherwise control the reclamation works. 

 

The FY 2021-22 Adopted Fee Schedule identifies a $1,883.00 Easement Dedication Application Fee.  A copy of the offer detailing the acquisition is attached (Attachment D - Letter Agreement).  The current action will provide Reclamation District 1614 the necessary access to continue the levee maintenance work along Smith Canal.  The access will be used for staging construction equipment and personnel during maintenance and operation activities.

 

DISCUSSION

 

Background

 

Reclamation District 1614 oversees the maintenance and operation of the levee in the area of Smith Tract, providing flood protection for approximately 1,598 acres.  The proposed levee easement is located over a portion of a parcel owned by the City.  The parcel was acquired by the City in 1983 and serves as a pump station.

 

Present Situation

 

Reclamation District 1614 recently completed a rock slope protection project along the levee crown and water side slope via the City of Stockton pump station.  The levee easement will provide the Reclamation District the necessary access for future operation and maintenance activities, which may involve the staging of construction equipment and personnel and the transportation of rock material.

 

City of Stockton staff identified the most applicable fee in the FY 2021-22 Adopted Fee Schedule, which contains an Easement Dedication Application Fee in the amount of $1,883.00.  Therefore, staff recommends the granting of this levee easement dedication for the amount of $1,883.00.

 

NOTIFICATION

 

All City Departments and local utilities were notified of the proposed dedication of an easement at this site.  There are no utilities in the proposed disposition area and no utility easement will need to be reserved over the area.

 

On June 9, 2022, as required by the City Charter Section 510, a Notice of Intention to Grant or Sell Real Property interest was advertised in the legal notice section of The Record ten days prior to Council consideration of this action.

 

ENVIRONMENTAL CLEARANCE

 

It has been determined by the Community Development Department that this action/project is exempt from the requirements of the California Environmental Quality Act (CEQA) and is granted a “Categorical Exemption” under Section 15061(B)(3), since there is no possibility that the activity in question would have significant effect on the environment and the activity is not subject to CEQA.  In accordance with Section 65402 of the Government Code, the Community Development Department further determined that this activity/project conforms to the City’s General Plan Policy Document, as amended.

 

FINANCIAL SUMMARY

 

If approved, the $1,883 application fee will be deposited into the General Fund, non-departmental, Misc. Other Revenues account.  All of the advertising costs necessary to process the granting of easement interests to Reclamation District 1614, approximately $500, will be paid from the Economic Development Department’s General Fund, Asset Management Division, Real Property program, Publicity and Advertising account.
