AUTHORIZE SUBMITTAL OF GRANT APPLICATIONS FOR AQUATIC FACILITIES AND DENTONI PARK IMPROVEMENTS, AUTHORIZE THE EXECUTION OF TWO CONTRACTS WITH THE STATE OF CALIFORNIA, AMEND THE FISCAL YEAR 2021-22 ANNUAL BUDGET, APPROVE THE PURCHASE AND INSTALLATION OF NEW PLAYGROUND EQUIPMENT AT DENTONI PARK

RECOMMENDATION

 

It is recommended that the City Council adopt three resolutions.

 

Resolution No. 1:

 

1.                     Authorize the City Manager to submit grant applications to the California State Parks Local Assistance Specified Grants via the California Department of Parks and Recreation Office of Grants and Local Services for two projects:

 

                     Aquatic Facilities Renovation & Replacement in the amount of $5,400,000; and

 

                     Dentoni Park Playground Equipment Replacement in the amount of $250,000.

 

2.                     Authorize the City Manager to accept the grant awards, conduct all negotiations, sign, and submit all documents including applications, amendments, and all payment requests, and make all necessary appropriations in compliance with and for the purposes stated in the grant applications.

 

Resolution No. 2:

 

1.                     Approve Notice of Exemption Nos. NOE68-21 and NOE69-21 under the California Environmental Quality Act for the renovation of aquatics facilities and replacement of Dentoni Park playground equipment, respectively.

 

Resolution No. 3:

 

1.                     Amend the Fiscal Year 2021-22 Annual Budget to appropriate additional funds from the California Department of Parks and Recreation Office of Grants and Local Services in the amount of:

 

                     $2,700,000 to the Aquatic Facilities Renovation & Replacement, Project No. CR18020 for the replacement of the Victory Park pool.

 

                     $2,700,000 to the McKinley Park Renovation, Project No. WR21017 for the renovation of the McKinley Park pool; and

 

                     $250,000 to the Dentoni Park Playground Equipment Replacement, Project No. WP22035.

 

2.                     Approve findings pursuant to the Stockton Municipal Code section 3.68.070 in support of an exception to the competitive bidding process.

 

3.                     Approve the use of a Cooperative Purchasing Agreement through Sourcewell Contract No. 010521-BUR, to provide the City access to preferential pricing programs from BCI Burke Company, LLC, and its regional representative, Specified Play Equipment Co.

 

4.                     Approve a contract in the amount of $150,231.13 with BCI Burke Company, LLC for the purchase of new playground equipment at Dentoni Park.

 

It is also recommended that the City Manager be authorized to take appropriate and necessary actions to carry out the purpose and intent of this resolution.

Summary

 

The approval of the 2021-22 California State Budget SB 129, Chapter 69, Statutes of 2201 as amended by SB170, Chapter 240, Statutes of 2021 included two budget allocation items (“Projects”) specific to the City of Stockton in Section 174:

 

                     Item Number 116:  $5,400,000 for City of Stockton Aquatic Facilities; and

 

                     Item Number 51:  $250,000 for Dentoni Park.

 

These Local Assistance Specified Grants provide agency and project-specific budget allocations. The Grant agency requires a resolution for the Projects to be adopted before submission of a grant application for each of the two projects. Although considered grants, they are not competitive in nature and the City is guaranteed the allocated funds.

 

Staff recommends the submittal of two grant applications in the amounts of $5,400,000 and $250,000 for the Local Assistance Specified Grants. The grant performance period runs from July 1, 2021 through June 30, 2024.

 

Staff also recommends that Council approve a Cooperative Purchasing Agreement through Sourcewell in the amount of $150,231.13 for the purchase of new playground equipment at Dentoni Park.

 

DISCUSSION

 

Background

 

The Fiscal Year 2021-22 State Budget included millions of dollars in direct funding to critical programs throughout California. Stockton received two direct allocations through the leadership of local elected officials who recommended legislation to support families in need by strengthening recreation opportunities in Stockton. The legislative action provided an allocation of funds for City of Stockton Aquatic Facilities and Dentoni Park to expand access to recreation and parks in underserved communities and urban populations.

 

These Local Assistance Specified Grants provide agency and project-specific budget allocations. The Grant agency requires resolutions for the projects to be adopted before submission of a grant application for each of the two projects. These allocated grants were identified in the budget process and are intended to encourage healthy communities through parks and recreation opportunities.

 

Present Situation

 

The State of California specified two grants for the City of Stockton which originated from line items in the State of California Budget for Fiscal Year 2021-22:  City of Stockton Aquatic Facilities and Dentoni Park.

 

Aquatic Facilities

 

The Legislative funds of $5,400,000 can be used for repair and replacement of aquatic amenities. These funds are recommended for use in conjunction with Strong Communities funding for the Victory and McKinley pool projects that have been negatively impacted by inflation and increased project costs.

 

                     Victory Park Pool Replacement - This project is included in the 2021-2026 Capital Improvement Program with $1,500,000 in Strong Communities funding identified for Fiscal Year 2021-22. In response to significant community advocacy, staff recommends allocating $2,700,000 in SB 129 funds to increase the size of the planned pool to accommodate four swim lanes.

 

                     McKinley Park Renovation - This project which includes renovation of the existing pool is funded by Proposition 68 and supplemented by $1.8 million of Strong Communities funding specifically for the pool. Staff recommends allocating $2,700,000 in SB 129 funds to close the funding gap for the pool and pool house renovations.

 

Dentoni Park

 

The recommended legislative funds of $250,000 for the Dentoni Park Playground Equipment Replacement Park project will improve playground surfacing and replace the 40-year-old timber and steel playground equipment which is in very poor condition. Staff recommends the purchase of playground equipment at Dentoni Park through a Cooperative Purchasing Agreement through Sourcewell.

 

Sourcewell is a public agency based in Minnesota that serves as a municipal contracting agency.  Sourcewell contracts have been competitively bid, solicited, nationally reviewed, evaluated by a committee, and recommended to the Sourcewell Board of Directors for consideration of award. The use of these contracts is optional and is available to California State and local government agencies.  Sourcewell has a multiple award contract for playground equipment.BCI Burke Company, LLC is one of the contractors under Sourcewell’s multiple award contract and Specified Play Equipment Co is their authorized dealer.

 

The specifications for the playground equipment (Attachment A) available through the Sourcewell contract meet the City’s requirement for this type of equipment. By accessing this type of Cooperative Purchasing Agreement, administrative costs are reduced because Sourcewell obtains low bids for volume purchasing, and local agencies avoid the expense associated with conducting the bid process. Staff time and associated costs to develop specifications and prepare documents are minimized.

 

 

Staff recommends Council approve the purchase of new playground equipment at Dentoni Park in the amount of $150,231.13 with BCI Burke Company, LLC.

 

Findings

 

Pursuant to Stockton Municipal Code (SMC) section 3.68.070, Council may approve findings which support an exception to the competitive bidding process. These findings include:

 

1.                     Sourcewell established a Cooperative Purchasing Agreement for the purchase of playground equipment and other parks amenities.

 

2.                     The BCI Burke Company, LLC Purchasing Agreement that includes other vendors was established pursuant to a formal competitive bidding process conducted by Sourcewell on behalf of its governmental members, of which the City is one.

 

3.                     The procurement process used by Sourcewell has been reviewed and is compliant with the City’s procurement standards.

 

4.                     Utilizing the Sourcewell Cooperative Agreement will save the administrative expense of City staff conducting separate procurements.

 

5.                     SMC section 3.68.070.A.5 allows exceptions to competitive bidding for Cooperative Purchasing Agreements authorized by Council for the purchase of supplies or services through other governmental jurisdictions or public agencies.

 

Both grant awards require City Council approval of the grant application terms by resolution. The grant applications will require each Project to administer and complete plans in accordance with the project scope, procedural guides, and accounting rules. The deadline for grant applications is December 31, 2021, which will allow time for the contract approval. The contract must be fully attested by January 31, 2022.

 

FINANCIAL SUMMARY

 

There is no matching fund requirement for the project grants.

 

Aquatic Facilities

 

Public Works Engineering Division staff will manage the aquatics projects in coordination with Community Services staff. The following appropriations will provide sufficient funding to complete the Victory Park Pool Replacement and McKinley Park Renovation projects:

 

                     Increase State Grant Revenue Fund, account number 0000-000-430201-300-000-00-00-000-000- in the amount of $5,400,000.

 

                     Appropriate SB 129 funds in the amount of $2,700,000 to the Aquatic Facilities Renovation & Replacement, Project No. CR18020, account number 4540-000-800007-300-000-30-45-000-000- for the replacement of the Victory Park pool; and

 

                     Appropriate SB 129 funds in the amount of $2,700,000 to the McKinley Park Renovation, Project No. WR21017, account number 4510-000-800007-300-000-30-45-000-000-.

 

Dentoni Park

 

The Public Works Department will deliver the Dentoni Park Playground Equipment Replacement project. The following appropriations will provide sufficient funding to approve a contract in the amount of $150,231.13 with BCI Burke Company, LLC for the purchase of playground equipment at Dentoni Park:

 

                     Increase State Grant Revenue Fund, account number 0000-000-430201-300-000-00-00-000-000- in the amount of $250,000; and

 

                     Appropriate SB 129 funds in the amount of $250,000 to the Dentoni Park Playground Equipment Replacement, Project No. WP22035, account number 4510-000-800007-300-000-30-45-000-000-.

 

There is no impact to the City’s General Fund or any other unrestricted funds as a result of taking this recommended action.
