APPROVE MOTION TO AUTHORIZE THE THORNTON ROAD WIDENING - CURB, GUTTER, AND SIDEWALK PROJECT

It is recommended that the City Council approve a motion to:

 

1.                     Approve the plans and specifications for the Thornton Road Widening - Curb, Gutter, and Sidewalk, Project No. WT14028.

 

2.                     Award a Construction Contract in the amount of $41,445.89 to HBC Enterprises of Clovis, CA, for the Thornton Road Widening - Curb, Gutter, and Sidewalk, Project No. WT14028.

 

It is also recommended that the City Manager be authorized to take appropriate and necessary actions to carry out the purpose and intent of this motion.

Summary

 

The project will remove temporary asphalt concrete sidewalk and replace with concrete curb, gutter, and sidewalk, and a driveway to access the levee on Thornton Road just south of the Bear Creek bridge (Attachment A - Vicinity Map).  These improvements could not be permanently constructed during the original Thornton Road Widening project, because the City did not have the required environmental permit to construct near the bridge levee.  The permits have now been obtained, so the originally intended improvements can now be constructed.  The project is locally funded through Public Facilities Fees and was included in the 2014-19 Five-Year Capital Improvement Plan (CIP).

 

On April 1, 2021, the City received eight bids for this project.  Staff recommends award of the Construction Contract to the lowest responsible bidder, HBC Enterprises, in the amount of $41,445.89.  Staff also recommends that Council approve a motion approving the plans and specifications for the project.  On September 11, 2007, by Resolution No. 07-0382, Council approved the Initial Study/Mitigated Negative Declaration and adopted the Findings and Mitigation Monitoring/Reporting Program California Environmental Quality Act documents for the original Thornton Road Widening project. Construction is anticipated to be completed by October 2021.

 

DISCUSSION

 

Background

 

The Thornton Road Widening project began construction in 2016 and was completed in 2019.  The project widened Thornton Road between Pershing Avenue and Bear Creek from two to four lanes with buffered bicycle lanes, traffic signal improvements, curbs, gutters, sidewalks, and landscaping.  The project was included in the 2014-19 Five-Year CIP.

 

During construction of the Thornton Road Widening project, the City was unable to construct permanent sidewalk facilities on Thornton Road near the Bear Creek bridge because the City did not have the required environmental permit from the Central Valley Flood Protection Board.  The permit has now been issued, allowing the City to complete construction of approximately 85 linear-feet of concrete curb, gutter, and sidewalk, and a driveway to access the levee.  The Public Works Department prepared the Plans, Specifications, and Estimate for this project, and the design was completed in March 2021.

 

On July 26, 2016, Council adopted a Community Workforce and Training Agreement (CWTA).  The CWTA became effective August 25, 2016, and applies to all Public Works projects over $1 million that are bid after that date. On July 16, 2019, by Motion No. 2019-07-16-1403, Council extended the CWTA term to August 25, 2024.  The CWTA was not applied to this project as the lowest bid amount is less than $1 million.

 

Present Situation

 

On March 15, 2021, the Thornton Road Widening - Curb, Gutter, and Sidewalk, Project No. WT14028, was advertised for bids.  On April 1, 2021, eight bids were received with the following results:

The requirements of Stockton Municipal Code (SMC) section 3.68.090, Local Business Preference, apply to this project. Application of the Local Business Preference has no effect on the bid result.  The Local Employment Ordinance, SMC section 3.68.095, also applies to this project.

 

MCE Corporation was the lowest bidder.  However, two errors were found in MCE Corporation’s bid schedule, which lowered their bid from $29,610.00 to $26,266.00. MCE Corporation is unable to perform the work for $26,266.00.  Public Works’ staff consulted with the City Attorney’s Office, who advised that because of MCE Corporation’s bid errors, the City can award the Construction Contract to the next lowest bidder.

 

The Local Business Preference was only applied to one bidder, McFadden Construction, Inc., which is located outside of City of Stockton limits, but within San Joaquin County limits. A two percent bid preference was applied to the bid from McFadden Construction, Inc. The bid from HBC Enterprises is $41,445.89, which is lower than the bid from McFadden Construction, Inc.  Therefore, HBC Enterprises is the lowest responsible bidder. 

 

The bid from HBC Enterprises is regular in all respects.  HBC Enterprises has the proper license to perform the work. Staff recommends Council approve the plans and specifications for the project and award a Construction Contract to HBC Enterprises of Clovis, CA, in the amount of $41,445.89 (Attachment B).

 

On September 11, 2007, by Resolution No. 07-0382, Council approved the Initial Study/Mitigated Negative Declaration and adopted the Findings and Mitigation Monitoring/Reporting Program California Environmental Quality Act documents for the original Thornton Road Widening project.  All project improvements for the Thornton Road Widening - Curb, Gutter, and Sidewalk project were contemplated in the environmental document for the Thornton Road Widening project, so no further environmental analysis is needed.

 

FINANCIAL SUMMARY

 

Sufficient funds are available in Thornton Road Widening - Curb, Gutter, and Sidewalk, Project No. WT14028 (formerly PW1428), Account No. 4570-000-800007-300-000-30-45-000-000, to award a Construction Contract to HBC Enterprises in the amount of $41,445.89.

 

There is no impact to the City’s General Fund or any other unrestricted fund as a result of taking the recommended action.
