It is recommended that the City Council approve a motion to:

 

1.                     Authorize the City Manager to execute a sole source purchase of twenty-two (22) upgrades to City owned cardiac monitors/defibrillators and preventative maintenance services from Zoll Medical Corporation in the amount of $119,948.68; and

 

2.                     Approve findings for an exception to the competitive bidding process; and

 

It is also recommended that the City Council authorize the City Manager to take appropriate and necessary actions to carry out the purpose and intent of this motion.

Summary

 

The Stockton Fire Department (SFD) is an Advanced Life Support (ALS) Provider in San Joaquin County that has been providing ALS paramedic care since 1976. SFD’s paramedic truck and engine companies are currently equipped with Zoll X Series monitors/defibrillators that were purchased in 2019. The purchase of the twenty-two (22) monitors/defibrillators was approved by City Council on April 30, 2019 (motion 2019-04-30-1104 through Zoll Medical Corporation (Zoll) utilizing the Los Angeles County competitive process (contract no. MA-IS-1540197-11) in the amount of $702,724.00.

 

When the original monitors/defibrillators were purchased, Zoll informed the City of Stockton they would upgrade the purchased X Series monitors to their latest series, should the company introduce new technology to the market over the next two years. Zoll introduced new technology and has advised the City has until July 2021 to exercise the option to upgrade to the X Series Advanced monitors/defibrillators.

 

Staff recommends a sole-source purchase with Zoll for twenty-two (22) upgrades for cardiac monitors/defibrillators to the X Series Advanced monitors and preventative maintenance services in the amount not to exceed $119,948.68 (Attachment A).

 

DISCUSSION

 

Background

 

SFD is an ALS Provider in San Joaquin County that has been providing ALS paramedic care since 1976. All ALS response apparatus of the SFD are equipped with a cardiac monitor as part of EMS delivery and as required by the ALS agreement between the SFD and the San Joaquin County Emergency Medical Service Agency. The department currently has a total of twenty-two (22) cardiac monitors/defibrillators on its truck and engine companies and for use as reserve devices for equipping additional ALS paramedic teams for City events or extraordinary emergencies and training purposes.  Equipment assignments are as follows:   

 

                     Twelve (12) on Engine Companies;

 

                     Three (3) on Truck Companies;

 

                     Three (3) for city events or extraordinary emergencies;

 

                     Two (2) are placed in service for repairs and maintenance of out of service units; and

 

                     Two (2) for Division of Training for Quarterly Skills, EMS Tower Drills, CQI process, and remediation training.

 

The current cardiac monitors/defibrillators were purchased in 2019. The purchase of the twenty-two (22) monitors/defibrillators was approved by City Council on April 30, 2019, (motion 2019-04-30-1104), utilizing the Los Angeles County competitive process (contract no. MA-IS-1540197-11) in the amount of $702,724.00.

 

Present Situation

 

When the original monitors/defibrillators were purchased, the City of Stockton was advised Zoll would upgrade the purchased X Series monitors to the latest technology, should the company introduce new technology, which they did, to the market over the next two years. Zoll advised the City has until July 2021 to exercise the option to upgrade to the X Series Advanced monitors. The upgraded twenty-two (22) Zoll X Series Advanced cardiac monitors/defibrillators will be acquired through a sole source purchase.  Zoll has also extended the preventative maintenance coverage on the devices until August 2026, as indicated in the attached letter dated March 22, 2021 (Attachment B). Additionally, Zoll will upgrade the purchased X Series Advanced monitors to their latest technology if a new cardiac monitor is introduced to the market by Zoll over the next two (2) years (Attachment C).

 

Cardiac monitors/defibrillators are a critical medical device used by paramedics to assess and treat potentially lethal cardiac arrythmias. The X Series Advanced upgraded monitors provide enhanced technology to improve patient care. The latest model includes a new carry case, a temperature probe, Real-Time Bag Valve Mask (BVM) Help, and a Traumatic Brain Injury (TBI) dashboard.  This upgrade will add additional features to assist with COVID-19 cleaning measures and ultimately provide increased monitoring capability and higher diagnostic ability levels for SFD Paramedics.

 

SFD’s goal is to provide a higher level of life-saving ability to the citizens of Stockton and Fire contract areas. This upgrade will reset the end-of-life date on the current monitors/defibrillators and potentially extend the date until 2032.

 

Zoll is the manufacturer of the X Series / X Series Advanced monitors and is the only authorized vendor for upgrade and service based on proprietary parts, system requirements, and contractual warranty language.

 

The City of Stockton will work with Zoll to develop a purchasing agreement for a guaranteed purchasing price on all future related equipment/consumables.

 

FINDINGS

 

Stockton Municipal Code section 3.68.070(A)(4) provides an exception to the competitive bidding process for sole source vendors in cases where the City Council has approved findings that support and justify the exception. The proposed findings are as follows:

 

1.                     Cardiac monitors/defibrillators are a critical medical device used by paramedics to assess and treat potentially lethal cardiac rhythms. The X Series Advanced upgraded monitors provide further technology to improve patient care.

 

2.                     When the original monitors/defibrillators were purchased utilizing the Los Angeles County competitive process (contract no. MA-IS-1540197-11), the City of Stockton contractually engaged Zoll to upgrade purchased X Series monitors to their latest monitors, should the company introduce new technology to the market over the next two years. Zoll did introduce new technology and has advised the City has until July 2021 to exercise the option to upgrade to the X Series Advanced monitors/defibrillators.

 

3.                     Zoll is the manufacturer of the X Series / X Series Advanced monitors and is the only authorized vendor for upgrade and service based on proprietary parts, system requirements, and contractual warranty language.

 

4.                     The Zoll Medical Corporation X Series Advanced cardiac monitors/defibrillator was thoroughly evaluated and identified as meeting and exceeding the operational requirements for use by fire department ALS paramedics.

 

Staff recommends a sole-source purchase with Zoll for twenty-two (22) upgraded cardiac monitors/defibrillators to the X Series Advanced monitors and preventative maintenance services in the amount not to exceed $119,948.68.

 

FINANCIAL SUMMARY

 

Funding for the cost of twenty-two (22) upgraded monitors/defibrillators is available in General Fund Fire Department Materials and Supplies account 4020-000-650001-100-000-20-40-000-000 in the amount of $119,948,68.
