RECOMMENDATION

 

It is recommended that City Council adopt a resolution:

 

1.                     Reappointing Commissioner Jay Allen to the Stockton Port Commission, for a term commencing immediately and ending January 15, 2024.

 

2.                     Extending the term of Stephen Griffen to end January 15, 2022.

 

3.                     Extending the term of Anthony Barkett to end January 15, 2023.

Summary

 

On June 30, 2020, Commissioner Allen’s term on the Stockton Port Commission expired creating the vacancy to be filled. In January 2020, the City Clerk’s Office conducted a recruitment to fill the vacancy and scheduled interviews with the qualified applicants. Interviews were held on August 25, 2020 at which the incumbent, Jay Allen was the only applicant to appear.

 

DISCUSSION

 

Background

 

The Stockton Port Commission consists of seven members, with three members appointed by the County Board of Supervisors, and four members appointed by the City Council. The function of the Stockton Port Commission is to exercise general supervision over the Port of Stockton by adopting general rules and regulations which, in its judgment, will best promote the interests of the Port as established under State law.

 

A discrepancy in the terms of current members of the Stockton Port Commission was discovered during this appointment process. To realign with the original terms established by the Harbors and Navigation Code, Section 6240.3, in collaboration with Port Director Richard Aschieris, staff is recommending that the term of Stephen Griffen extend to January 15, 2022 and the term of Anthony Barkett extend to January 15, 2023. This aligns with the guidance set forth in the Harbors and Navigation Code and provides appropriate staggering of terms.

 

Present Situation

 

With Jay Allen being the only applicant to interview, Council Policy 3.02 Section 11. F. provides that if the number of applicants is less than or equal to the number of vacancies, Council may proceed to fill any number of vacancies from the available list.  Subject to Council ratification, it is recommended that Jay Allen be appointed to a four-year term commencing immediately and ending January 15, 2024.

 

FINANCIAL SUMMARY

 

Members of the Port Commissioner do not receive remuneration. There is no financial impact to the General Fund in making this appointment.
