ADOPT A RESOLUTION OF INTENTION TO FORM A NEW DISTRICT WITHIN THE STOCKTON INDUSTRIAL STORM DRAINAGE BASIN MAINTENANCE ASSESSMENT DISTRICTS

RECOMMENDATION

 

It is recommended that the City Council approve a Resolution of Intention to:

 

1.                     Form a new District (Stockton Industrial Storm Drainage Basin Maintenance Assessment District, North Newcastle, Project 20-1) to maintain and operate storm drainage improvements, providing for annual assessments for the costs and expenses thereof.

 

2.                     Specify that the public interest would be served by establishing the Zone and levying annual assessments for the costs to operate the storm drainage improvements.

 

3.                     Preliminarily approve Engineer’s Report, approve a proposed boundary map, and appoint Engineer of Work.

 

4.                     Set date for the Public Hearing of Protests and provide for Property Owner Ballots on December 15, 2020, and direct the City Clerk to mail a public notice to the affected property owners at least forty-five days before the hearing date. (To be mailed by October 30, 2020.)

 

It is also recommended that the City Manager be authorized to take appropriate and necessary action to carry out the purpose and intent of the resolution.

Summary

 

As a condition of their subdivision agreements, industrial development is typically required to form a maintenance district to maintain the storm drainage basins. This maintenance includes spraying for weeds and rodents, maintenance of fences and pump station, and general upkeep of the basin.

 

To fund the ongoing operation and maintenance of the stormwater basin and pump station, it will be necessary to add a new City of Stockton Industrial Storm Drainage Basin Maintenance Assessment District, North Newcastle, to the existing five Districts. The cost of the annual operation and maintenance of the improvements are hereby referred to Siegfried Engineering, Inc., of Stockton, as the Engineer of Work for this district (the “Engineer of Work”), and the Engineer’s Report is attached for preliminary review and approval (Attachment A). A Public Hearing will be necessary, and if adopted the Resolution would schedule the hearing on December 15, 2020. Staff recommends that Council adopt the proposed Resolution.

 

 

 

DISCUSSION

 

Background

 

The City Council, pursuant to various resolutions in previous years, ordered the formation of five storm drainage basins districts (Attachment B). Formation of a District is conducted pursuant to the Municipal Improvement Act of 1913 (Act) and the Stockton Improvement Procedure Code (Stockton Municipal Code).

 

As a condition of their subdivision agreements, development is required to form a maintenance district to maintain the storm drainage basins. This maintenance includes spraying for weeds and rodents, maintenance of fences, operations and maintenance of pump stations, and general upkeep of the basins.

 

North Newcastle Storm Pump Station and Basin Assessment District No. 20-1 consists of 378.48 acres and 16 commercial lots, open space, pump station, and a detention basin. The project is located north of Arch Road, south of Mariposa Road along Newcastle Road and Logistics Drive as shown on the attached Location Map (Attachment C).

 

Present Situation

 

As part of the Conditions of Approval for any development project, the Owners/Developers/Successors-in-Interest (ODS) are required to install certain public stormwater quality improvements and provide operations and maintenance services for the proposed treatment features. North Newcastle Storm Pump Station and Basin Assessment District No. 20-1 is being formed to provide funding for the continued operation, maintenance and replacement costs of the proposed stormwater Drainage District. The funding for North Newcastle Storm Pump Station and Basin Assessment District No. 20-1 will be provided through an annual assessment based on the stormwater runoff from individual parcels. The annual budgets for such tasks will be presented each year to the City Council for approval for the North Newcastle Storm Pump Station and Basin Assessment District No. 20-1.

 

The City Council, pursuant to Resolution Numbers 85-0416, 86-1059, 88-0492, 88-0552, and 99-0400, authorized the formation of the five industrial storm drainage basin maintenance districts. The formation of these districts was based on the provisions of the Municipal Improvement Act of 1913 (Act) and the Stockton Improvement Procedure Code (Stockton Code). The Act and the Stockton Code contain provisions for the City to form assessment districts for the maintenance and operation of improvements that impart a special benefit to an area.

 

The purpose of these Districts is to provide funding for the operations and maintenance of the storm drainage basins and the associated improvements. The maintenance includes vector control; weed abatement, rodent control, slope dressing; mowing, disking; grading the basin bottom as needed, trash and debris pick-up and removal; pump station maintenance; cleaning of the basin structures; and sedimentation relocation. Property owners within a District are responsible for funding only those improvements within the District from which they receive benefit.

 

North Newcastle Storm Pump Station and Basin Assessment District No. 20-1 will become part of the five existing Stockton Industrial Storm Drainage Basin Maintenance Assessment Districts by adopting the above resolution. The total assessment is spread among the parcels in the Assessment District in proportion to the incremental special benefit a parcel receives from the stormwater basin and pump station. Parcels APN 179-220-44, 179-220-45 and a portion of parcel 179-220-40 (totaling 8,435 square feet) will be dedicated to the City for the basin and pump station. The maximum annual maintenance assessment for the North Newcastle Storm Pump Station and Basin Assessment District No. 20-1 will be $78,164.05. The maximum annual assessment includes a yearly increase, which is the greater of three percent (3.00%), or the yearly increase of the Consumer Price Index (CPI), if required by increased costs of maintenance.

 

FINANCIAL SUMMARY

 

The City of Stockton has no financial contribution related to the formation of the North Newcastle Storm Pump Station and Basin Assessment District No. 20-1 or the annual maintenance costs. All fees and other costs and expenses incurred are payable solely by the annual tax roll by the owner/developer of the property in the proposed district.

 

The formation of this new District will result in approval of a maximum assessment. The actual FY 2021-2022 levy on developed parcels will be determined and budgeted during the annual budgets and assessments for industrial storm drainage basin maintenance districts budget process.
