RECOMMENDATION

 

It is recommended that the City Council adopt a resolution to:

 

1.                     Appoint Anuit Albahar, Maximilian Cao, Evai Dellafosse, Tina DeZuniga, Lindsay Heimm, Dru Hunt, Michael Oliva, and Kevin Pontuti to the Stockton Arts Commission with term to commence immediately upon approval;

 

2.                     Set new Commissioner terms to create staggered vacancies; and

3.                     Authorize the City Manager to take whatever actions are appropriate and necessary to carry out the purpose and intent of this Resolution.

Summary

 

The Stockton Arts Commission (SAC) membership is defined by Stockton Municipal Code section 2.94.040 as a 15-member board appointed by the Mayor with approval of the City Council for a term of four years. There is a total of eight (8) vacancies on  SAC as of February 4, 2019. Five vacancies are due to the expiration of member terms on December 31, 2018, two vacancies occurred as the result of commissioner resignations, and one vacancy occurred when a recommended candidate was found to not have residency within Stockton City limits.

 

In 2018 and 2019 the Stockton City Clerk conducted recruitment campaigns for new members and also accepted applications on a continuous basis throughout the year. Thirteen applications were received and forwarded to SAC.  A nominating committee of Arts Commissioners selected nine applicants to interview and conducted interviews on February 22, 2019. On March 4, 2019, the nominating committee presented a recommendation to SAC to fill the eight vacancies.  The commission voted unanimously to recommend the appointment of Anuit Albahar, Maximilian Cao, Evai Dellafosse, Tina DeZuniga, Lindsay Heimm, Dru Hunt, Michael Oliva and Kevin Pontuti to the Stockton Arts Commission. Staff conducted a random drawing to select term lengths for new members following Council approval: Anuit Albahar, Evai Dellafosse, Tina DeZuniga, Michael Oliva and Kevin Pontuti to serve terms ending December 31, 2022; Maximilian Cao and Lindsay Heimm to serve terms ending December 31, 2020; and Dru Hunt to serve a term ending December 31, 2019. All appointees will have the opportunity to reapply for full four-year appointments at the end of their respective terms.

 

 

DISCUSSION

 

Background

 

The Stockton Arts Commission is composed of 15 members. There are currently eight vacancies. Five vacancies were expected due to the expiration of member terms on December 31, 2018. Two vacancies occurred after the City received letters of resignation on December 3, 2018, and February 4, 2019. One vacancy has remained unfilled since January 1, 2018, when a recommended member was not appointed following verification that their address was not within in the official City limits of Stockton.  

 

In accordance with Council Policy, Title 3 chapter 3.02, the City Clerk initiated a recruitment process. The recruitment for new Commissioners was advertised from February 26, 2018, through April 6, 2018, and January 14, 2019, through April 11, 2019. The vacancy announcement was posted on the City’s Boards, and Commissions web page and print copies were posted on the City’s public posting boards. The City Clerk’s office also accepted applications continuously throughout the year. At the conclusion of the recruitment period, 13 applications were received. 

 

In accordance with City Council Policy Manual Chapter 3.02, City Council and Mayoral Appointments to Committees, Boards, and Commissions, and Resolution 2018-02-27-1110, the City Clerk forwarded the 13 applications to the SAC to conduct Interviews. The nominating subcommittee selected nine applicants to interview. Interviews were conducted on February 22, 2019, and a recommendation to fill the eight vacancies was submitted to the full Commission. On March 4, 2019, the full Commission unanimously approved the recommendation.

 

 

Present Situation

 

The SAC has approved a recommendation of eight new members for Council consideration. Pursuant to Stockton Municipal Code section 2.94.040, the Mayor and City Council are responsible for appointing members to the SAC.

 

Stockton Municipal Code section 2.94.040 B. 1 also states “The City Council may by written policy institute terms of less than four (4) years initially and whenever necessary in order to create staggered vacancies…”. To prevent a majority of Commissioner terms ending at the same time, Staff has completed a random drawing process and recommends staggering terms as follows upon Council approval: Anuit Albahar, Evai Dellafosse, Tina DeZuniga, Michael Oliva and Kevin Pontuti to serve terms ending December 31, 2022; Maximilian Cao and Lindsay Heimm to serve terms ending December 31, 2020, and Dru Hunt to serve a term ending December 31, 2019. All appointees will have the opportunity to reapply for full four-year appointments at the end of their respective terms.

FINANCIAL SUMMARY

 

The Stockton Arts Commission receives no remuneration. There is no direct financial impact to the City by taking this action.
