APPROVE RESOLUTION TO AUTHORIZE THE SB1 FUNDED 2018 SLURRY SEAL

RECOMMENDATION

 

It is recommended that the City Council adopt a resolution to:

 

1.                     Approve the Notice of Exemption No. CE16-18 under the California Environmental Quality Act for the 2018 Slurry Seal, Project No. PW1730.

 

2.                     Approve the plans and specifications for the 2018 Slurry Seal, Project No. PW1730.

 

3.                     Award a Construction Contract in the amount of $473,337 to California Pavement Maintenance Company, Inc. of Sacramento, CA, for the 2018 Slurry Seal, Project No. PW1730.

 

4.                     Approve the project name change from “Microsurfacing of City Streets, Project No. PW1730” as initially approved by Council on September 19, 2017, by Resolution No. 2017-09-19-1116, to “2018 Slurry Seal, Project No. PW1730”.

 

It is also recommended that the City Manager be authorized to take appropriate and necessary actions to carry out the purpose and intent of this resolution.

Summary

 

The Slurry Seal project will resurface various residential roadways citywide for a total distance of approximately 11 centerline miles (Attachment A - Project Location Map).  A slurry seal is the application of a mixture of water, asphalt emulsion, aggregate (very small crushed rock), and additives to an existing asphalt pavement surface.  The placement of this mixture on existing pavement seals the surface and is a highly cost-effective treatment for extending the life of streets that are in fair to good condition with a Pavement Condition Index (PCI) rating near or above 70. The PCI score for the streets segments chosen for the 2018 Slurry Seal project range between 70 and 90.  The project will be funded from the City’s Senate Bill 1 (SB1) allocation.  SB1, The Road Repair and Accountability Act of 2017, provides an annual allocation of funds to the City to address significant maintenance, rehabilitation, and safety needs on our local streets.

 

On May 31, 2018, the City received six bids for this project.  Staff recommends award of the Construction Contract to the lowest responsive bidder, California Pavement Maintenance Company, Inc., in the amount of $473,337.  Staff also recommends Council adopt a resolution approving the Notice of Exemption No. CE16-18 under the California Environmental Quality Act (CEQA), approving the plans and specifications for the project, and approve the project name change from “Microsurfacing of City Streets, Project No. PW1730” to “2018 Slurry Seal, Project No. PW1730”.

 

Construction is anticipated to begin in summer 2018, and be completed in fall 2018, weather permitting.

 

DISCUSSION

 

Background

 

On April 28, 2017, Governor Brown signed SB1, the Road Repair and Accountability Act of 2017.  SB1 provides the first significant, stable, and ongoing increase in State transportation funding in more than two decades.  The funding will provide for basic road maintenance, rehabilitation, and critical safety needs on both the State highway and local streets and road systems.  The Legislature tasked the California Transportation Commission (CTC) with oversight of funding and/or programs created with the approval of SB1.  

 

SB1 provides funding of a new program called the Road Maintenance and Rehabilitation Account (RMRA) Program.  Other programs include the Local Partnership Program, the Active Transportation Program, the State Highway Operation and Protection Program, and the Local Streets and Roads Program.  The RMRA funding will become part of the overall Gas Tax allocation; however, RMRA funds can only be expended on projects that meet eligibility criteria and have been approved by the CTC.  RMRA funds are to be accounted for and reported separately from the regular Gas Tax funds. 

 

An estimated $1,783,124 in SB1 RMRA Program funding was allocated to the City for FY 2017-18.  On September 19, 2017, Council approved expenditure of these funds on four projects (Resolution No. 2017-09-19-1116).  One of the approved projects was Microsurfacing of City Streets, Project No. PW1730.  After a detailed analysis of the project roadways, a slurry seal resurfacing treatment was determined to be more appropriate than a microsurfacing treatment.  To ensure that there are no issues with future audits of SB1 expenditures, staff recommends Council approve a revision of the project name to 2018 Slurry Seal, Project No. PW1730.

To determine which roadway segments should be included with the 2018 Slurry Seal project, Public Works utilized a Pavement Management System, which uses variables such as current pavement condition and projected traffic load to forecast how roadway segments will decline over time.  The Pavement Management System uses these forecasts to recommend a pavement resurfacing treatment plan.  The current pavement condition is numerically represented by the PCI, which is calculated for each roadway segment utilizing a nationally standardized method. A PCI rating of 100 means the street is in perfect condition.  A zero means the road has no functioning surface. Slurry seal resurfacing is a highly cost-effective treatment for extending the life of streets that are in fair to good condition (PCI ratings near or above 70).  The PCI score for the streets segments chosen for the 2018 Slurry Seal project range between 70 and 90.  On July 26, 2016, Council adopted a Community Workforce and Training Agreement (CWTA).  The CWTA became effective August 25, 2016, and applies to all Public Works projects over $1 million that are bid after that date.  The CWTA was not applied to this project, as the estimated construction cost is less than $1 million.

 

Present Situation

 

On May 1, 2018, the 2018 Slurry Seal project was advertised for bids.  On May 31, 2018, six bids were received with the following results:

The requirements of Stockton Municipal Code (SMC) section 3.68.090, Local Business Preference Ordinance, apply to this contract.  Application of the Local Business Preference has no effect on the bid order.  The Local Employment Ordinance, SMC section 3.68.095, also applies to this contract.

 

The bid from California Pavement Maintenance Company, Inc., the lowest responsive bidder, is regular in all respects. California Pavement Maintenance Company, Inc. has the proper license to perform the work.  Staff recommends Council approve the plans and specifications for the project, and award a Construction Contract to California Pavement Maintenance Company, Inc. in the amount of $473,337.

 

The project is in conformance with the City’s General Plan, pursuant to California Government Code section 65402, and is categorically exempt from the requirements of CEQA as specified under Article 19, Section 15301, Class 1, of the CEQA Guidelines. The activities related to this discretionary City project do not have a significant effect on the environment.  The resolution will approve the Notice of Exemption No. CE16-18 under CEQA.  Construction is anticipated to begin in summer 2018, and be completed in fall 2018, weather permitting.

 

FINANCIAL SUMMARY

 

The project is fully funded by the new SB1 RMRA (Gas Tax) funding.  The current unencumbered balance in the 2018 Slurry Seal (Project No. PW1730, 030-3062-640) is $534,770. This amount is sufficient to award a Construction Contract to California Pavement Maintenance Company, Inc. in the amount of $473,337.  The remaining funds will be used for contingency, change orders, and staff costs.

 

There is no impact to the City’s General Fund or any other unrestricted fund as a result of taking the recommended actions.
