APPROVE RESOLUTION ACCEPTING A TOBACCO LAW ENFORCEMENT PROGRAM GRANT AWARD FROM THE CALIFORNIA DEPARTMENT OF JUSTICE, OFFICE OF ATTORNEY GENERAL, AUTHORIZING THE PROFESSIONAL SERVICES AGREEMENT WITH SAN JOAQUIN COUNTY PUBLIC HEALTH SERVICES, AND AMENDING THE FISCAL YEAR 2018-19 ANNUAL BUDGET

RECOMMENDATION
It is recommended that the City Council approve a resolution to:
1. Authorize the City Manager to accept grant funding from the State of California Department of Justice (DOJ), Office of Attorney General in the amount of $241,934, for the Tobacco Law Enforcement Program;
2. Authorize the City Manager to execute a two-year Professional Services Agreement between the City of Stockton and San Joaquin County Public Health Services (SJCPHS) not to exceed $197,710;
3. Amend the Fiscal Year (FY) 2018-19 Annual Budget to increase the Police Grants & Special Programs expenditure and revenue appropriation by $241,934; and
4. Authorize the City Manager to take appropriate and necessary actions to carry out the purpose and intent of this resolution including executing, on behalf of the City of Stockton, all required contracts or agreements with the granting agency, provide additional information and furnish such documents as may be required, execute all documents and amendments or extensions pertaining to the grant project, and make all required appropriations in compliance with and for the purposes stated in the project Agreement.

Summary
In May 2018, the Stockton Police Department (SPD) submitted an application to the California DOJ, Office of Attorney General requesting grant funding under its Tobacco Law Enforcement Grant Program. On June 8, 2018, the SPD was notified by the DOJ that the application was approved in the amount of $241,934. Funds received for this two-year grant program will be used for SPD Officer overtime costs related to tobacco enforcement operations, roll call training, and local retailer inspection operations, operating costs, equipment, and travel expenses for DOJ-sponsored training (Attachment A); as well as a contract with SJCPHS in the amount of $197,710 (Attachment B). SJCPHS administers the Smoking & Tobacco Outreach Prevention/Program (STOPP), aimed at creating healthier communities and promoting a healthy lifestyle by influencing the local retail environments that serve Stockton. The grant period runs from July 1, 2018, to June 30, 2020.
DISCUSSION
Background
The California Healthcare, Research and Prevention Tobacco Tax Act of 2016 (Prop. 56), approved by voters, increased taxes on cigarettes and other tobacco products by $2.00 as of April 2017, and established a grant program for local governments, administered by the DOJ. The multimillion-dollar grant funds are intended to support local efforts to reduce the illegal sale of tobacco products to minors. The City has approximately 325 active, licensed tobacco retailers in San Joaquin County.
On May 25, 2018, the SPD submitted a grant proposal to the DOJ requesting grant assistance in the amount of $241,934 to pay for various operations to enforce tobacco-related laws and ordinances in addition to a partnership with SJCPHS. Multiple cities and counties throughout the state were selected to receive grant funds ranging from $9K-$5M, to support tobacco-related enforcement programs.
Present Situation
On June 8, 2018, the DOJ awarded the City $241,934 to raise tobacco retailer awareness of underage sales laws, conduct tobacco enforcement operations, meet with student and youth organizations regarding tobacco use, conduct roll call training, and raise public awareness of tobacco harm.
The components of the grant program will be to:
• Conduct at least eight (8) tobacco-related enforcement operations targeting licensed retailers, averaging eight (8) retailer locations per mission (32 businesses per year);
• Increase communication and involvement with students and youth by meeting with student and youth organizations, schools and colleges at least three times per year;
• Provide roll call training on tobacco-related issues for all sworn personnel on a regular basis; and
• Raise awareness among the public about the harm caused by tobacco, tobacco products, and tobacco advertising by conducting a media campaign using radio, print, billboard and social media.
Grant-funded overtime will allow SPD Officers to initiate tasks and activities to accomplish objectives. SJCPHS will assign a Health Education Associate and a Supervising Public Health Educator, on a part-time basis, to provide outreach services, media development, and advertising related to illegal sales and marketing of tobacco products to minors. The Special Investigations Section supervisor will coordinate with SJCPHS and monitor activities to meet objectives.

The SPD Special Investigations Section will be responsible for coordinating operations of the grant program. The portion of the grant award paying for SJCPHS services is $197,710. The grant program does not require matching funds and will have no impact to the General Fund. A budget appropriation in FY 2018-19 is requested for grant revenue and expenses in the amount of $241,934 to the Police Grants & Special Programs Other Special Revenue Programs Tobacco Law Enforcement Grant Program Account No. 025-6437-530.
