Approve a motion ratifying the Mayoral Appointments to the Building and Housing Board of Appeals and the Handicapped Access Board of Appeals.

Summary

 

The City Clerk’s Office conducted a recruitment, to fill the vacancies on these Boards.  At the end of the recruitment, the qualified applications were forwarded to the Mayor’s Office for review and selection.  Pursuant to Stockton Municipal Code and California Building Code Section 113 these appointments are to be made by the Mayor with the Council’s concurrence.

 

DISCUSSION

 

Background

 

The Building and Housing Board of Appeals is a seven-(7) member board that meets as needed, whose purpose is to hear appeals of decisions made by the Building Official relative to denials of requests to use alternative methods and materials, from aggrieved parties relative to the application of the Uniform Housing Code, California Fire Code, California Building Code, Uniform Code for Abatement of Dangerous Buildings, California Plumbing Code, California Mechanical Code, California Electric Code, and related regulations of the City of Stockton.  In addition, the Board is to hear and decide appeals of orders, decisions or determinations made by the Building Official relative to the application and interpretation of the California Building Standards Code. 

 

The Handicapped Access Board of Appeals is a five-(5) member board that meets as needed, whose purpose is to hear and decide appeals of administrative decisions including, but not limited to, denials of requests to use alternative methods of providing access to public accommodations by physically disabled persons as required by the California Health and Safety Code, Part 5.5 (Section 19955, et.seq.). To approve, disapprove or modify Building Division interpretations of Part 5.5 of Division 13 of the Health and Safety Code (Section 19955 et seq.) including the exceptions contained in Section 19957, and enforce actions taken by the Building Division. The Handicapped Access Board of Appeals also conducts appeals. The Board's conduct of appeals and decisions shall be governed by the procedures prescribed for the Building Board of Appeals as set forth in Section 15.04.170 and state law.

 

 

Pursuant to Stockton Municipal Code, these appointments are to be made by the Mayor with the Council’s concurrence.

 

Present Situation

 

The Mayor has reviewed the available applications (Attachments A and B) and is recommending the following applicants for appointment.  The term for these appointments will begin immediately and end January 31, 2023.  The appointments being made will represent the following fields:

 

Building and Housing Board of Appeals:

 

Wesley Hull, General Building Contractor

David Queirolo, Mechanical Contractor

David Vizcarra, Engineer/Architect

Brenda Amboy, Lay Member

 

Handicapped Access Board of Appeals:

 

Don Aguillard, Disabled Persons 

Lynette Mieglitz, Lay Member

Wesley Hull, Building and Housing Board of Appeals

 

FINANCIAL SUMMARY

 

These Boards do not receive remuneration, and the cost of staffing and provisions for a meeting are covered within the operational budget of the Community Development Department.
