RECOMMENDATION

 

It is recommended that the City Council adopt a resolution authorizing the City Manager to:

 

1.                     Approve the plans and specifications for the French Camp Road/I-5 Interchange Landscaping (Project No. PW1418/STPL-5008(159)).

 

2.                     Appropriate additional federal grant funds in the amount of $938,458 for the French Camp/I-5 Interchange Landscaping (Project No. PW1418/STPL-5008(159)) and reduce the Public Facilities Fee Street Improvement Fund appropriation in the project by $750,000.

 

3.                     Award a Construction Contract in the amount of $881,609.05 to Emert Construction, Inc. of Stockton, CA, for the French Camp Road/I-5 Interchange Landscaping (Project No. PW1418/STPL-5008(159)).

 

It is also recommended that the City Manager be authorized to take appropriate and necessary actions to carry out the purpose and intent of this resolution.

Summary

 

The French Camp Road/I-5 Interchange Reconstruction project was substantially completed in 2015.  Construction of landscaping at the French Camp/I-5 Interchange was included in the Fiscal Year (FY) 2014-19 Capital Improvement Plan (CIP), but was deferred due to the drought.  A project to install landscaping at the interchange has now been approved by the California Department of Transportation (Caltrans). The environmental approval for the landscaping project is covered under the approved environmental document for the reconstruction of the French Camp Road/I-5 Interchange. 

 

The French Camp Road/I-5 Interchange Landscaping project consists of installing colored rock with a shape and pattern to enhance aesthetics and to control weeds and other unwanted vegetation.

 

On April 12, 2018, the City received six bids for this project.  Staff recommends award of the Construction Contract to the lowest responsive bidder, Emert Construction, Inc. in the amount of $881,609.05.  Construction is anticipated to begin in July 2018 and be completed by December 2018.  Caltrans will maintain the project improvements upon completion.

 

This project is federally funded and is subject to federal Disadvantaged Business Enterprise (DBE) requirements.

DISCUSSION

 

Background

 

The City was the lead agency for the French Camp Road/I-5 Interchange Reconstruction project (Attachment A - Vicinity Map), which is also associated with the Sperry Road Extension and Manthey Road Relocation projects.  These projects have all been completed and are open to traffic.

 

Construction of landscaping at the French Camp/I-5 Interchange was included in the FY 2014-19 CIP, but was deferred due to the drought. The original plans were revised to a more drought tolerant concept and approved by Caltrans.  The French Camp Road/I-5 Interchange Landscaping project consists of installing colored rock with a shape and pattern to enhance aesthetics and to control weeds and other unwanted vegetation.

 

The environmental approval for the landscaping is covered under the approved environmental document for the reconstruction of the French Camp Road/I-5 Interchange.  The project is funded by federal transportation funds available from savings realized from the construction of the interchange project. 

 

Since the project is funded with federal transportation dollars, DBE program rules apply.  DBE rules require that the prime contractor either meet a calculated project specific DBE participation goal or undertake and document good faith efforts to do so.  If the apparent low bidder does not meet the project goal, a Good Faith Efforts Evaluation must be made examining several specific factors.  Failure to meet the goal or provide evidence of adequate good faith efforts are grounds for rejecting the bidder as non-responsive.

 

A DBE is a socially and economically disadvantaged small business owned by a woman or by a specified ethnic group that has been properly certified by Caltrans.  These groups include:

                     Asian Pacific American

                     Native American

                     Women

                     Hispanic American

                     Subcontinent Asian American

 

A DBE goal of three percent was established for this project.  The goal was calculated by examining the breakdown of the types of work to be performed, and the availability of certified DBE companies in our market area to perform the work.  A pre-bid meeting was held on March 13, 2018, to emphasize the DBE requirements, and to provide information on how to meet the project DBE goal. 

 

The federal funding restrictions prohibit the use of the Local Employment Ordinance (Stockton Municipal Code (SMC) section 3.68.095), and the Local Business Preference Ordinance (SMC section 3.68.090).

 

On July 26, 2016, Council adopted a Community Workforce and Training Agreement (CWTA).  The CWTA became effective August 25, 2016, and applies to all Public Works projects over $1 million that are bid after that date.  The CWTA was not applied to this project as federal regulations prohibit the use of such agreements.

 

Present Situation

 

On April 12, 2018, six bids were received with the following results:

The bid from Emert Construction, Inc. the lowest responsive bidder, is regular in all respects.  Emert Construction, Inc. has the proper license to perform the work and has proposed a DBE participation of 3.08 percent, which exceeds the three percent DBE goal.  Staff recommends approving the plans and specifications for the project, and awarding the Construction Contract to Emert Construction, Inc. of Stockton, CA, in the amount of $881,609.05.  

 

Environmental clearance for this project was achieved as a part of the French Camp Road/I-5 Interchange Reconstruction project.  Construction is anticipated to begin in July 2018 and be completed by December 2018.

 

FINANCIAL SUMMARY

 

With the appropriation of the additional federal grant funds in the amount of $938,458 (PW1418 - French Camp Road/I-5 Interchange Landscaping; 308-3020-640) the project budget will be increased to $3,588,458. 

 

The project does not need the entire amount of $3,588,458; therefore, $750,000 of the previously approved Public Facilities Fee (PFF) Street Improvement funds (Fund 910) will be returned to fund balance.  These funds will be reprogrammed during future annual CIP budget processes.

 

The project budget with the additional federal funds less the PFF funds will be a total of $2,838,458.  The design of the project has expended $250,000 leaving an unencumbered balance of $2,588,458,000.  This is sufficient to award a Construction Contract with Emert Construction, Inc. in the amount of $881,609.05.  The remaining funding will be expended on contingency, construction engineering, and staff costs. Staff expects that there will be remaining Measure K Regional funding once this project is complete.  These funds will be returned to SJCOG and reprogrammed to other Regional Arterial projects.

 

There is no impact to the City’s General Fund or any other unrestricted fund as a result of taking the recommended actions.  Caltrans will maintain the project improvements upon completion.
