It is recommended that the City Council approve a motion to:

 

1.                     Authorize the City Manager to execute a Professional Services Agreement in the amount of $117,500 with Co Occupational Medical Partners of Stockton, CA to provide pre-hospital care services and to act as the Medical Director for Stockton Fire Department for a fee of $23,500 per year for five years.

 

2.                     Approve findings pursuant to Stockton Municipal Code section 3.68.070 in support of an exception to the competitive bidding process.

 

It is further recommended that the City Manager be authorized to take appropriate and necessary actions to carry out the purpose and intent of this motion.

Summary

 

Stockton Fire Department (SFD) provides Emergency Advanced Life Support (ALS) Services to the citizens of the County of San Joaquin by maintaining a Paramedic program. The maintenance of this program, regulated by San Joaquin County, State of California, Food and Drug Administration (FDA) and Drug Enforcement Administration (DEA), requires SFD to purchase and maintain large quantities of pharmaceuticals and medical supplies. All controlled substances are supplied and re-supplied by the ALS Provider’s prescribing physician, licensed in the State of California. The City is required to retain the services of a licensed physician, knowledgeable and experienced in the delivery of pre-hospital care and to act as a Medical Director.

 

On February 8, 2018, the City advertised a Request for Proposal (RFP) for pre-hospital medical care and Medical Director services for SFD. On March 8, 2018, one proposal was received from Johnston Lim Co, MD of Co Occupational Medical Partners (C.O.M.P.).

 

It is recommended that Council approve a motion authorizing the City Manager to execute a Professional Services Agreement in the amount of $117,500 with C.O.M.P. for a term of five (5) years.

 

 

 

 

DISCUSSION

 

Background

 

The City is required to retain the services of a licensed physician, knowledgeable and experienced in the delivery of pre-hospital care and to act as a Medical Director to remain in compliance with County, State and Federal requirements for the acquisition, administration and management of controlled substances utilized for the current Emergency Medical Technician (EMT) and Paramedic Services provided by SFD.

SFD provides ALS Services to the citizens of the County of San Joaquin by maintaining a Paramedic program.  As such, the maintenance of this program, regulated by San Joaquin County, State of California, FDA, and DEA, requires SFD to purchase and maintain large quantities of pharmaceuticals and medical supplies.  All controlled substances are supplied and re-supplied by the ALS Provider’s prescribing physician, licensed in the State of California.

 

In 2014, SFD’s Emergency Medical Services (EMS) Supplies/Medicine Coordinator conducted a search for physicians to provide pre-hospital care and to act as the Medical Director for SFD.  These services include: 1) management of prescriptions and controlled substances, 2) advising SFD on its Medical Technician and Paramedic program; 3) advising SFD in planning, evaluating, and delivery of pre-hospital medical care; 4) assisting SFD EMS Coordinator in evaluating conformance with medical/legal requirements; and, 5) providing technical expertise in the development and structure of emergency medical procedures.  C.O.M.P. was selected to provide these services based on Dr. Co’s qualifications and experience to act as Medical Director. A Professional Services Agreement was executed effective August 6, 2014, to have Dr. Co provide these services on a regular basis for an annual fee of $23,500.  The initial term expired June 30, 2015, with automatic one (1) year successive renewals, for up to three (3) years.  The current Agreement will expire on June 30, 2018.

 

Other services provided by Dr. Co include oversight of SFD’s Continuous Quality Improvement and Quality Assurance (CQI/QA) Programs to maintain the highest level of service to Stockton’s citizens.

 

 

Present Situation

 

On February 8, 2018, the City advertised an RFP for pre-hospital medical care and Medical Director services for SFD. On March 8, 2018, one proposal was received from Johnston Lim Co, MD of C.O.M.P. Other likely providers cited recent retirements and lack of capacity for not submitting proposals.

 

A Selection Committee evaluated the proposal based on the firm’s understanding of work, experience with similar kinds of work, qualifications of the proposed team, project approach, cost, and local preference.  The Committee determined that based on the noted criteria, C.O.M.P represented by Dr. Johnston Co is qualified and experienced to act as a Medical Director for SFD to meet the requirements of San Joaquin County Emergency Medical Services. C.O.M.P. has provided medical services to SFD on a regular basis since 2014, and is qualified and experienced to act as Medical Director for SFD to meet the requirement of the San Joaquin County Emergency Medical Services. Staff negotiated a fee of $23,500 per year for pre-hospital care and Medical Director services.

 

 

Findings

 

Pursuant to Stockton Municipal Code section 3.68.070, Council may approve findings which support an exception to the competitive bidding process. The proposed findings include:

 

1.                     The City is required to retain the services of a licensed physician, knowledgeable and experienced in the delivery of pre-hospital care and to act as a Medical Director to remain in compliance with County, State and Federal requirements for the acquisition, administration and management of controlled substances utilized for the current EMT and Paramedic Services provided by SFD.

2.                     Use of the RFP process is appropriate for this Professional Services Agreement because it relies on the evaluation of professional qualifications and performance as the basis for selection of a vendor. Use of these criteria helps ensure selection of a vendor that will provide the highest quality professional service which is in the public interest.

 

3.                     C.O.M.P, represented by Dr. Johnston Co, was determined to be qualified and experienced to act as Medical Director based on the noted criteria.

 

The recommended motion will approve a five (5) year Professional Services Agreement (Attachment A) in the amount of $117,500 with C.O.M.P. for pre-hospital care and Medical Director services for SFD.

 

 

FINANCIAL SUMMARY

 

Based on the service requirements of the department for the past years, staff recommends an annual contract amount of $23,500 for a total of $117,500 for a five-year professional services agreement with C.O.M.P. The Fire Department has included these costs in its FY2018-19 proposed annual budget in the General Fund Fire Administration account 010-2610-530. Annual contract costs for subsequent years will be budgeted in the same manner throughout the contract term.
