RECOMMENDATION

 

It is recommended that the City Council adopt a resolution authorizing the City Manager to:

 

1.                     Approve the Notice of Exemption No. CE039-17 under the California Environmental Quality Act for the Pump Station Roof Repair, Project No. M13026.

 

2.                     Approve the plans and specifications for the Pump Station Roof Repair, Project No. M13026.

 

3.                     Appropriate funds in the amount of $30,620 from the Stormwater Utility Fund balance (441-0000-287) to the Storm Pump Station Improvements (447-7783-670) for the Pump Station Roof Repair, Project No. M13026.

 

4.                     Award a Construction Contract in the amount of $103,150 to Comfort Air, Inc. of Stockton, CA, for the Pump Station Roof Repair, Project No. M13026.

 

It is also recommended that the City Manager be authorized to take appropriate and necessary actions to carry out the purpose and intent of this resolution.

Summary

 

Staff recommends award of a construction contract to repair the roof of the pump station at American Legion Park (Attachment A).  The Municipal Utilities Department operates the storm drain pump station at American Legion Park.  The pump station collects street water runoff and discharges into Yosemite Lake at the head of Smith Canal.  This project will repair the station’s roofing members and equipment hatches that show signs of dry rot or have reached the end of their useful life.  Project design was completed by Teter, LLP in January 2017. 

 

The project was first advertised for construction in early 2017 and no bids were received.  The project was re-advertised, and on August 31, 2017, one bid was received from Comfort Air, Inc. in the amount of $103,150.

 

Staff recommends award of the construction contract to Comfort Air, Inc.  To fully fund the project, staff recommends Council appropriate additional funds in the amount of $30,620 from the Stormwater Utility Fund balance (441-0000-287) to the Storm Pump Station Improvements (447-7783-670).  Staff also recommends that Council adopt a resolution authorizing the filing of Notice of Exemption No. CE039-1 under the California Environmental Quality Act (CEQA).  Construction is anticipated to begin in spring 2018 and be completed by summer 2018.

 

DISCUSSION

 

Background

 

Staff recommends award of a construction contract to repair the roof of the American Legion Park pump station.

 

The Municipal Utilities Department operates a storm drain pump station at American Legion Park, located on Baker Place.  The pump station collects street water runoff and discharges into the adjacent Yosemite Lake using four large diesel-powered pumps and one small electric pump. This project will repair the station’s roofing members and equipment hatches that show signs of dry rot or have reached the end of their useful life. 

 

On August 17, 2016, staff retained Teter, LLP to prepare the plans and specifications for construction of the project.  The project design was completed in January 2017 and advertised for bids.  No bids were received.  The project was re-advertised on August 10, 2017.

 

On July 26, 2016, Council adopted a Community Workforce and Training Agreement (CWTA). The CWTA became effective August 25, 2016, and applies to all Public Works projects over $1 million that are bid after that date. The CWTA was not applied to this project, as the estimated construction cost is less than $1 million.

 

Present Situation

 

On August 31, 2017, one bid was received with the following result:

 

                     Comfort Air, Inc. (Stockton, CA)                                                               $103,150

The requirements of Stockton Municipal Code (SMC) section 3.68.090, Local Business Preference Ordinance, apply to this project.  The Local Employment Ordinance, SMC section 3.68.095, also applies to this contract.

 

The bid from Comfort Air, Inc., the apparent low bidder, is regular in all respects.  Comfort Air, Inc. has the proper license to perform the work.  Following receipt of the bid, staff determined that the Engineer’s Estimate was calculated incorrectly.  The correct estimate is $87,500.  As only one bid was received, and it is approximately 18 percent higher than the corrected Engineer’s Estimate, staff contacted other contractors to determine their reasons for not bidding this project.  Contractors typically responded that they are either too busy with current projects, or this project is too small for them to consider.  Staff concluded that there are minimal opportunities to reduce costs.  As a result, lower bids are not likely if the project is re-advertised for a third time.  Staff recommends Council approve the plans and specifications for the project, and award a construction contract to Comfort Air, Inc. in the amount of $103,150.  To fully fund the project, $30,620 will be transferred from the Stormwater Utility Fund balance (441-0000-287) to the Storm Pump Station Improvements (447-7783-670).  Construction is anticipated to begin in spring 2018 and be completed by summer 2018.

 

The project is in conformance with the City’s General Plan, pursuant to California Government Code, Section 65402, and is categorically exempt from the requirements of CEQA as specified under Article 19, Section 15301, Class 1, of CEQA Guidelines. The activities related to this project constitutes a discretionary project under the City’s jurisdiction and qualifies as a project that does not have a significant effect on the environment. The resolution will approve the filing of Notice of Exemption No. CE039-17 under CEQA.

 

FINANCIAL SUMMARY

 

Staff recommends the appropriation of additional funding in the amount of $30,620 from the Stormwater Utility Fund balance (441-0000-287) to the Storm Pump Station Improvements (447-7783-670).  With this additional funding, there is sufficient funding to award a construction contract in the amount of $103,150 with Comfort Air, Inc.

 

There is no additional impact to the City’s General Fund or any other unrestricted fund as a result of taking the recommended actions.
