It is recommended that the City Council adopt a resolution authorizing the City Manager to:

 

1.                     Approve the plans and specifications for the City of Stockton Fire Station No. 4 Kitchen Renovation (Project No. PW1411).

2.                     Award a Construction Contract in the amount of $69,025.62 to Desert West Contracting, Inc. of Stockton, CA, for the Fire Station No. 4 Kitchen Renovation (Project No. PW1411).

 

It is also recommended that the City Manager be authorized to take appropriate and necessary actions to carry out the purpose and intent of this resolution.

Summary

 

The Fire Station No. 4 Kitchen Renovation project will renovate the existing 50-year-old kitchen with new countertops, cabinets, flooring, expand the cabinet storage area, and bring the kitchen into compliance with current Americans with Disabilities Act (ADA) regulations.

 

On December 22, 2016, the City received four bids for the project.  On March 28, 2017, Council rejected all four bids due to irregularities and high bid prices.  The project was re-advertised and the City received four bids on April 13, 2017.

 

Staff recommends Council adopt a resolution to approve the plans and specifications for the project, and award a Construction Contract to the low bidder, Desert West Contracting, Inc., in the amount of $69,025.62.  Construction is anticipated to be completed by the end of December 2017.

 

DISCUSSION

 

Background

 

City of Stockton Fire Station No. 4 is located at 5525 Pacific Avenue (Attachment A - Vicinity Map).  The kitchen at Fire Station No. 4 is approximately 50 years old, with deteriorated and damaged counters, cabinets, and floor covering.  In addition, the kitchen storage closet is inadequate, and the kitchen area, in general, is not ADA compliant.

 

The Fire Station No. 4 Kitchen Renovation project was programmed in the Fiscal Year 2014-19 Capital Improvement Plan to renovate the kitchen with new countertops, cabinets, flooring, expand the cabinet storage area, and bring the kitchen into compliance with current ADA regulations.   

 

The City hired WMB Architects, Inc. to prepare the plans and specifications, and estimates for the project.  The project was advertised for bids, and on December 22, 2016, the City received four bids.  On March 28, 2017, Council rejected all four bids due to irregularities and high bid prices. 

 

Present Situation

 

On March 13, 2017, the Fire Station No. 4 Kitchen Renovation project was re-advertised for bids.  On April 13, 2017, four new bids were received with the following results:

The requirements of Stockton Municipal Code (SMC) section 3.68.090, Local Business Preference, apply to this project.  Desert West Contracting, Inc. is located within the City and is entitled to a five percent bid preference.  Haggerty Construction is located in San Joaquin County and is entitled to a two percent bid preference.  There is no change in the bid order after applying the Local Business Preference. 

 

The bid from Desert West Contracting, Inc., the lowest bidder, is regular in all respects.  The bid amount has been corrected for minor calculation errors in the amount of $5.38.  This correction had no impact on the bid order.  Desert West Contracting, Inc. has the proper license to perform the work.    The low bid is less than $75,000 and could be approved administratively.  However, administrative approval would leave limited authority for contract change orders to address unforeseen circumstances that may arise during construction.  Council approval of the contract award will provide standard administrative change order authority.  Staff therefore recommends Council approve the plans and specifications for the project and award a Construction Contract to Desert West Contracting, Inc. in the amount of $69,025.62.  Construction could begin in July 2017 and is anticipated to be completed by the end of December 2017.

 

The California Environmental Quality Act (CEQA) guidelines state that interior building tenant improvement type projects do not require compliance with CEQA.  This project falls within the definition of tenant improvements, therefore CEQA does not apply to this project.

 

On July 26, 2016, Council adopted a Community Workforce and Training Agreement (CWTA).  The CWTA became effective August 25, 2016, and applies to all Public Works projects over $1 million that are bid after that date.  The CWTA was not applied to this project because the engineer’s estimate was under $1 million.

 

 

FINANCIAL SUMMARY

 

The Fire Station No. 4 Kitchen Improvements project (PW1411; 301-3020-640) is funded from the General Fund.  This project has sufficient unobligated balance to award a Construction Contract to Desert West Contracting, Inc. in the amount of $69,025.62.  Remaining funding in the project account will be used for contingencies, staff cost, and construction management.  No additional appropriations are required to complete this project.

 

There is no additional impact to the City’s General Fund beyond the funds allocated in the current operating budget, or to any other unrestricted fund as a result of taking the recommended action.
