RECOMMENDATION

 

It is recommended that the City Council adopt a resolution authorizing the City Manager to:

 

1.                     Approve the Notice of Exemption No. CE020-14 under the California Environmental Quality Act for the Harding Way and El Dorado Street/ Center Street Traffic Signal Modifications (Project No. PW1210/Federal Project No. HSIPL-5008(128)).

 

2.                     Approve the plans and specifications for the Harding Way and El Dorado Street/ Center Street Traffic Signal Modifications (Project No. PW1210/Federal Project No. HSIPL-5008(128)).

 

3.                     Accept and appropriate additional Highway Safety Improvement Program Grant funds in the amount of $72,094 to the Harding Way and El Dorado Street/Center Street Traffic Signal Modifications (Project No. PW1210/Federal Project No. HSIPL-5008(128)).

 

4.                     Appropriate additional matching funds in the amount of $11,064 from Measure K Maintenance Fund to the Harding Way and El Dorado Street/Center Street Traffic Signal Modifications (Project No. PW1210/Federal Project No. HSIPL-5008(128)).

 

5.                     Award a Construction Contract in the amount of $533,722 to Tim Paxin’s Pacific Excavation, Inc. of Elk Grove, CA, for the Harding Way and El Dorado Street/Center Street Traffic Signal Modifications (Project No. PW1210/Federal Project No. HSIPL-5008(128)). 

 

It is also recommended that the City Manager be authorized to take appropriate and necessary actions to carry out the purpose and intent of this resolution.

Summary

 

The Harding Way and El Dorado Street/Center Street Traffic Signal Modifications project will enhance safety by upgrading the existing traffic signals to current standards, including the installation of Emergency Vehicle Preempt (EVP) equipment (Attachment A).  This project was included in the City’s application to the Cycle 5 Highway Safety Improvement Program (HSIP) Call for Projects which was authorized by Council on June 26, 2012 (Motion No. 2012-06-26-1205).  Grant funding for the project was approved, and it was included in the FY 2013-18 Capital Improvement Plan (CIP).

 

On March 9, 2017, the City received three bids for this project.  Staff recommends award of the Construction Contract to the lowest responsible bidder, Tim Paxin’s Pacific Excavation, Inc. in the amount of $533,722.  Additional funding in the amount of $83,158 is needed to fund construction of the project.  The Harding Way and El Dorado Street/Center Street Traffic Signal Modifications project has been granted additional HSIP funding in the amount of $72,094 and requires an additional match of $11,064 of Measure K funds to provide sufficient capacity to award the contract and fund all other project related costs.  Staff recommends Council accept the additional HSIP funds, and appropriate the HSIP and Measure K funds.  Staff also recommends that Council adopt a resolution authorizing the filing of Notice of Exemption No. CE020-14 under California Environmental Quality Act (CEQA).  Construction is anticipated to begin August 2017 and be completed by December 2017.

 

This project is subject to federal Disadvantaged Business Enterprise (DBE) requirements.

 

DISCUSSION

 

Background

 

The HSIP is a core Federal-aid program established to achieve a significant reduction in fatalities and serious injuries on all public roads.  Caltrans, Division of Local Assistance, manages California’s local agency share of HSIP funds.  California’s Local HSIP focuses on infrastructure projects with nationally recognized crash reduction factors.  Local HSIP projects are prioritized on the basis of crash experience, crash potential, crash rate, or other data-supported means. 

 

On June 26, 2012, Council approved Motion No. 2012-06-26-1205 authorizing the submittal of HSIP applications to Caltrans Cycle 5 HSIP Call for Projects.  The City submitted seven grant applications for funding consideration.  Four were selected and awarded HSIP funds, including the Harding Way and El Dorado Street/Center Street Traffic Signal Modifications project.  The project was included in the FY 2013-18 CIP.  

 

The Harding Way and El Dorado Street/Center Street Traffic Signal Modifications project will enhance safety by upgrading the existing traffic signals to current standards, including the installation of EVP equipment (Vicinity Map - Attachment A). 

 

In July 2015, Caltrans authorized the City to proceed with the construction of the project.  The project was advertised on August 13, 2015.  The project uses EVP equipment manufactured by Global Traffic Technologies (GTT).  Prior to the bid opening, the City and Caltrans received a request from an EVP equipment manufacturer, Emtrac, to permit the use of their equipment on the project.  After reviewing the request, Caltrans advised the City to evaluate other EVP manufacturer’s equipment for compatibility with the City’s existing GTT based EVP system, and with the City’s Central Management Software (CMS), to determine if other manufacturers could be used on the project.  The project advertisement was canceled to allow time to perform the evaluation.

 

The City completed the testing and evaluation of the three main manufacturer’s EVP equipment and, on August 23, 2016, concluded that the other manufacturer’s EVP equipment is not fully compatible or interchangeable with the City’s existing GTT based EVP system and CMS.  The City recommended continued use of GTT EVP equipment to preserve the EVP system’s integrity and safety. The results and recommendation were reported in the form of a Public Interest Finding with the Federal Highway Administration. 

 

Since the project is funded with federal transportation dollars, DBE program rules apply.  DBE rules require that the prime contractor either meet a calculated project specific DBE participation goal or undertake and document good faith efforts to do so.  If the apparent low bidder does not meet the project goal, a Good Faith Efforts Evaluation must be made examining several specific factors.  Failure to meet the goal or make adequate good faith efforts are grounds for rejecting the bidder as non-responsive.

 

A DBE is a socially and economically disadvantaged small business owned by a woman or by a specified ethnic group that has been properly certified by Caltrans.  These groups include:

                     Subcontinent Asian American

 

A DBE goal of nine percent was established for this project.  The goal was calculated by examining the breakdown of the types of work to be performed, and the availability of certified DBE companies in our market area to perform the work.  A non-mandatory pre-bid meeting was held on February 15, 2017, to emphasize the DBE requirements, and to provide information on how to meet the project DBE goal.

 

The federal HSIP funding restrictions prohibit the use of the Local Employment Ordinance (Stockton Municipal Code (SMC) section 3.68.095), and the Local Business Preference Ordinance (SMC section 3.68.090).

 

On July 26, 2016, Council adopted a Community Workforce and Training Agreement (CWTA).  The CWTA became effective August 25, 2016, and applies to all Public Works projects over $1 million that are bid after that date.  The CWTA was not applied to this project as federal regulations prohibit the use of such agreements, and because the estimated construction cost was less than $1 million. 

 

Present Situation

 

On February 9, 2017, the Harding Way and El Dorado Street/Center Street Traffic Signal Modifications (Project No. PW1210/Federal Project No. HSIPL-5008(128) was re-advertised for bids.  On March 9, 2017, three bids were received with the following results:

The bid from Tim Paxin’s Pacific Excavation, Inc., the lowest responsive bidder, is regular in all respects. Tim Paxin’s Pacific Excavation, Inc. has the proper license to perform the work and has proposed a DBE participation of 10.8 percent, which exceeds the nine percent DBE goal.  Staff recommends approving the plans and specifications for the project and awarding the Construction Contract to Tim Paxin’s Pacific Excavation, Inc. of Elk Grove, CA, in the amount of $533,722.

 

Additional funding in the amount of $83,158 is needed to fund construction of the project.  The Harding Way and El Dorado Street/Center Street Traffic Signal Modifications project has been granted additional HSIP funding in the amount of $72,094 and requires an additional match of $11,064 of Measure K funds to provide sufficient capacity to award the contract and fund all other project related costs.  With the additional funding, the unencumbered project balance will be $694,500, which is sufficient to award the Construction Contract in the amount of $533,722, with the remainder funding construction management ($80,100) and contingency ($53,400).  Staff recommends Council accept the additional HSIP funds, and appropriate the HSIP and Measure K funds. 

 

The project is categorically exempt from the requirements of CEQA as specified under Article 19, Sections 15301, Class 1, and 15302, Class 2, of CEQA Guidelines.  A determination of Categorical Exclusion has been made by Caltrans under the National Environmental Policy Act.  Staff recommends Council adopt a resolution approving the CEQA notice of exemption for the project.

 

Construction is anticipated to begin August 2017 and be completed by December 2017.

 

 

Financial Summary

 

The additional $72,094 of HSIP grant funds must be appropriated to the project.  Additional matching funds are required and need to be appropriated in the amount of $11,064.  There is sufficient funding available in the fund balance of Measure K Maintenance to appropriate to the Harding Way and El Dorado Street/Center Street Traffic Signal Modifications (Project No. PW1210/Federal Project No. HSIPL-5008(128)) for these purposes.  The total additional funding is $83,158.

With the additional funding, the unencumbered balance in the project will be $694,500, which is sufficient to award a Construction Contract in the amount of $533,722 with Tim Paxin’s Pacific Excavation, Inc., with the remainder funding construction management ($107,378) and contingency ($53,400).

 

There is no additional impact to the City’s General Fund or any other unrestricted fund as a result of taking the recommended action.
