RECOMMENDATION

 

It is recommended that the City Council approve a motion rejecting all bids received for construction of the Fremont Square Sidewalk Reconstruction (Project No. PW1438/ ATPL-5008(140)) pursuant to Stockton Municipal Code (SMC) section 3.68.160(B).

 

It is also recommended that the City Manager be authorized to take appropriate and necessary actions to carry out the purpose and intent of this motion.

Summary

 

The Fremont Square Sidewalk Reconstruction (Project No. PW1438/ATPL-5008(140)) will reconstruct sidewalks along the perimeter of Fremont Square (Attachment A) with a rubberized surface.  Additional improvements include the removal and replacement of existing curb ramps, relocation of pedestrian lighting, tree removal/trimming, and the addition of bicycle racks. 

 

On September 22, 2016, the City received three bids for this project. Odyssey Landscaping, Inc., the apparent low bidder, submitted a bid in the amount of $663,327, which is 27.8 percent over the engineer’s estimate. Staff recommends Council approve a motion to reject all bids received and rebid the project, with a revision to the plans and additional marketing to obtain better bid results.

 

DISCUSSION

 

Background

 

The Active Transportation Program (ATP) was created in September 2013 by Senate Bill 99 (Chapter 359, Statues of 2013) and Assembly Bill 101 (Chapter 354, Statutes of 2013) to encourage increased use of active modes of transportation, such as bicycling and walking.

 

On May 6, 2014, by Motion No. 2014-05-06-1208, Council authorized submission of 19 grant applications for funding under ATP Cycle 1 statewide, and regional call for projects. The City was awarded a total of approximately $4.6 million for seven of the applications, four at the statewide level and three at the regional level. The Fremont Square Sidewalk Reconstruction project was one of the four approved projects awarded statewide funding.

 

On January 13, 2015, Council accepted the award of $728,000 of ATP grant funds for the Fremont Square Sidewalk Reconstruction project.  Council action at that time also appropriated funding for the project and authorized the filing of a Notice of Exemption under the California Environmental Quality Act by Resolution No. 2015-01-13-1201.

 

The Fremont Square Sidewalk Reconstruction project will reconstruct sidewalks along the perimeter of Fremont Square with a rubberized surface.  Additional improvements include the removal and replacement of existing curb ramps, relocation of pedestrian lighting, tree removal/trimming, and the addition of bicycle racks.  The California Transportation Commission (CTC) allocated design funding for the project on May 28, 2015.

 

On January 7, 2016, the City retained Siegfried Engineering, Inc. to prepare the plans and specifications for construction of the project. The CTC allocated construction funding for the project in June 2016.

 

Present Situation

 

The project was advertised on August 25, 2016. On September 22, 2016, three bids were received with the following results:

Odyssey Landscaping, Inc., the apparent low bidder, submitted a bid in the amount of $663,327, which is 27.8 percent over the engineer’s estimate. There are insufficient funds to support awarding the project. Staff recommends Council approve a motion to reject all of the bids received and to rebid the project.

 

Staff surveyed contractors who bid the projects to determine the reasons for the higher bid results and obtain suggestions to reduce the project cost. The project plans will be revised before rebid to incorporate these suggestions as appropriate.  Also, staff will increase marketing of the project to increase the amount of bidders and competition.

 

FINANCIAL SUMMARY

 

The recommended action has no financial impact. There is sufficient funding in PW1438 Account No. 308-3020-640 (Fremont Square Park Sidewalk Reconstruction) for the rebid process.
