RECOMMENDATION

 

It is recommended that the City Council approve a motion ratifying the emergency expenditure of $269,440 to MCM Construction, Inc. and $31,272.50 to Mark Thomas & Company, Inc. for the emergency repair of the Wilson Way Bridge over Mormon Slough. 

 

It is also recommended that the City Manager be authorized to take appropriate and necessary actions to carry out the purpose and intent of this motion.

Summary

 

On June 21, 2016, the City Council, as required by Stockton Municipal Code section 3.68.070, approved findings associated with the emergency repair of the Wilson Way Bridge over Mormon Slough.  The bridge had been damaged due to a fire related to a homeless encampment under the bridge structure.  The fire damaged the bottom of the bridge deck and the supports on the north side of the structure.  This condition prompted emergency action to provide temporary shoring to reopen the bridge and to make permanent repairs.  As final cost of the repair work was not known on June 21, 2016, Council was advised that staff would return for final ratification of expenditures for this work.  All repairs have now been completed with expenditures in the amount of $300,712.50.  Staff recommends Council approve a motion to ratify final expenditures for the emergency repairs. 

 

DISCUSSION

 

Background

 

On the morning of Sunday, February 28, 2016, the Wilson Way Bridge at Mormon Slough was damaged due to a fire related to a homeless encampment under the bridge structure.  Mattresses, furniture, wood, and other debris burned for approximately two hours until the fire was contained and ultimately extinguished. The fire damaged the bottom of the bridge deck and the supports on the north side of the structure.  The bridge was closed to traffic for two days to assess the damage. The bridge carries the weight of two lanes of traffic in each direction with a significant amount of large truck traffic. The bridge was assessed on an emergency basis by a structural bridge engineer from Mark Thomas & Company, Inc. who provided the following recommendations:  1) Reopen the bridge under limited traffic conditions (one lane in each direction) and install signs prohibiting trucks; 2) Install temporary bridge supports (shoring) under the bridge to allow additional traffic lanes onto the bridge, and; 3) Perform permanent repairs and remove shoring.  

 

Staff took immediate action to limit traffic on the bridge to one lane in each direction until temporary shoring could be installed in accordance with recommendation 1.  The City subsequently contracted with MCM Construction, Inc. who installed temporary shoring, and the bridge was reopened to full traffic on March 15, 2016, in accordance with recommendation 2. 

 

On March 29, 2016, Council approved Motion No. 2016-03-29-1204 to adopt findings in support of an exception to the competitive bidding process for the emergency repair of the Wilson Way Bridge pursuant to Stockton Municipal Code section 3.68.070. 

 

Concurrently, Mark Thomas & Company, Inc. prepared plans and specifications for the permanent repairs, and the project was advertised for bids on April 6, 2016.  One bid was received in the amount of $269,340 from Meyers & Sons Construction.  The engineer’s estimate for the work was $225,000.  The single bid from Meyers & Sons Construction was deemed high, and the project was re-advertised on May 11, 2016. Staff included an additive bid item on the second advertisement.  The additive item involved concrete flatwork under the bridge to potentially prevent further encampments.  The additive item was not structurally required as part of the bridge repair work.

The bid from MCM Construction, Inc, the lowest bidder, was regular in all respects, and they had the proper license to perform the work.  The second lowest bidder, Pacific Infrastructure Construction, LLC, protested alleging that the low bid was unbalanced.  Staff deemed the protest to be without merit as MCM Construction, Inc. was the low bidder for both the base bid and the combined (base plus additive) bid.  Staff further determined that the best value for the City was to award a contract for the base bid only without utilizing the additive bid item.    

 

On July 15, 2016, the City entered into a Construction Contract with MCM Construction, Inc. in the amount of $191,915 to perform the permanent repairs.

 

Present Situation

 

The permanent structural repairs to the bridge were completed on August 19, 2016.  The total emergency expenditures for design and construction of the repairs were $300,712.50; $31,272.50 to Mark Thomas & Company, Inc. and $269,440 to MCM Construction, Inc. (includes temporary shoring cost of $77,525).  It is recommended that Council approve the above noted expenditure of $300,712.50, in accordance with SMC section 3.68.070, for the emergency repair of the Wilson Way Bridge over Mormon Slough.

 

FINANCIAL SUMMARY

 

Sufficient funds are allocated to the Wilson Way Bridge Fire project (PWWWFR).

 

There is no impact to the City’s General Fund or to any other unrestricted fund as a result of taking the recommended action.
