APPROVE RESOLUTION TO AUTHORIZE THE SAN JOAQUIN TRAIL (PROJECT NO. PW1442/ATPL 5008(139))

RECOMMENDATION

 

It is recommended that the City Council adopt a resolution authorizing the City Manager to:

 

1.                     Approve the plans and specifications for the San Joaquin Trail (Project No. PW1442/ATPL 5008(139)).

 

2.                     Award a Construction Contract in the amount of $878,433 to McFadden Construction, Inc. of Stockton, CA, for the San Joaquin Trail (Project No. PW1442/ATPL 5008(139)).

 

3.                     Approve an Agreement between the City and the Greater Valley Conservation Corps (GVCC) in the amount of $16,138.78.

 

It is also recommended that the City Manager be authorized to take appropriate and necessary actions to carry out the purpose and intent of this resolution.

Summary

 

On January 13, 2015, Council accepted the award of $1,394,000 of Active Transportation Program (ATP) grant funds for the San Joaquin Trail project.  Council action at that time also appropriated funding for the project and authorized the filing of a Notice of Exemption under the California Environmental Quality Act (CEQA) by Resolution No. 2015-01-13-1201.

 

The San Joaquin Trail project is located between French Camp Slough, French Camp Road, and Manthey Road in the Weston Ranch subdivision.  This project will rehabilitate and widen 2.6 miles of existing trail.  The improvements will also install signage and striping, bicycle racks, drinking fountains, trash receptacles, benches, minor landscaping, and upgrade existing ramps to Americans with Disabilities Act (ADA) standards.

 

On September 22, 2016, the City received two bids for the project.  The recommended 

resolution will approve the plans and specifications for the project, and award a Construction Contract to the lowest responsible bidder, McFadden Construction, Inc. of Stockton, CA, in the amount of $878,433.  The resolution will also approve an Agreement between the City and the GVCC (formerly San Joaquin Regional Conservation Corps) in the amount of $16,138.78 to provide labor to install landscaping, benches, and bicycle racks on the project.  This agreement is a component of the City’s grant application, as ATP funding regulations give higher priority to projects that partner with the Local Conservation Corps, such as the GVCC. 

 

Construction is anticipated to begin in March 2017, and be completed by the end of 2017, weather permitting.

 

DISCUSSION

 

Background

 

On September 26, 2013, Governor Brown signed legislation creating the ATP in the Department of Transportation.

 

The ATP consolidated existing federal and State transportation programs, including the Transportation Alternatives Program, Bicycle Transportation Account, and State Safe Routes to School, into a single program with a focus to make California a national leader in active transportation.  The ATP is administered by Caltrans on behalf of the California Transportation Commission.

 

The purpose of ATP is to encourage increased use of active modes of transportation by achieving the following goals:

 

                     Increase the proportion of trips accomplished by bicycling and walking

                     Increase safety and mobility for non-motorized users

                     Advance the active transportation efforts of regional agencies to achieve greenhouse gas reduction goals

                     Enhance public health

                     Ensure that disadvantaged communities fully share in the benefits of the program

                     Provide a broad spectrum of projects to benefit many types of active transportation users

 

On May 6, 2014, by Motion No. 2014-05-06-1208, Council authorized the submission of 19 grant applications for funding under the ATP Cycle 1 statewide and regional call for projects.  The City was awarded a total of approximately $4.6 million for seven of the applications, four at the statewide level and three at the regional level. The San Joaquin Trail project was one of the four approved projects awarded statewide funding.  The total ATP grant award received for the San Joaquin Trail project was $1,394,000.  On January 13, 2015, Council accepted the grant awards and appropriated funds to multiple projects by Resolution No. 2015-01-13-1201. 

 

The San Joaquin Trail project is located between French Camp Slough, French Camp Road, and Manthey Road in the Weston Ranch subdivision.  This project will reconstruct, resurface, repair, and widen 2.6 miles of existing trail, add signage and striping for bicyclists and pedestrians, and incorporate erosion control measures. The improvements will also install bicycle racks, water drinking fountains, trash receptacles, benches, minor landscaping, and upgrade existing ramps to ADA standards (Attachment A).

Agencies applying for ATP grants were given higher priority for project funding when partnered with the California Conservation Corps or the Local Conservation Corps (LCC).  The LCC for our area is the GVCC.  The GVCC agreed to participate in the San Joaquin Trail project and this participation is a condition of the City’s ATP grant award. 

 

In November 17, 2015, the City retained Kjeldsen, Sinnock & Neudeck, Inc. to prepare the plans and specifications for construction of the project.  The project plans and specifications were completed, and in June 2016, the California Transportation Commission allocated construction funds and Caltrans authorized the City to proceed with the construction phase of this project.

 

Present Situation

 

The project was advertised for bids on August 18, 2016.  On September 22, 2016, two bids were received with the following results:

The State ATP funding restrictions prohibit the use of the Local Employment Ordinance (Stockton Municipal Code (SMC) section 3.68.095), and the Local Business Preference (SMC section 3.68.090) on this project.  The funding restrictions also exclude the use of federal Disadvantage Business Enterprise provisions.

 

On July 26, 2016, Council adopted a Community Workforce and Training Agreement (CWTA).  The CWTA became effective August 25, 2016, and applies to all Public Works projects over $1 million that are bid after the effective date noted above.  As the estimated project cost was less than $1 million, the CWTA does not apply to this project. 

 

The bid from McFadden Construction, Inc., the lowest responsible bidder, is regular in all respects.  McFadden Construction, Inc. has the proper license to perform the work.  Staff recommends Council approve the plans and specifications for the project, and award a Construction Contract to McFadden Construction, Inc. in the amount of $878,433.  Construction is anticipated to begin in March 2017, and be completed by the end of 2017, weather permitting.

 

In addition to this construction contract, the GVCC will provide labor to install landscaping, benches, and bicycle racks on the project.  The Agreement between the City and GVCC (Exhibit 1) outlines the labor services the GVCC will be providing at a cost of $16,138.78.  Staff recommends Council approve this Agreement.

The project is categorically exempt from the requirements of CEQA as specified under Article 19, Section 15301, Class 1, of the CEQA Guidelines.  The activities related to this project constitute a discretionary project under the City’s jurisdiction, and qualify as a project that does not have a significant effect on the environment.  On January 13, 2015, by Resolution No. 2015-01-13-1201, Council authorized the filing of Notice of Exemption No. CE026-14 under CEQA (Attachment B).

 

FINANCIAL SUMMARY

 

The project is fully funded with State ATP funds that have been accepted and appropriated.  There is no local match requirement.

 

The Grantor has authorized a total of $1,145,000 for the construction phase of the project.  There are sufficient funds to award a Construction Contract to McFadden Construction, Inc., in the amount of $878,433, for construction work on the San Joaquin Trail project (PW1442; 308-3020-640), and to approve an Agreement between the City and GVCC in the amount of $16,138.78.  The remaining funding will be used primarily for staff costs.  No additional appropriations are necessary to complete this project.

 

There is no impact to the City’s General Fund or to any other unrestricted fund as a result of taking the recommended actions.
