RECOMMENDATION

 

It is recommended that the City Council adopt a resolution authorizing the City Manager to:

 

1.                     Approve the plans and specifications for the Hammer Lane Widening Phase 3B, Project No. PW1427.

 

2.                     Execute Amendment No. 1 to the Cooperative Agreement between the City of Stockton and San Joaquin County (County) (A-16-217).

 

3.                     Appropriate $189,224 from Amendment No. 1 to the City-County Cooperative Agreement to the Hammer Lane Widening Phase 3B, Project No. PW1427.

 

4.                     Award a Construction Contract in the amount of $5,645,461.65 to DSS Company dba Knife River Construction for the Hammer Lane Widening Phase 3B, Project No. PW1427.

 

It is further recommended that the City Manager be authorized to take appropriate and necessary actions to carry out the purpose and intent of this resolution.

Summary

 

On March 10, 2015, by Resolution No. 2015-03-10-1201, Council adopted the City/San Joaquin Council of Governments (SJCOG) Cooperative Agreement, which provided up to $9,500,000 in Measure K renewal funding for the Hammer Lane Widening Phase 3B, Project No. PW1427. 

 

The Hammer Lane Widening Phase 3B project will widen Hammer Lane between Alexandria Place and Thornton Road from four to six lanes with traffic signal improvements, landscaped medians, curb, gutter, sidewalks, bicycle lanes, and landscaping.  The project will also install a storm drain system along Pershing Avenue between Hammer Lane and Five Mile Slough.  Portions of the project are within the unincorporated San Joaquin County.

 

On September 16, 2008, by Resolution No. 08-0379, Council adopted a City-County Cooperative Agreement for the future Hammer Lane Widening Phase 3B project.  The City-County Cooperative Agreement identified the City as the lead agency for the project, including the section within the unincorporated San Joaquin County, and described the mutual roles and responsibilities of each agency.  The County has requested an amendment to the Cooperative Agreement to construct additional sidewalks in the County’s jurisdiction.  Amendment No. 1 to the City-County Cooperative Agreement adds the obligation of the County to pay for these additional sidewalks estimated at $189,224.  The County Board of Supervisors approved the Amendment No. 1 to the City-County Cooperative Agreement during their June 14, 2016, Board meeting.   

 

The recommended resolution will adopt the plans and specifications for the project, execute Amendment No.1 to the City-County Cooperative Agreement, appropriate $189,224 additional funding from the County, and award a Construction Contract to the lowest responsible bidder, DSS Company dba Knife River Construction, in the amount of $5,645,461.65 for the construction of the Hammer Lane Widening Phase 3B, Project No. PW1427.  Construction of the project is anticipated to begin toward the end of 2016 and be substantially complete by the end of 2017. 

 

DISCUSSION

 

Background

 

In October 1994, Council adopted specific plans for nine roadway corridors, one of which included the Hammer Lane corridor. 

 

The Specific Plan for Hammer Lane identified the roadway to be widened to six lanes from Interstate 5 to Thornton Road, and to eight lanes from Thornton Road to SR99.  The widening of Hammer Lane was divided into multiple phases as follows: Thornton Road to the Union Pacific Railroad crossing (Phase 1), Union Pacific Railroad underpass to the formerly Southern Pacific Railroad crossing (Phase 2), and Kelley Drive to Thornton Road (Phase 3).  Phases 1 and 2 were completed in 2003 and 2004, respectively.

 

On March 8, 2005, Council adopted Resolution No. 05-0080, which authorized an Amendment to the Professional Services Master Contract with Mark Thomas & Company, Inc. for final design of the third phase of the Hammer Lane Widening project from Kelly Drive to Thornton Road.  Phase 3 plans were completed, but were split into two phases - Phase 3A (Kelly Drive to Alexandria Place) and Phase 3B (Alexandria Place to Thornton Road) - due to funding availability, right-of-way acquisition issues, and utility relocations.

 

On September 25, 2007, Council adopted Resolution No. 07-0408, which approved the Initial Study/Mitigated Negative Declaration (IS20-06) for the Hammer Lane Widening Phase 3A and Phase 3B construction phases.  Phase 3A construction was completed in 2008, leaving Phase 3B as the last remaining piece of the Hammer Lane Widening project to be completed. 

 

The Hammer Lane Widening Phase 3B project will widen Hammer Lane between Alexandria Place and Thornton Road from four to six lanes with traffic signal improvements, landscaped medians, curb, gutter, sidewalks, bicycle lanes, and landscaping.  The project will also install a storm drain system along Pershing Avenue between Hammer Lane and Five Mile Slough to discharge the roadway drainage to the slough. 

 

On September 16, 2008, Council adopted Resolution No. 08-0379, which approved a City-County Cooperative Agreement with the County for the Hammer Lane Widening Phase 3B project.  The City-County Cooperative Agreement identified the City as the lead agency to widen Hammer Lane between Alexandria Place and Thornton Road, including a section of the project which is part of the County’s jurisdiction (Attachment A).

 

The Hammer Lane Widening Phase 3B project was originally anticipated to receive Measure K Congestion Relief Regional Arterial funding for construction in 2011.  However, the downturn in the economy severely impacted Measure K revenues, and construction funds were no longer available.  The project was then left to wait until funding was available from the Measure K Program, which was projected to be no earlier than 2021.

 

In 2014, SJCOG and the City developed a proposal to deliver the project by advancing Measure K funds through the sale of bonds.  On March 10, 2015, by Resolution No. 2015-03-10-1201, Council adopted the City/SJCOG Cooperative Agreement, which provided up to $9,500,000 in Measure K bond funds for the Hammer Lane Widening Phase 3B project.  Principal and interest on the bond funds will be paid back through the collection of future Measure K revenues.

 

On May 19, 2015, Council approved an Amendment to the Professional Services Master Contract with Mark Thomas & Company, Inc. to update the plans, specifications, estimate, and environmental document.  Mark Thomas & Company, Inc. reviewed the environmental documents from 2006, and determined that the project is still adequately represented by the existing environmental document, and no further action is required. 

 

The project design was completed, and the project advertised for construction bids on May 19, 2016. 

 

Present Situation

 

On June 30, 2016, four bids were received for the subject project with the following results:

The project is locally funded and, therefore, requires the use of the Local Employment Ordinance (Stockton Municipal Code (SMC) section 3.68.095), and the Local Business Preference (SMC section 3.68.090).  SMC section 3.68.090 gives a five percent bid preference to businesses located within the City of Stockton, and a two percent bid preference to businesses located within San Joaquin County. 

 

The bid from DSS Company dba Knife River Construction, the lowest responsible bidder, is regular in all respects.  DSS Company dba Knife River Construction has the proper license to perform the work.  Staff recommends Council adopt a resolution approving the plans and specifications, and to award a Construction Contract in the amount of $5,645,461.65 to DSS Company dba Knife River Construction for construction of the Hammer Lane Widening Phase 3B, Project No. PW1427.

 

Amendment No. 1 to the City-County Cooperative Agreement adds the obligation of the County to pay for the requested additional sidewalks estimated at $189,224 in their jurisdiction.    The County Board of Supervisors approved the agreement during their June 14, 2016, Board meeting.  Amendment No. 1 to the City-County Cooperative Agreement sets a maximum not to exceed County contribution amount of $189,224 toward the total project cost for design, construction, and construction management. 

 

Construction of the project is anticipated to begin toward the end of 2016 and be substantially complete by the end of 2017.

 

On July 26, 2016, Council adopted a Community Workforce and Training Agreement (CWTA).  The CWTA became effective August 25, 2016, and applies to all Public Works projects over $1 million that are bid after the effective date noted above.  Because this project was bid on May 19, 2016, the CWTA does not apply.  Although the CWTA does not apply in this instance, DSS Company dba Knife River Construction is a union contractor and will be using union staff on this project.

 

FINANCIAL SUMMARY

 

Measure K Bond Funding in the amount of $9,500,000 was secured for this project by a Cooperative Agreement and Finance Agreement with SJCOG dated February 2015.  Additionally, the project has been allocated funding from the Municipal Utilities Department for utility adjustments and drainage in the amount of $70,000.

 

Amendment No. 1 to the Cooperative Agreement with the County allocates a maximum not to exceed amount of $189,224.  The proposed resolution appropriates the County contribution of $189,224 to the Hammer Lane Widening Phase 3B project (PW1427; 301-3020-640). 

 

The total project budget including the County share is $9,759,224.  There is currently an unencumbered balance of $9,373,000.  Therefore, sufficient funds are available to award a Construction Contract in the amount of $5,645,461.65 to DSS Company dba Knife River Construction for construction of the Hammer Lane Widening Phase 3B, Project No. PW1427.  The remaining funds will be used for construction management, construction contingency, and City staff costs associated with this project.

 

There is no impact to the City’s General Fund or to any other unrestricted fund as a result of taking the recommended actions.
