RECOMMENDATION

 

It is recommended that the City Council adopt a resolution authorizing the City Manager to:

 

1.                     Approve the plans and specifications for the Thornton Road Widening, Project No. PW1428.

 

2.                     Execute a Cooperative Agreement between the City of Stockton and San Joaquin County.

 

3.                     Appropriate $2,045,000 from the County Cooperative Agreement to the Thornton Road Widening project (PW1428).

 

4.                     Award a Construction Contract in the amount of $11,618,705 to Goodfellow Top Grade Construction, LLC for the Thornton Road Widening, Project No. PW1428.

 

It is further recommended that the City Manager be authorized to take appropriate and necessary actions to carry out the purpose and intent of this resolution.

Summary

 

On March 10, 2015, by Resolution No. 2015-03-10-1201, Council adopted the City/San Joaquin Council of Governments (SJCOG) Cooperative Agreement, which provided up to $14,500,000 in Measure K renewal funding for the Thornton Road Widening, Project No. PW1428.  The Thornton Road Widening project will widen Thornton Road between Pershing Avenue and Bear Creek from two to four lanes with buffered bicycle lanes, traffic signal improvements, curb, gutter, sidewalks, and landscaping.   

 

The section of Thornton Road between Pershing Avenue and Mosher Slough is within the unincorporated San Joaquin County.  San Joaquin County (County) has agreed to participate in widening their section of Thornton Road, subject to receiving reasonable bid results for the segment as Bid Alternate A as provided for in the City-County Cooperative Agreement for the Thornton Road Widening Project (Exhibit 1 to the Resolution).  The  City-County Cooperative Agreement describes the mutual roles and responsibilities of each agency relative to the County’s segment of Thornton Road.  The County Board of Supervisors approved the agreement during their June 14, 2016, Board meeting.  The County section of the Thornton Road Widening project was bid as an Alternate Bid Item.  The County has reviewed the bid results for their segment and has agreed to participate.

 

The recommended resolution will adopt the plans and specifications for the project, execute a City-County Cooperative Agreement, and award a Construction Contract to the lowest responsible bidder, Goodfellow Top Grade Construction, LLC, in the amount of $11,618,705 for the construction of the Thornton Road Widening, Project No. PW1428.  The award amount is for the combined total of the Base Bid amount of $9,665,965, plus Bid Alternate A in the amount of $1,952,740.  It is anticipated that construction will begin by fall 2016, and be substantially completed by the end of 2017. 

 

DISCUSSION

 

Background

 

In October 1994, Council adopted specific plans for nine roadway corridors, one of which included the Thornton Road corridor. 

 

The Specific Plan for Thornton Road called for the roadway to be widened to six lanes from Pershing Avenue to Bear Creek.  Work began on the project in 2005, and on September 11, 2007, Council adopted Resolution No. 07-0382, which approved the Initial Study/Mitigated Negative Declaration, and adopted the Findings and Mitigation Monitoring/Reporting Program California Environmental Quality Act documents (Attachment A - Resolution No. 07-0382 and Attachment B - Vicinity Map). Council also adopted Resolution No. 07-0393, which authorized an Amendment to the Professional Services Master Contract with Stantec Consulting Services, Inc. (Stantec) for final design of the project.   

 

The Thornton Road Widening project was originally anticipated to receive Measure K Congestion Relief Regional Arterial funding for construction in 2011.  However, the downturn in the economy severely impacted Measure K revenues, and construction funds were no longer available.  The project was then left to wait until funding was available from the Measure K Program, which was projected to be no earlier than 2021. 

 

In 2014, SJCOG and the City developed a proposal to deliver the project by advancing Measure K funds through the sale of bonds.  On March 10, 2015, by Resolution No. 2015-03-10-1201, Council adopted the City/SJCOG Cooperative Agreement, which provided up to $14,500,000 in Measure K bond funds for the Thornton Road project.  Principal and interest on the bond funds will be paid back through the collection of future Measure K revenues.

 

On May 19, 2015, Council approved an Amendment to the Professional Services Master Contract with Stantec to update the plans, specifications, estimate, and environmental document.  Stantec reviewed the environmental documents from 2007, and determined that the project is still adequately represented by the existing environmental document, and no further action is required. Part of Stantec’s scope of work included an analysis of existing and future traffic volumes to re-confirm the need for six lanes.  The results of the traffic analysis showed that estimated traffic volumes could be accommodated with four lanes for the foreseeable future.  Therefore, the roadway was designed such that it will be striped for four lanes with wider bicycle lanes that are separated from vehicle lanes by a striped buffer.  Minor landscaping, signal improvements, signing, and striping are also included.  The project design provides a more complete street type facility with the inclusion of buffered bicycle lanes to encourage the use of another transportation mode choice.  The pavement will be wide enough to transition to six vehicular travel lanes with conventional bicycle lanes in the future when required.

 

The section of roadway from Mosher Slough to Pershing Avenue is located within the unincorporated San Joaquin County.  The County has agreed to participate in widening their section of Thornton Road, subject to receiving reasonable bid results for the segment as Bid Alternate A.  A City-County Cooperative Agreement is attached, which outlines the mutual roles and responsibilities of each agency.  The County Board of Supervisors approved the agreement during their June 14, 2016, Board meeting.  The City-County Cooperative Agreement sets a maximum not to exceed County contribution of $2,045,000 toward the total project cost for design, construction, construction management, and administration.  The County section of the Thornton Road Widening project was bid as an Alternate Bid Item and can be awarded if the bid received for this section is acceptable.

The bid specifications presented in the provisions for the project, stipulated that the base bid was the basis of award.  The project is locally funded and, therefore, requires the use of the Local Employment Ordinance (Stockton Municipal Code (SMC), section 3.68.095), and the Local Business Preference (SMC, section 3.68.090).  SMC, section 3.68.090 which gives a five percent bid preference to businesses located within the City of Stockton, and a two percent bid preference to businesses located within San Joaquin County.  Both Goodfellow Top Grade Construction, LLC and George Reed Construction, Inc. have submitted documentation substantiating that they have local businesses located in San Joaquin County.  The City Attorney’s Office has reviewed the substantiating information, and determined that a two percent bid preference must be applied to their base bids in accordance with SMC section 3.68.090. Both businesses have been informed that the bid preference has been applied.   After application of the local preference to all base bids, Goodfellow Top Grade Construction, LLC remains the lowest bidder for the project.

 

The award amount is for the combined total of the Base Bid amount of $9,665,965, plus Bid Alternate A in the amount of $1,952,740.  The bid from Goodfellow Top Grade Construction, LLC was regular in all respects, and they have the proper license to perform the work.  The Base Bid amount of $9,665,965 was 23 percent lower than the engineer’s estimate.   Bid Alternate A was $1,952,740, 1.5% over the engineer’s estimate of $1,924,049 and thus within an acceptable range.  The County has reviewed the bid results for their segment (Bid Alternate A) and has agreed to participate. 

 

Staff recommends Council adopt a resolution approving the plans and specifications, and to award a Construction Contract in the amount of $11,618,705 to Goodfellow Top Grade Construction, LLC for construction of the Thornton Road Widening, Project No. PW1428.

 

The City-County Cooperative Agreement has a maximum not to exceed the County participation amount of $2,045,000.  There are thus sufficient funds to award the County’s construction portion.  However, staff will return to Council to amend the agreement estimate to increase the County’s total participation amount to fund other relevant project management expenses. It is anticipated that construction will begin by fall 2016, and be substantially completed by the end of 2017. 

 

FINANCIAL SUMMARY

 

Measure K Bond Funding in the amount of $14,500,000 was secured for this project by a Cooperative Agreement and Finance Agreement with SJCOG dated February 2015.  Additionally, there is $49,000 from developer fees collected for this project, and $50,000 from the Municipal Utilities Department for their share of utility relocations. 

 

The Cooperative Agreement with the County being executed with this action allocates a maximum not to exceed amount of $2,045,000.  The total project budget is therefore $16,644,000.

There is currently an unencumbered balance of $16,344,000.  Therefore, sufficient funds are available to award a Construction Contract in the amount of $11,618,705 to Goodfellow Top Grade Construction, LLC for construction of the Thornton Road Widening, Project No. PW1428.

 

There is no impact to the City’s General Fund or to any other unrestricted fund as a result of taking the recommended actions.
