RECOMMENDATION

 

It is recommended that the City Council:

 

1.                     Consider the recommendation of the Legislative Committee regarding the adoption of an ordinance amending the Stockton Municipal Code to incorporate tiny and micro houses, and

 

2.                     Provide direction to staff and Legislative Committee regarding desired analyses, public outreach, ordinance revisions and other related policy actions, if any.

Summary

 

On May 3, 2016, the Legislative Committee approved Motion 2016-05-03-0303 forwarding to the full City Council for consideration amendments to Stockton Municipal Code sections 5.16.010, 5.76.010, 16.80.020.A, 16.80.310, and 16.240.020 allowing tiny and micro housing options.  In accordance with this recommendation, staff is forwarding the Committee’s report for the full Council’s consideration (Attachments A-C).

 

 

DISCUSSION

 

Background

 

The Legislative Committee discussed policy direction to facilitate the production of affordable housing units in the form of “tiny houses” and “micro houses” and also the need to revise regulations relating to campgrounds to allow groups of these housing types to be located in industrial areas.

 

Present Situation

 

The committee’s recommendation has been presented to the Council for its consideration and direction.  Upon receipt of Council direction, staff will prepare the appropriate analysis, ordinance revisions, public outreach, and Planning Commission hearings necessary prior to final approval of an ordinance by the Council.

 

 

Environmental Review

 

Discussion of the proposed Stockton Municipal Code (SMC) amendments is exempt from the California Environmental Quality Act (CEQA) under the “general rule” that CEQA applies only to projects that have the potential for causing significant environmental effects, as specified in Section 15061(b)(3).  Consideration of the proposed amendments constitutes an administrative action that will not result in direct or indirect physical changes in the environment, and any future ordinance adoption will require further case-specific environmental review under CEQA.

 

 

FINANCIAL SUMMARY

 

There is no anticipated financial impact to the City of Stockton as a result of the proposed action.
