DISCUSSION

 

BACKGROUND

Civil Service Rules and Regulations for Miscellaneous Employees Rule VI, Section 5 details the rule regarding the conduct of examinations by the Personnel Officer. This rule currently requires that the Personnel Officer notify the Commission before conducting an examination

 

PRESENT SITUATION

Human Resources is requesting to amend Rule VI, Section 5 to delete the language requiring that the Personnel Officer notify the Civil Service Commission (CSC) before conducting an examination. Currently, Human Resources must notify the CSC prior to opening any recruitment that is classified under Civil Service. Because the CSC meets only once a month, this current practice makes it very difficult for City departments to open up recruitments as needed. This rule delays the process and thus makes it more difficult for departments to timely fill their vacant positions. This current practice may also result in the loss of qualified applicants who are searching for employment opportunities at the time Human Resources must notify the CSC. The rule does not allow for flexibility, and unduly adds more time to the recruitment process. Amending this rule will allow Human Resources the ability to open recruitments as soon they are approved by budget instead of having to wait to notify the CSC. There are no other applicable rules in the Charter, Stockton Municipal Code, or any bargaining agreements that require the notification to the CSC before opening a recruitment.

 

Attached for your information and review is the proposed rule amendment. The bargaining units that would be affected by this rule amendment have been notified of the proposed rule change.

 

AUTHORITY

Stockton Municipal Code section 2.36.030 (A) states “It shall be the duty of the Civil Service Commission to Establish Rules and Regulations: To adopt, amend or repeal rules for the administration of the Civil Service System.”  Therefore, this amendment is being proposed in accordance with section 2.36.030 (A).
