ADOPT A RESOLUTION TO AWARD A CONSTRUCTION CONTRACT TO CON J. FRANKE ELECTRIC, INC. FOR THE WILSON WAY UNDERCROSSING PUMP STATION RECONSTRUCTION

RECOMMENDATION
It is recommended that the City Council adopt a resolution to:
1. Approve the filing of Notice of Exemption No. NOE20-25 under the California Environmental Quality Act (CEQA) for the Wilson Way Undercrossing Pump Station Reconstruction (Exhibit 1 to the Resolution).
2. Approve the project Plans and Specifications for the Wilson Way Undercrossing Pump Station Reconstruction (Exhibit 2 to the Resolution).
3. Award a $247,700 Construction Contract to Con J. Franke Electric, Inc of Stockton, CA, for the Wilson Way Undercrossing Pump Station Reconstruction (Exhibit 3 to the Resolution).
It is further recommended that the City Manager be authorized to take appropriate and necessary actions to carry out the purpose and intent of this resolution.

Summary
The Municipal Utilities Department (MUD) is comprised of three enterprise funds including Water, Wastewater and Stormwater Utilities. The Stormwater Utility consists of 77 pump stations, more than 600 miles of pipeline, and 22,500 drain inlets that route stormwater from city streets into local basins and waterways.
The Wilson Way Subway Pump Station provides stormwater removal from the adjacent roadways and pumps it into Mormon Slough. In June 2023, the pump station was vandalized and all of the electrical controls were stolen. It is currently running with temporary controls. An electrical engineer was hired and completed the design for the reconstruction necessary to restore the pump station to permanent service.
If approved by the City Council, this action will authorize a construction contract in the amount of $247,700 to Con J. Franke Electric, Inc. of Stockton, CA, for the Wilson Way Undercrossing Pump Station Reconstruction.
DISCUSSION
Background
The Wilson Way Subway Storm Pump Station provides stormwater removal from the adjacent roadways and pumps it to the Mormon Slough.
In June 2023, the pump station electrical control devices and wiring were stolen, which caused a significant loss in pump station operations and jeopardized the ability to properly convey stormwater from the underpass.
In July 2023, staff retained electrical engineering services to design the temporary reconnection of power, automatic control devices, and necessary connections to the site instruments.
In September 2023, a contractor was retained to perform temporary repairs at the pump station based and is currently operational.
In August 2024, an electrical engineer was hired to design the complete reconstruction necessary to restore the pump station to permanent service.
On February 20, 2025, the Wilson Way Undercrossing Pump Station Reconstruction project was advertised in the Stockton Record and on the City Bid Flash webpage. Additionally, staff mailed a notice with a brief project description to 111 contractors holding a Class “A” and “C-10” license and sent Ask Stockton notifications.
Present Situation
On March 6, 2025, Amerine Systems, Inc., Saboo, Inc., NCECI, Tesco Controls, Inc., and Laurel Ag & Water attended a non-mandatory pre-bid conference meeting.
On March 20, 2025, three sealed bids were received and publicly opened by the City Clerk with the following results:

The Local Preference Ordinance, which states that “preference shall be given to the purchase of supplies, materials, equipment, and contractual services from local merchants, quality and price being equal,” applies to the project because Con J. Franke Electric, Inc. and Bockmon & Woody Electric Co., Inc. are based in Stockton, CA. Bids for both companies were adjusted in accordance with the Local Preference Ordinance. Con J. Franke Electric, Inc. of Stockton, CA, submitted the lowest bid, which is regular in all aspects and meets the project specifications.
It is recommended that the City Council authorize a construction contract in the amount of $247,700 to Con J. Franke Electric, Inc. of Stockton, CA, for the Wilson Way Undercrossing Pump Station Reconstruction.
Local Employment Ordinance
The contract amount is over $100,000 and subject to the Local Employment Ordinance, which requires that “all City contracts for public works or improvements of estimated value or City subsidy of $100,000 or more shall contain provisions pursuant to which the contractor promises to make a good faith effort, with the assistance of local labor union hiring halls or community organizations designated by the City to employ qualified individuals who are, and have been for one year prior to the effective date of the contract, residents of Stockton in sufficient numbers so that no less than 50 percent of the contractor’s total construction workforce, including any subcontractor workforce, measured in labor work hours, is comprised of Stockton residents.”
The project is under $1,000,000 and not subject to the Community Workforce and Training Agreement.
Environmental Clearance
It has been determined that this project is categorically exempt from the requirements of the California Environmental Quality Act (CEQA) guidelines as specified under Article 19, Section 15302, Class 2 (c) of the CEQA guidelines because it concerns replacement or reconstruction of an existing public facility where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced.
In addition, the proposed project is consistent with the 2040 Stockton General Plan (Land Use Policy 6.3) because it improves existing utility services to ensure that all neighborhoods have access to well-maintained public facilities and utilities that meet community service needs.
Following approval by the City Council, staff will file and post the approved Notice of Exemption in compliance with CEQA Guidelines section 15062.
FINANCIAL SUMMARY
There are sufficient funds in the Stormwater Capital Improvement Budget (6518-000-800007-620-621-00-65-000-000) for Project No. US24005 to award a $247,700 construction contract to Con J. Franke Electric, Inc. for the reconstruction of the pump station electrical components.
This action has no impact on the General Fund or any other unrestricted funds.
