body
Summary
The property is currently vested in Verona Office Plaza LLC, a California limited liability company (“Owner”), an affiliate of MGD Inc., a California corporation doing business as The Garibaldi Company. The Owner has offered to donate approximately 2.01 acres of real property located at 7306 Shoreline Drive to the City of Stockton for the benefit and use of the Stockton Police Department (SPD).
The property is proposed to support active SPD law enforcement training and operational activities, to support law enforcement training, Mounted Patrol operations, storage of vehicles and/or equipment assigned to SPD, and other related public safety activities.
The subject property is approximately 4.07 acres and is currently developed with a three-story office building. The approximately 2.01-acre portion proposed for donation includes a building pad, a parking overhang structure, and a concrete driveway area. The Owner is working with the City to subdivide the property into two separate legal lots, with the approximately 2.01-acre portion proposed for donation to the City to be created as Parcel 2.
A condition of the donation will require Parcel 2 to be lawfully created as a separate lot, either through the recording of a subdivision map or via transference by legal description. The deadline for conveyance of Parcel 2 to the City must occur no later than December 31, 2026, in accordance with the Land Donation Agreement.
DISCUSSION
Background
The Stockton Police Department (SPD) has identified a need for a permanent location to support law enforcement training and related operational activities. The proposed property would provide space for the Department’s Mounted Patrol Unit, including storage of trucks, horse trailers, police vehicles, equipment, and other related operational needs.
The Owner has offered to donate approximately 2.01 acres of property located at 7306 Shoreline Drive to the City of Stockton. The proposed donation consists of a vacant lot within the existing approximately 4.07-acre property. The Owner is pursuing a minor subdivision to divide the property into two separate legal lots, with Parcel 2 consisting of approximately 2.01 acres proposed for donation to the City.
The City would retain ownership and control of Parcel 2 for exclusive use by SPD. Any future development or construction on the property would be subject to applicable planning, zoning, environmental, building, and other required approvals.
Present Situation
The Owner has offered to donate approximately 2.01 acres to the City at no purchase price for the use of SPD. The proposed donation would provide the City with property to support SPD’s law enforcement including but not limited to Mounted Patrol operations; training for sworn and professional staff; storage of vehicles and/or equipment assigned to SPD; community engagement; use as a police facility and other related public safety needs.
City Council consideration of the proposed donation is occurring concurrently with the subdivision process. For the City to receive ownership, the property must be subdivided into two separate legal lots, with the approximately 2.01-acre portion created as Parcel 2. As contemplated in the Land Donation Agreement, Parcel 2 will be created via the subdivision process, or will be conveyed to the City via legal description.
Upon execution of the Land Donation Agreement, City staff will work with the property owner to complete the conveyance of the approximately 2.01 acres.
Legal Authority
California Government Code Section 37351 authorizes a city’s legislative body to receive real property that is necessary or proper for municipal purposes. California Government Code Section 37354 authorizes a city to accept gifts, bequests, and devises made to or for the city or for a public purpose.
The proposed donation is being made to the City for a public purpose and for the benefit and use of SPD. Acceptance of the property would provide the City with a permanent site to support SPD’s active law enforcement activities without an upfront purchase price.
Land Donation Agreement
The terms and mechanics of the proposed donation are outlined in the Land Donation Agreement. The Agreement requires conveyance of Parcel 2 to the City no later than December 31, 2026. Following conveyance, the property is to be used for the direct benefit and use of the Stockton Police Department, consistent with the terms of the Agreement.
ENVIRONMENTAL
Staff reviewed due diligence documents related to the property, including a Phase I Environmental Site Assessment and preliminary title report. Staff’s review of the available due diligence materials did not identify any issues warranting further investigation prior to proceeding with the proposed acquisition. Accordingly, the City would accept the property in its existing, as-is condition, subject to the terms of the conveyance documents and without completing additional due diligence prior to acceptance.
Any required review under the California Environmental Quality Act (CEQA) associated with the proposed SPD use and any future development or improvements on the property will be conducted at the appropriate time as the City proceeds with development of the property for SPD use.
FINANCIAL SUMMARY
There is no immediate fiscal impact to the General Fund associated with this action, as the City would acquire the property at no purchase price. However, acquisition of the property will result in ongoing costs, including assessments, maintenance, utilities, and other ownership-related expenses. These costs would be covered using allocated departmental funds from SPD, as applicable. Any future improvements or development of the property will be subject to separation approval and appropriation of funds.
