APPOINTMENTS TO THE STOCKTON PORT COMMISSION

RECOMMENDATION

 

It is recommended that City Council adopt a resolution:

 

1.                     Appointing two members to fill two upcoming vacancies on the Stockton Port Commission, for a term commencing July 1, 2017 and ending January 15, 2021.

 

2.                     Extend the term of current Commissioner Sylvester Aguilar from his original end date of December 31, 2017 to a new term end date of January 15, 2018.

Summary

 

On June 30, 2017, two terms on the Stockton Port Commission will expire creating the vacancies to be filled this evening. Additionally, it was discovered that the current terms for the Stockton Port Commission were not in alignment with the Harbors and Navigation Code, Section 6240.3, which established four year terms that are staggered from the time of appointment, and ending January 15th (Attachment A).

 

DISCUSSION

 

Background

 

The Stockton Port Commission consists of seven members, with three members appointed by the County Board of Supervisors, and four members appointed by the City Council. The function of the Stockton Port Commission is to exercise general supervision over the Port of Stockton by adopting general rules and regulations which, in its judgment, will best promote the interests of the Port as established under State law.

 

The four-year terms of Commissioners Michael Duffy and Stephen Griffen will expire on June 30, 2017, which will create the vacancies we are seeking to fill this evening.

 

The Office of the City Clerk initiated the recruitment to fill the vacancies, which opened on January 27, 2017 and ended February 10, 2017. During the recruitment process the City Clerk discovered a discrepancy in the terms of current members of the Stockton Port Commission. To realign with the original terms established by the Harbors and Navigation Code, Section 6240.3, staff is recommending that the two vacancies being filled have a shorter term with end dates of January 15, 2021, and the extension of the current term for Commissioner Aguilar from December 31, 2017 to January 15, 2018.

 

Pursuant to Council Policy Chapter 3.02, City Council and Mayoral Appointments to Boards, Commissions, and Committees, the following two-step interview and appointment process is used to fill current vacancies on boards and commissions:

 

1. The City Clerk conducts the initial applicant interviews, which are recorded so that the Council can view from the archive; and,

 

2. The Council makes the appointment at a regularly scheduled Council meeting.

 

The City Clerk's Office scheduled interviews on May 19, 2017, May 23, 2017 and May 24, 2017. The following applicants appeared and were interviewed using a list of prepared questions approved by the Port of Stockton:

 

1. Gene Biggler

2. Michael Duffy - Incumbent

3. Carolyn Gaynor

4. Stephen Griffen - Incumbent

5. Karl Miller

 

The applicants were notified of tonight's meeting; however, their attendance is not mandatory unless any Councilmember had additional questions of an applicant. If additional questions are asked of the applicants, the City Attorney has confirmed that the same question or questions do not need to be posed to all applicants.

 

Present Situation

 

As established in Council Policy Chapter 3.02, the Mayor and City Council will rank the applicants such that ranking “will be one number greater than the number of vacancies” with the applicants receiving the highest rankings, subject to Council ratification, being so appointed.

 

With two vacancies being filled, City Council will rank three applicants - ranking their first choice for appointment with the number “3”, second choice with a “2”, and third choice with a “1”. In the event of a tie, this process will be repeated, only with the applicants who are tied.

 

FINANCIAL SUMMARY

 

The Port Commissioners do not receive remuneration so, there is no financial impact in making these appointments.
