ADOPT RESOLUTION TO AUTHORIZE ROOF RESTORATION AT FAIR OAKS LIBRARY, MCKINLEY COMMUNITY CENTER, OAK PARK TENNIS COMPLEX, AND OAK PARK ICE ARENA

RECOMMENDATION
It is recommended that the City Council adopt a resolution to:
1. Approve Notice of Exemption No. NOE53-24 under the California Environmental Quality Act for Roof Restoration - Fair Oaks, McKinley, Oak Park Tennis Complex and Ice Arena, Project No. WC13020-B.
2. Approve findings pursuant to Stockton Municipal Code section 3.68.070 in support of an exception to the competitive bidding process.
3. Authorize the City Manager to execute a Cooperative Purchasing Agreement through Omnia Partners, Contract No. R230404, to provide the City access to preferential pricing of roofing products, services, and job-order-contracting services from Weatherproofing Technologies, Inc.
4. Authorize the City Manager to execute a Construction Contract in the amount of $1,105,188.26 with Weatherproofing Technologies, Inc. of Beachwood, OH, for Roof Restoration - Fair Oaks, McKinley, Oak Park Tennis Complex and Ice Arena, Project No. WC13020-B.
5. Authorize a budget amendment to appropriate funds in the amount of $232,383 from the Entertainment Venues fund balance to the Roof Restoration - Fair Oaks, McKinley, Oak Park Tennis Complex and Ice Arena, Project No. WC13020-B.
It is also recommended that the City Manager be authorized to take appropriate and necessary actions to carry out the purpose and intent of this resolution.

Summary
The roofs at Fair Oaks Library, McKinley Community Center, Oak Park Tennis Complex, and Oak Park Ice Arena require restoration (Attachment A). The Roof Restoration, Project No. WC13020-B, will provide the necessary repairs and restoration to these facilities, mitigating additional structural damage.
The project is partially funded from the Roof Replacement and Construction Program, an ongoing program within the Capital Improvement Plan (CIP). Restoration of the roofs at Fair Oaks Library and McKinley Community Center are identified as top priorities in the 2024-29 Five-Year CIP. Repairs at the Oak Park Tennis Complex and Oak Park Ice Arena have been requested and will be funded by the Economic Development Department (EDD).
Omnia Partners, the nation’s largest cooperative purchasing organization in public sector procurement, has partnered with Weatherproofing Technologies, Inc. to provide public agencies with competitively bid products and services.
It is recommended that Council approve the use of a Cooperative Purchasing Agreement through Omnia Partners, Contract No. R230404, and award a Construction Contract in the amount of $1,105,188.26 with Weatherproofing Technologies, Inc. for Roof Restoration - Fair Oaks, McKinley, Oak Park Tennis Complex and Ice Arena, Project No. WC13020-B. It is also recommended that Council adopt a resolution approving Notice of Exemption No. NOE53-24 under the California Environmental Quality Act (CEQA) and approving the plans and specifications for the project. Construction is anticipated to begin in spring 2025, weather permitting.
DISCUSSION
Background
Community and recreation centers and libraries play a crucial role in enhancing the quality of life in the City. They provide residents with opportunities for education, physical activity, and social interaction. They also host events and workshops that encourage community engagement and cultural enrichment.
Fair Oaks Library is located at 2370 East Main Street, the McKinley Community Center is located at 424 East 9th Street, and the Oak Park Tennis Complex is located at 3514 North Sutter Street (Attachment A).
The Roof Replacement and Construction Program is an ongoing program within the CIP. Restoration of the roofs at Fair Oaks Library and McKinley Community Center are identified as top priorities in the 2024-29 Five-Year CIP.
The Oak Park Tennis Complex roof restoration will also be funded by the Roof Replacement and Construction Program. Repair of the Oak Park Ice Arena roof, located at 3545 Alvarado Street, has been requested and will be funded by EDD.
On July 26, 2016, Council adopted a Community Workforce and Training Agreement (CWTA). The CWTA became effective August 25, 2016, and applies to all Public Works projects over $1 million that are bid after that date. On July 16, 2019, by Motion No. 2019-07-16-1403, Council extended the CWTA term to August 25, 2024. On August 20, 2024, by Motion No. 2024-08-20-1203, Council extended the CWTA term to August 25, 2029. The CWTA was not applied to this project as the estimated construction cost is less than $1 million, and the City pursued the use of a Cooperative Purchase Agreement in accordance with Stockton Municipal Code (SMC) Section 3.68.070 in support of an exception to the competitive bidding process.
Present Situation
In 2018, National IPA and US Communities were brought together to form Omnia Partners, the nation’s largest cooperative purchasing organization in public sector procurement. Thousands of institutions and public agencies use Omnia Partner’s services for combined purchasing power. All contracts available through Omnia Partners are competitively solicited and publicly awarded by a lead public agency using a competitive solicitation process. Weatherproofing Technologies, Inc. has partnered with Omnia Partners to provide public agencies with competitively bid products and services aimed at controlling labor costs, minimizing compliance risk, and improving workforce productivity and efficiency.
It is recommended that Council approve the use of a Cooperative Purchasing Agreement with Omnia Partners, Contract No. R230404, and award a Construction Contract in the amount of $1,105,188.26 with Weatherproofing Technologies, Inc. for Roof Restoration - Fair Oaks, McKinley, Oak Park Tennis Complex and Ice Arena, Project No. WC13020-B.
The project is categorically exempt from the requirements of CEQA as specified under Section 15301(d) of the CEQA Guidelines. The activities related to this project constitute a discretionary project under the City’s jurisdiction and qualifies as a project that does not have a significant effect on the environment. The resolution will approve the filing of Notice of Exemption No. NOE53-24 under CEQA. Weatherproofing Technologies, Inc. has the proper license to perform the work. Construction is anticipated to begin in spring 2025, weather permitting.
Findings
Pursuant to SMC section 3.68.070, Council may approve findings which support an exception to the competitive bidding process. These findings include:
1. Omnia Partners has established a Cooperative Purchasing Agreement with Weatherproofing Technologies, Inc. for roofing products, services, and job-order-contracting services.
2. The Request for Proposals (RFP) specifications used by the Omnia Partners were assessed against the City’s standard RFP process and industry standards of quality and efficiency. Weatherproofing Technologies, Inc. was selected by Omnia Partners as a supplier for these products and services.
3. The Procurement Division of Administrative Services recommends and approves the use of this Cooperative Purchasing Agreement and has determined that the process that was used to establish the Cooperative Purchasing Agreement was awarded through a competitive process and meets the City’s procurement requirements.
4. Taking advantage of the leveraged procurement agreement negotiated by Omnia Partners will save the administrative expense of City staff conducting separate procurement.
5. This Cooperative Purchasing Agreement allows for other agencies such as the City of Stockton the ability to utilize and participate in this Agreement.
FINANCIAL SUMMARY
With the appropriation from the Entertainment Venues fund balance to Project No. WC13020-B, there is sufficient budget to award a contract with Weatherproofing Technologies, Inc. of Beachwood, OH, in the amount of $1,105,188.26.
There is no additional impact to the City’s General Fund or any other unrestricted fund as a result of taking the recommended actions.
