ADOPT RESOLUTION TO AWARD A PROFESSIONAL SERVICES CONTRACT FOR THE SWAIN ROAD AND MORGAN PLACE ROUNDABOUT PROJECT

RECOMMENDATION
It is recommended that the City Council adopt a resolution to:
1. Transfer funds in the amount of $55,582 from the Grant Match, Project No. WT21016, to the Swain Road and Morgan Place Roundabout, Project No. WT24047/Federal Project No. CRPL-5008(213).
2. Approve findings pursuant to Stockton Municipal Code section 3.68.070 in support of an exception to the competitive bidding process.
3. Award a Professional Services Contract to Siegfried Engineering, Inc. of Stockton, CA, in the amount of $337,530.04 for design of the Swain Road and Morgan Place Roundabout, Project No. WT24047/Federal Project No. CRPL-5008(213).
It is also recommended that the City Manager be authorized to take appropriate and necessary actions to carry out the purpose and intent of this resolution.

Summary
Swain Road (two lanes) currently intersects with Morgan Place (two lanes) to form a four-way stop intersection (Attachment A). The Swain Road and Morgan Place Roundabout project will replace the four-way stop with a roundabout and add new Americans with Disabilities Act (ADA) compliant ramps, streetlights, roadway resurfacing, Pan Tilt Zoom (PTZ) cameras, rectangular rapid flashing beacons, curbs, gutters, sidewalks, and a dedicated right-turn lane. The project is being federally funded with Carbon Reduction (CRP) and Congestion Mitigation and Air Quality (CMAQ) Programs administered by Caltrans. The project is included in the 2025-30 Five-Year Capital Improvement Plan (CIP).
On December 10, 2024, the City advertised a Request for Proposals (RFP) for preliminary design and preparation of environmental documents for the Swain Road and Morgan Place Roundabout project. On January 23, 2025, two firms submitted proposals for this project. The Selection Committee evaluated the proposals and found Siegfried Engineering, Inc. to be the most qualified and highest ranked firm.
It is recommended that Council adopt a resolution authorizing the City Manager to execute a Professional Services Contract, in the amount of $337,530.04, with Siegfried Engineering, Inc. It is also recommended that Council adopt a resolution authorizing the transfer of funds in the amount of $55,582 from the Grant Match, Project No. WT21016, to the Swain Road and Morgan Place Roundabout, Project No. WT24047/Federal Project No. CRPL-5008(123). It is anticipated that the design will be completed by summer 2026.
This project is federally funded and subject to federal Disadvantaged Business Enterprise (DBE) requirements.
DISCUSSION
Background
The CRP/CMAQ Programs are federal programs that fund transportation projects or programs that contribute to the attainment or maintenance of National Ambient Air Quality Standards. In 2019, a “Stockton Traffic Signal, Roundabout, and Protected Left-Turn Phasing Priority Studies Report” was completed by DKS Associates. The report was an update to a previous study conducted in 2008 that identified candidate locations for roundabouts or traffic signals. Swain Road and Morgan Place were identified as a roundabout location based on an intersection control evaluation. In 2023, the City applied for CRP funds to convert the four-way stop-controlled intersection at Swain Road and Morgan Place to a roundabout. The CRP/CMAQ funding application was approved in the total amount of $3,092,000 for design, construction, and administration of the project. The project is included in the proposed 2025-30 Five-Year CIP.

The Swain Road and Morgan Place Roundabout, Project No. WT24047/Federal Project No. CRPL-5008(213), will replace the four-way stop with a roundabout and add new ADA compliant ramps, streetlights, roadway resurfacing, interconnected PTZ cameras, rectangular rapid flashing beacons, curbs, gutters, sidewalks, and a dedicated right-turn lane on Morgan Place going north and turning east onto Swain Road.
The funding is administered by Caltrans who has provided authorization to proceed with design. Caltrans allocated $429,000 in federal funds for the project. The City required local match is $55,582. The combined federal and local funding amount of $484,582 will cover the costs for design, administration, and contingency. The need to acquire right of way for the dedicated right-turn lane on the project will be evaluated during design. A separate authorization to proceed with right of way acquisition will be requested from Caltrans if right of way is needed. Public outreach for the project will be performed during the design of the project.
Since the project is funded with federal transportation dollars, DBE program rules apply. DBE rules require that the consultant either meet a calculated project specific DBE participation goal or undertake and document good faith efforts to do so. If the consultant does not meet the project goal, a Good Faith Efforts Evaluation must be made examining several specific factors. Failure to meet the goal or make adequate good faith efforts are grounds for rejecting a consultant’s proposal.
A DBE is a socially and economically disadvantaged small business owned by a woman or by a specified ethnic group that has been properly certified by Caltrans. These groups include:
• African American
• Asian Pacific American
• Native American
• Women
• Hispanic American
• Subcontinent Asian American
A DBE goal of 12 percent was established for this project. The goal was calculated by examining the breakdown of the types of work to be performed and the availability of certified DBE companies in our market area to perform the work.
The federal funding restrictions prohibit the use of the Local Employment Ordinance (Stockton Municipal Code (SMC) section 3.68.095), and the Local Business Preference Ordinance (SMC section 3.68.090).
Present Situation
On December 10, 2024, the City advertised an RFP for preliminary design and preparation of environmental documents for the Swain Road and Morgan Place Roundabout, Project No. WT24047/Federal Project No. CRPL-5008(213). On January 23, 2025, two proposals were received from the following firms:
• Siegfried Engineering, Inc. (Stockton, CA)
• Kimley-Horn and Associates, Inc. (Sacramento, CA)
The Selection Committee, comprised of Public Works’ staff, evaluated and ranked the proposals based on each firm’s understanding of work, experience with similar kinds of projects, staff qualifications and technical ability, project approach, and familiarity with federal transportation funding procedures.
Siegfried Engineering, Inc. received the highest ranking, based on the noted criteria, and was determined to be the most qualified firm for this project. Staff negotiated a fee in the amount of $337,530.04 with Siegfried Engineering, Inc. This fee is approximately 15 percent of the total estimated construction cost, which is reasonable for a project of this type and complexity. Siegfried Engineering, Inc. has proposed a 28 percent DBE participation, which exceeds the DBE goal of 12 percent. A total of $484,582 in federal and local funding is available for design, administration, and contingency costs. The federal funding has been programmed in the 2025-30 Five-Year CIP.
It is recommend that Council adopt a resolution to transfer the local match of $55,582 to the project.
It is also recommended that Council adopt a resolution authorizing the City Manager to execute a Professional Services Contract, in the amount of $337,530.04, with Siegfried Engineering, Inc. for design of the Swain Road and Morgan Place Roundabout, Project No. WT24047/Federal Project No. CRPL-5008(213). It is anticipated that the design will be completed by summer 2026.
Findings
Pursuant to SMC section 3.68.070, Council may approve findings which support an exception to the competitive bidding process. These findings include:
1. The City does not have sufficient staff resources to design this project.
2. The scope of design services requires an engineering firm experienced in the design of roundabouts.
3. Use of the RFP process is appropriate for this Professional Services Contract because it relies on the evaluation of professional qualifications and performance as the basis for selection of a vendor. Use of the criteria helps ensure selection of a vendor that will provide the highest quality professional service, which is in the public interest.
4. The City negotiated a contract following solicitation of competitive proposals in accordance with SMC section 3.68.070.A.3.
FINANCIAL SUMMARY
With the transfer of funds from the Grant Match, Project No. WT21016, to the Swain Road and Morgan Place Roundabout, Project No. WT24047/Federal Project No. CRPL-5008(213), there will be sufficient funding to award a Professional Services Contract to Siegfried Engineering, Inc. in the amount of $337,530.04.
There is no impact to the City’s General Fund or any other unrestricted fund as a result of taking the recommended actions.
