body
Summary
On October 24, 2021, the Teen Impact Center suffered extensive roof and interior damage due to a significant storm event. There was a critical need to safeguard the interior of the Teen Impact Center from further damage. With City Manager approval, Public Works negotiated a contract with Stratus Construction Co. of Stockton, CA. On December 8, 2021, a Construction Contract was executed for the negotiated amount of $289,916 with Stratus Construction Co. (Attachment A) to replace the Teen Impact Center roof. Contract Change Order No. 1 in the amount of $ 1,018.18 (Attachment B) was approved administratively for a total contract amount of $290,934.18.
The negotiated contract was processed in accordance with the provisions of Stockton Municipal Code (SMC) section 3.68.070, which provides an exception to the competitive bidding process under certain circumstances, including cases of emergencies. SMC section 3.68.070 requires that a written report, including findings upon which the emergency was based, shall be provided to City Council for approval. The roof replacement was completed on February 16, 2022.
The recommended motion includes approval of findings for the emergency Construction Contract for the Teen Impact Center Roof Replacement project to safeguard the facility from further water and vandalism damage.
DISCUSSION
Background
In June 2021, the Teen Impact Center was vacated by Family Resource and Referral after expiration of the operator agreement with the Community Services Department. Following this vacancy, the facility was vandalized multiple times, most notably through roof perforation. This damage was discovered by staff through preliminary inspections and planning efforts for the future consolidation of Community Services staff to the facility. Initial structural assessments were performed in early September and October 2021 to plan the roof repairs.
Beginning October 24, 2021, all of northern California was pummeled by a significant storm event that would later be categorized as a “Bomb Cyclone”. A powerful extratropical cyclone struck the western United States and Canada. In northern California, the cyclone tapped into a large atmospheric river and underwent explosive intensification, becoming the most powerful bomb cyclone recorded in the northeast Pacific. Within 24-hours, Stockton received over four-inches of rainfall. Despite preventative measures to protect the facility, the Teen Impact Center suffered extensive roof and interior damage due to the storm event.
On November 1, 2021, Siegfried Engineering performed a structural assessment of the Teen Impact Center. The roof was determined to be in disrepair with parts of the roof visibly missing.
On November 16, 2021, by Resolution No. 2021-11-16-1501, Council approved $900,000 of Discretionary Funding for the Teen Impact Center Roof Replacement, Project No. CR22002.
Due to the critical need to complete the roof replacement and prevent further damage, the City Manager authorized staff to negotiate a contract on an emergency basis. Prior to negotiating a Construction Contract with Stratus Construction Co., Public Works explored the use of Cooperative Purchasing Agreements for job-order contracting; however, they were over double the cost and required four months delay based on contractor availability. Because of the reasonable cost, positive past experience on City projects, and ability to mobilize immediately, Public Works recommended that the City enter into a Construction Contract with Stratus Construction Co. to complete the roof replacement.
On December 8, 2021, a Construction Contract (Attachment A) was executed for the negotiated amount of $289,916 with Stratus Construction Co. of Stockton, CA, for the project. Contract Change Order No. 1 in the amount of $ 1,018.18 (Attachment B) was approved administratively for a total contract amount of $290,934.18.
The negotiated contract was processed in accordance with the provisions of SMC section 3.68.070, which provides an exception to the competitive bidding process under certain circumstances, including cases of emergencies. SMC section 3.68.070 requires that a written report, including findings upon which the emergency was based, shall be provided to City Council for approval.
Present Situation
On January 18, 2022, Stratus Construction Co. secured the needed equipment, materials and permits for the project and commenced work on the Teen Impact Center Roof Replacement project. The roof replacement was completed on February 16, 2022. Public Works staff is completing the closeout of the construction contract with Stratus Construction Co.
Findings
The findings for this emergency construction pursuant to SMC section 3.68.070 are as follows:
1. The damaged Teen Impact Center was a hazard that could adversely affect the public health, safety, welfare and/or morale of the City of Stockton.
2. Failure to undertake emergency roof replacement of the Teen Impact Center would have resulted in additional damage from being exposed to the elements. More damage to the facility impacts plans for the Community Services Department’s to consolidate staff at the Teen Impact Center to provide needed youth programming and streamlined coordination of community sports and special events with the public, and further adversely affecting the public health, safety, welfare and/or morale of the City of Stockton.
3. The damaged Teen Impact Center was vulnerable to vandalism that could significantly increase the cost of the project and impacted the delivery of public services.
4. Stratus Construction Co. was selected as the most qualified construction contractor given the following:
• Experienced commercial general contractor, serving both the public and private sectors;
• Locally-owned;
• Completed a successful roof replacement project approximately two years ago for multiple buildings located at the Corporation Yard; and
• Maintaining an overall reliable and good working relationship with the City of Stockton for projects.
Staff recommends Council approve payment in an amount up to $290,934.18 to Stratus Construction Co. for construction of the Teen Impact Center Roof Replacement, Project No. CR22002.
