Summary

On June 23, 2020, by Resolution No. 2020-06-23-1108-02, Council awarded a Construction Contract, in the amount of $14,544,221.95, to George Reed, Inc., of Modesto, CA, to complete the Miner Avenue Complete Street Improvements, Project No. WT16007/Federal Project No. ATPL-5008(158); Project No. WT17032/Federal Project No. ATPSB1L-5008(170); and Project No. WT15015/Federal Project No. CML-5008(188).

On August 11, 2020, by Motion No. 2020-08-11-1111, Council awarded a Professional Services Contract, in the amount of $1,706,570, to Salaber Associates, Inc., of Rancho Cordova, CA, for construction management services for the Miner Avenue Complete Street Improvements, Project No. WT17032.

The Miner Avenue Complete Street Improvements project is now complete with vehicles and pedestrians actively using the newly improved corridor.  The project began construction in September 2020 and was originally scheduled to be completed by October 2021.  Construction delays related to added work, unforeseen field conditions, utility conflicts, and inclement weather extended the original project completion through 2022.

Construction Contract Change Order (CCO) Nos. 1 through 9, in the amount of $2,520,930.13, were previously approved under the administrative change order authority allowed under the original contract.  CCO No. 10, with George Reed, Inc., in the amount of $452,152.55, requires Council authorization as the cumulative amount of CCO Nos. 1 through 10 exceeds the administrative change order authority allowed under the existing contract (Exhibit 1 - CCO No. 10).  Staff recommends Council approve CCO No. 10 in the amount of $452,152.55 to pay for the additional pavement needed between Hunter Street and Sutter Street, and at the intersection of San Joaquin Street and Miner Avenue roundabout.  The total revised contract value will be $17,517,304.63.

Additional services from Salaber Associates, Inc., Construction Manager, are required to complete project closeout paperwork.  Staff recommends Council authorize Amendment No. 2 to the Professional Services Contract, in the amount of $135,267.62, with Salaber Associates, Inc. to complete the extended duration of the project’s closeout activities.  The total revised contract value will be $2,076,045.22.

DISCUSSION

Background

The Miner Avenue Complete Street Improvements project rehabilitated Miner Avenue from Center Street to Aurora Street (Attachment A). On February 21, 2017, Council adopted Resolution No. 2017-02-21-1601 to approve both the environmental clearance and a Precise Road Plan (PRP) for the Miner Avenue Complete Street Improvements project.  Miner Avenue, an east-west connective corridor in Downtown Stockton, was a four-lane road, with two lanes in each direction. The PRP identified a “road diet” along the corridor that reduced the number of vehicle travel lanes from two lanes to one lane in each direction with buffered bicycle lanes, landscaped medians, signal and lighting improvements, and a roundabout at the intersection of Miner Avenue and San Joaquin Street. The project also included repaving the roadway, installing pedestrian and bicycle amenities, bulb-out round corners at intersections, and upgrading sewer and storm infrastructure as needed.

On June 23, 2020, by Resolution No. 2020-06-23-1108-02, Council awarded a Construction Contract, in the amount of $14,544,221.95, to George Reed, Inc., of Modesto, CA, to complete the Miner Avenue Complete Street Improvements, Project No. WT16007/Federal Project No. ATPL-5008(158); Project No. WT17032/Federal Project No. ATPSB1L-5008(170); and Project No. WT15015/Federal Project No. CML-5008(188).  Construction completion of the project was originally anticipated to be October 2021.

On August 11, 2020, by Motion No. 2020-08-11-1111, Council awarded a Professional Services Contract, in the amount of $1,706,570, to Salaber Associates, Inc., of Rancho Cordova, CA, to provide construction management services for the Miner Avenue Complete Street Improvements, Project No. WT17032.  The duration of construction management services coincides with the project duration.

The Miner Avenue Complete Street Improvements project began construction on September 14, 2020.  After construction started, the City was successful in receiving additional funding from the Transformative Climate Communities (TCC) Program administered by the California Strategic Growth Council.  On December 15, 2020, by Resolution No. 2020-12-15-1402, Council approved a grant agreement with the California Strategic Growth Council for $10,834,490 in TCC funding.  The Miner Avenue Complete Street Improvements project received $1,500,000 in TCC funding for additional frontage improvements.  Staff subsequently processed CCO No. 4 for the additional frontage improvements funded by the TCC funding as authorized by Resolution No. 2020-12-15-1402.

Present Situation

The Miner Avenue Complete Street Improvements project is now complete with vehicles and pedestrians actively using the newly improved corridor.  The project began construction in September 2020 and was originally scheduled to be completed by October 2021.  Construction delays related to added work, unforeseen field conditions, utility conflicts, and inclement weather extended the original project completion through 2022.

CCO Nos. 1 through 9, in the amount of $2,520,930.13, were previously approved under the administrative change order authority allowed under the original contract.  These change orders were needed to facilitate utility adjustments; fire hydrant upgrades; modifications and/or additions to electrical, sewer, storm and water facilities; additional roadway repairs; and additional infrastructure along Miner Avenue.

CCO No. 10, with George Reed, Inc., in the amount of $452,152.55, is required to pay for the additional pavement needed between Hunter Street and Sutter Street, and at the intersection of San Joaquin Street and Miner Avenue roundabout.  These field changes were made to improve the rideability for motorists and bicyclists.  The additional pavement accommodated adjacent grade differences and revised roundabout geometry and elevations.  Council approval is required for CCO No. 10, as the cumulative amount of CCO Nos. 1 through 10 will exceed the administrative change order authority under the contract.  The total revised contract value will be $17,517,304.63.

Salaber Associates, Inc. is the Construction Manager administering the project closeout activities.  Amendment No. 2 to the Professional Services Contract with Salaber Associates, Inc. is needed for additional construction management services to complete the extended duration of the project’s closeout activities.  Staff recommends Council authorize Amendment No. 2 to the Professional Services Contract, in the amount of $135,267.62, with Salaber Associates, Inc.  The total revised contract value will be $2,076,045.22.

The additional funding needed for final construction work and closeout activities will come from Measure K Maintenance, Traffic Signal Modification Program account fund balances, and the State of California Federal Coronavirus Response and Relief Supplemental Appropriations Act of 2021 (CRRSAA) Program funds.  In May 2021, the California Transportation Commission (CTC) made available $182 million in CRRSAA Program funding.  The San Joaquin Council of Governments has programmed this new funding into the local agencies Surface Transportation Block Grant Program.  Stockton will receive $752,705 in State CRRSAA Program funding that can be used for transportation projects.  The full amount of $752,705 in CRRSAA funding will be used on the Miner Avenue Complete Street Improvements project.

FINANCIAL SUMMARY

The project is funded with federal and State Active Transportation Program funds, Measure K Bicycle, Pedestrian, and Safe Routes to School and Smart Growth Incentive Program, Congestion Mitigation and Air Quality Improvement Program, Local Resurfacing funds, Wastewater funds, and other City matching funds.  This existing funding has already been appropriated.

The resolution includes the following actions to provide sufficient funding to fund all other construction related costs to complete the project:

1.                     Appropriate additional State of California Federal CRRSAA funds in the amount of $752,705 to Project No. WT16007 (formerly PW1607), Account No. 4570-000-800007-300-000-30-45-000-000; and

2.                     Appropriate additional Measure K funds from Measure K fund balance in the amount of $140,000 to Project No. WT17032 (formerly PW1732), Account No. 4510-000-800007-300-000-30-45-000-000; and

3.                     Transfer funds in the amount of $500,000 from the Traffic Signal Modification Program, Project No. WT15029 (formerly PW1529), Account No. 4570-000-800007-300-000-30-45-000-000, to the Miner Avenue Complete Street Improvements, Project No. WT17032 (formerly PW1732), Account No. 4510-000-800007-300-000-30-45-000-000, to provide additional funds for CCO No. 10.

There is no impact to the City’s General Fund or any other unrestricted fund as a result of taking the recommended actions.
