SUMMARY
On November 28, 2023, two (2) City of Stockton employees submitted a Request for Appeal/Public Hearing regarding the results of a practical exam administered by the Human Resources (HR) Department. The practical exam was administered to establish an eligibility list for the job classification of Program Manager I. Subsequently, the eligibility list was approved by the Civil Service Commission on December 21, 2023. The employees request the Civil Service Commission review the examination pursuant to Civil Service Rules for Miscellaneous Employees, Rule VI Application and Examination, Section 10(d) Errors in Computing Scores.
DISCUSSION
Background
The following is a timeline of events leading to this agenda item:
• November 28, 2023 - Julie Dycus-Coons and Lynn Smith submitted a Request for Appeal/Public Hearing (Attachment A).
• December 18, 2023 - HR met with the employees individually and allowed them to inspect their examination pursuant to Rule VI Application and Examination, Section 10 Examination Results and Inspection of Final Scoring. Both employees requested their concerns be brought forth to the Commission.
• January 18, 2024 - The item was agendized for closed session for discussion of Rule VI, Section 15(d) Non-Appealable Actions. After further legal review, Staff determined that Rule VI, Section 15(d) Non-Appealable Actions was not applicable. Accordingly, the item was rescheduled for February 15, 2024, for review and consideration by the Commission under Rule VI, Section 10(d).
Authority
Rule VI, Section 10(d) reads as follows:
“(d) Errors in Computing Scores. Upon the request of a candidate, the candidate shall be granted a consultation with the director and/or the Chief Examiner to discuss the correction of any item or errors in the computation of the candidate’s total score, and to review the reasons for the score. The consultation may include discussion of the written, performance, oral, or other rating devices.
If an error in the marking or grading of an examination is raised by the candidate, the Civil Service Commission shall be informed at the next regular meeting. The Commission shall consider the request from the candidate and the report from the director concerning such alleged error(s). The Commission shall determine the need for correction and, if necessary, shall instruct the director to republish the eligible list as corrected by the Commission. Such correction(s) shall not invalidate any certification or employment previously made.”
Present Situation
In accordance with Rule VI, Section 10(d), the Commission shall review the appropriate supporting documents to determine if there was an error in the computation of the examination for the Program Manager I and direct HR to 1) make no changes or 2) republish the eligibility list. Attached you will find a report from HR (Attachment B) detailing the issues brought forward by the employees along with HR’s response.
HR recommends that the Civil Service Commission maintain the existing eligibility list established on December 21, 2023.
