APPROVE AQUATICS AND FACILITIES MANAGEMENT AGREEMENT WITH COMMUNITY SERVICES SOLUTIONS LLC AND FIRST AMENDMENT TO ADD OAK PARK POOL (ALL DISTRICTS - CITYWIDE)

RECOMMENDATION
It is recommended that the City Council approve a motion to:
1. Authorize the City Manager, or designee, to execute a 2026 Aquatics and Facilities Management Agreement with Community Services Solutions LLC for the operation of City aquatic facilities for the 2026 swim season, in an amount not to exceed $57,000;
2. Authorize the City Manager, or designee, to execute a First Amendment to the Agreement to add Oak Park Pool, located at 3537 Alvarado Avenue, and increase the total not-to-exceed amount by $57,000, for a total not-to-exceed amount of $114,000; and
3. Approve findings which support and justify an exception to the competitive bidding process pursuant to Stockton Municipal Code section 3.68.070(A)(3), where the City used a competitive Request for Proposals process.
4. Authorize the City Manager, or designee, to take all necessary and appropriate actions to carry out the purpose and intent of this motion.

Summary
The Community Services Department (CSD) recommends approval of an agreement with Community Services Solutions LLC (Operator) to operate City aquatic facilities for the 2026 swim season (Agreement). The Agreement establishes the responsibilities for facility operations, including staffing, programming, daily operations, and reporting requirements.
The proposed First Amendment adds Oak Park Pool to the scope of services and increases compensation to reflect the additional facility (Amendment). Approval of this item ensures continued aquatics operations and expands service delivery to include Oak Park Pool.
DISCUSSION
Background
The City issued a Request for Proposals (RFP) PUR 26-024 - Sousa Park Pool Management on March 12, 2026, to solicit qualified operators to provide comprehensive aquatic facility management services. Proposals were due on March 26, 2026, at 2:00 PM. In response to the RFP, the City received two (2) proposals from qualified firms. Proposals were reviewed and evaluated by a City staff review panel based on qualifications, experience, operational approach, and ability to meet the City’s service needs, consistent with the evaluation criteria outlined in the RFP. Following the evaluation, Community Services Solutions LLC was determined to be the most responsive and responsible proposer and is recommended for contract award.
The Agreement reflects the originally planned scope of the RFP (Attachment B). After issuing the RFP, CSD determined that additional services were needed at Oak Park Pool. The addition of Oak Park Pool increased the not-to-exceed amount of the contract, such that City Council approval is required. Thus, a separate amendment to add services at Oak Park Pool is included for approval (Attachment A).
Present Situation
The proposed Agreement (Attachment B) authorizes Community Services Solutions LLC to operate designated aquatic facilities for the 2026 swim season. The Operator will be responsible for day-to-day operations, including staffing, programming, and facility oversight, while the City retains responsibility for utilities, major maintenance, and water quality support.
The First Amendment (Attachment A) adds Oak Park Pool, located at 3537 Alvarado Avenue, to the list of operated facilities. This expansion increases access to aquatics programming and supports service delivery in an area of community need.
The Amendment also increases the total compensation to reflect the additional facility while maintaining the existing payment structure and performance requirements outlined in the Agreement.
Approval of this item will allow the Operator to proceed with pre-season preparation, including recruitment, training, and program planning, to ensure facilities are operational for the 2026 swim season.
Findings
Pursuant to Stockton Municipal Code section 3.68.070(A)(3), the City Council finds that an exception to the competitive bidding requirements is justified and in the best interest of the City based on the following findings:
1. The City conducted a competitive Request for Proposals (RFP) process through RFP PUR 26-024 - Sousa Park Pool Management, which was publicly advertised and solicited qualified firms to provide aquatic facility management services.
2. The City received two responsive proposals from qualified firms. Proposals were evaluated by a City review panel using criteria established in the RFP, including qualifications, relevant experience, operational approach, and ability to meet the City’s service needs.
3. Community Services Solutions LLC was determined to be the most responsive and responsible proposer through the competitive evaluation process and was selected based on merit and demonstrated ability to perform the required services.
4. Following issuance of the RFP, the Community Services Department determined that operation of Oak Park Pool should be incorporated into the scope of services to meet community aquatics needs for the 2026 swim season.
5. The services required at Oak Park Pool are substantially similar in nature to the services solicited through the competitive RFP process and can be efficiently and effectively performed by the selected operator under the same operational standards, staffing requirements, and performance expectations.
6. Reissuing a separate competitive solicitation for Oak Park Pool would result in delays to recruitment, training, program preparation, and facility readiness that could jeopardize timely operation of the pool for the 2026 swim season and reduce aquatics services available to the community.
FINANCIAL SUMMARY
The total not-to-exceed compensation under the Agreement is $114,000 for the 2026 swim season.
• Base Agreement: $57,000
• First Amendment (Oak Park Pool): $57,000
• Total Not-to-Exceed: $114,000
Payments will be made in accordance with the Agreement’s compensation schedule in three installments (33.33%, 33.33%, and 33.34%) upon receipt of invoices and required documentation.
Funding for this agreement is included in the Community Services Department’s General Fund adopted budget for aquatics operations.
