RECOMMENDATION

 

It is recommended that the City Council adopt a resolution to:

 

1.                     Authorize the City Manager to execute the Subdivision Agreement, accept on behalf of the public all offers of dedication, and record the parcel map, Parcel Map COS 24-04, and

 

2.                     Authorize the City Manager to take appropriate and necessary actions to carry out the purpose and intent of the resolution.

Summary

 

The proposed resolution authorizes the City Manager to execute the Subdivision Agreement with SLD Management, Inc., a California Corporation, accept all offers of dedication, and record the parcel map, Parcel Map COS 24-04. The subdivision contains 17.98 acres divided into five (5) lots for commercial use and a remainder parcel. It is located at the southwest corner of Trinity Parkway and Scott Creek Drive. See Attachment A - Vicinity Map.

 

Review and approval of the Parcel Map and Subdivision Agreement are necessary to ensure the Tentative Map (TM P23-0266) conditions are fulfilled. If the City Council approves the parcel map, the City will transmit the map and Subdivision Agreement to the San Joaquin County Recorder.

 

It is recommended that the Council adopt the proposed resolution as SLD Management, Inc. has fulfilled all necessary conditions.

 

DISCUSSION

 

Background

 

On March 28, 2024, the Planning Commission approved the Tentative Parcel Map (TM P23-0266) and Design Review application, subject to conditions, for the parcel located at the southwest corner of Trinity Parkway and Scott Creek Drive. The parcel is approximately 17.98 +/- acres to be subdivided into five (5) lots for the purposes of developing a Chick-Fil-A restaurant, an In-N-Out restaurant, a Dutch Brother’s Coffee shop, a self-storage facility, and a remainder parcel.

 

On April 8, 2024, an appeal was filed with the City Council requesting reconsideration of the Planning Commission’s approval, citing environmental concerns. On June 4, 2024, the City Council denied the appeal and upheld the Planning Commission’s March 28, 2024, approval of the Tentative Parcel Map and Design Review.

 

Present Situation

 

SLD Management, Inc. submitted a parcel map (Parcel Map COS 24-04) to complete the subdivision process for the earlier approved Tentative Parcel Map. The subdivision contains 17.98 acres divided into five (5) lots for commercial use and a remainder parcel. It is located at the southwest corner of Trinity Parkway and Scott Creek Drive.

 

Staff reviewed Parcel Map COS 24-04 and subdivision applications and determined that all conditions necessary for approval are met, which includes preparing improvement plans for all proposed public off-site improvements within the adjacent streets, including raised medians, driveways, striping and extension of utilities into the project site, dedicating access and utility easements, paying proportionate share fees towards off-site improvement costs, and posting security bonds to guarantee the subdivision improvements.

 

The City Engineer reviewed Parcel Map COS 24-04 for technical accuracy, substantial conformance with the approved tentative map, and the required conditions are completed or incorporated within a Subdivision Agreement. The City Engineer recommends forwarding the Parcel Map, Subdivision Agreement, and any offers of dedication to the City Council for consideration and approval.

 

The Subdivision Agreement (Exhibit 1 to the proposed resolution) contains the subdivider’s obligations for project site development. The proposed resolution authorizes the City Manager to execute the Subdivision Agreement, accept on behalf of the public all offers of dedication, and authorizes the recordation of the parcel map. It is recommended that the Council adopt the proposed resolution as SLD Management, Inc. fulfilled all necessary conditions.

 

FINANCIAL SUMMARY

 

The costs of creating the Subdivision Agreement for Parcel Map COS 24-04, including plan checking, inspection, map filing, and computer mapping services provided by City staff, have been paid by the subdivider in the amount of $115,226.81 and deposited in various fee accounts in the Development Services Fund. These fees and deposits are described in detail in Exhibit A of the Subdivision Agreement. All other fees will be assessed at the time building permits are issued.

 

There is no financial impact to the City of Stockton because of the execution of the Subdivision Agreement. The developer bears the costs of constructing the required infrastructure improvements and developing the parcels.
