APPROVE MOTION TO AUTHORIZE PROFESSIONAL SERVICES CONTRACT AMENDMENT NO. 2 FOR THE FRENCH CAMP ROAD AND MCDOUGALD BOULEVARD TRAFFIC SIGNAL PROJECT

RECOMMENDATION
It is recommended that the City Council approve a motion to:
1. Approve findings pursuant to Stockton Municipal Code section 3.68.070 in support of an exception to the competitive bidding process.
2. Authorize the City Manager to execute Professional Services Contract Amendment No. 2 in the amount of $73,183 with W-Trans, Inc. for environmental clearance for the French Camp Road and McDougald Boulevard Traffic Signal, Project No. WT18023.
It is also recommended that the City Manager be authorized to take appropriate and necessary actions to carry out the purpose and intent of this motion.

Summary
The intersection of French Camp Road and McDougald Boulevard is located in the Weston Ranch neighborhood of the City (Attachment A). On October 19, 2023, the City advertised a Request for Proposals (RFP) for professional design services for the French Camp Road and McDougald Boulevard Traffic Signal, Project No. WT18023. On November 15, 2023, two firms submitted proposals for this project. The Selection Committee evaluated the proposals and found W-Trans, Inc. to be the most qualified and highest ranked firm.
On February 16, 2024, the City Manager approved a Professional Services Contract in the amount of $85,832 to W-Trans, Inc. of Oakland, CA, for professional design services for the French Camp Road and McDougald Boulevard Traffic Signal, Project No. WT18023. The design was completed in September 2024.
On January 23, 2025, the City Manager administratively approved Professional Services Contract Amendment No. 1 in the amount of $8,910. This amendment was to complete the Congestive Mitigation Air Quality (CMAQ) grant application on behalf of the City. In 2025, the CMAQ grant application was successful, and the project was awarded the full amount of $1,107,000 for construction. Before CMAQ is funded, environmental clearance must comply with federal National Environmental Policy Act (NEPA) standards before the project can proceed with construction.
Professional Services Contract Amendment No. 2 in the amount of $73,183 is for environmental clearance. This amendment requires Council authorization as the cumulative amount for professional services exceeds the administrative change order authority available.

DISCUSSION
Background
The intersection of French Camp Road and McDougald Boulevard is located in the Weston Ranch neighborhood of the City (Attachment A). In the City’s 2019 Traffic Signal and Roundabout Priority Study, it was determined that this intersection met warrants for a traffic signal and was ranked high on the priority list. In 2023, the City converted the intersection from one-way to all-way stop controlled as an interim solution to improve safety and reduce delay at the intersection. Design of a traffic signal was started in February 2024 with the intent of applying for construction grant funding.

Present Situation
The design scope included completing environmental clearance per the California Environmental Quality Act. The CMAQ funding for construction is federal funding that requires compliance with federal NEPA standards before the project can proceed with construction. Complying with NEPA will generally require more technical studies and coordination with Caltrans. The following studies, at a minimum, are needed to achieve approval: PM10/PM2.5 Interagency Consultation to address Air Quality and Conformity, Phase I Initial Site Assessment Memorandum to address hazardous materials, and Community Impacts Technical Memo.

Findings
Pursuant to Stockton Municipal Code (SMC) section 3.68.070, Council may approve findings which support an exception to the competitive bidding process. These findings include:
1. The City does not have the expertise to perform the tasks outlined in the scope of work.
2. Use of the RFP process is appropriate for this Professional Services Contract because it relies on the evaluation of professional qualifications and performance as the basis for selection of a vendor. Use of the criteria helps ensure selection of a vendor that will provide the highest quality professional service, which is in the public interest.
3. The City negotiated a contract following solicitation of competitive proposals in accordance with SMC section 3.68.070.A.3.
FINANCIAL SUMMARY
There is sufficient funding in the French Camp Road and McDougald Boulevard Traffic Signal, Project No. WT18023, to approve Professional Services Contract Amendment No. 2 with W-Trans, Inc. in the amount of $73,183. With approval of Professional Services Contract Amendment No. 2, the revised contract amount with W-Trans, Inc. will be increased to $167,925.
