AUTHORIZE A COOPERATIVE PURCHASING AGREEMENT WITH BENCHMARK SOLUTIONS LLC FOR PREDICTIVE ANALYTICS SERVICES

RECOMMENDATION
It is recommended that the City Council adopt a resolution to:
1. Approve findings pursuant to Stockton Municipal Code 3.68.070 in support of an exception to the competitive bidding process.
2. Authorize the City Manager to enter into a Cooperative Purchasing Agreement with Benchmark Solutions LLC (Attachment A - PRISM MSA), for an annual not-to-exceed amount of $120,960.
It is also recommended that the City Manager be authorized to take necessary and appropriate actions to carry out the purpose and intent of this resolution.

Summary
Risk Pools are Joint Powers Authorities (JPA) formed by public entities to pool their funds, obtain Excess (Stop Loss) coverage for members, and jointly implement programs, build facilities, or deliver services. On June 18, 2025, PRISM’s GL2 Committee voted to accept the City to participate in their GL2 program. A condition of the City’s participation in the program was that the City implement Benchmark Analytics, within ninety (90) days of becoming a member, or no later than September 29, 2025. Benchmark provides real-time analytics allowing command staff to proactively identify agency and officer-level risk patterns before adverse events happen. The technology recommends and tracks support strategies that change officer behavior as well as facilitate custom wellness planning to improve health and well-being. Benchmark automates and centralizes agency operations while enabling command staff to elevate performance, trust, and transparency. Staff have been working with the Benchmark analytics team to meet the implementation deadline.
DISCUSSION
Background
Between 2018 and 2022, the City sustained multiple severe losses that required its excess general liability carrier, California Joint Powers Risk Management Authority (CJPRMA), to pay out more than the City had paid in premiums each year. The City’s Police Department (PD) was identified as having most of those losses. The CJPRMA Board of Directors voted to expel the City from their Risk Pool effective June 30, 2025. On June 18, 2025, PRISM’s GL2 Committee voted to accept the City. As a condition of acceptance, PRISM required the City to implement the early intervention software system, Benchmark Analytics. Benchmark Analytics provides analytics allowing agencies to proactively identify officer risk patterns before adverse events occur, improving overall agency-level and officer-level performance.
Present Situation
On June 18, 2025, PRISM’s GL2 Committee voted to accept the City to participate in their GL2 program. One of the conditions of acceptance in the program was for the City to implement the early intervention software system, Benchmark Analytics, by September 29, 2025. PD, the City’s Information Technology Department, and the Benchmark Analytics team plan to integrate the new system with PD’s existing systems.
Findings
Stockton Municipal Code Section 3.68.070(A)(5) provides an exception to the competitive bidding process for contracts over one-hundred thousand dollars ($100,000) where the City Council adopts findings which justify and support the exception. The following findings justify and support an exception:
1. Cooperative agreements qualify as an exception to the City’s competitive bidding process as outlined in City Municipal Code §3.68.070(A)(5) and City Policy 17.05.050, specifically: “Cooperative purchasing agreements authorized by the City Council for purchase of supplies or services through other governmental jurisdictions or public agencies.”
2. A cooperative purchasing agreement enables the City to utilize the terms and conditions of a competitively solicited and negotiated cooperative purchasing agreement.
3. A cooperative agreement with PRISM will meet the City’s procurement and business needs by providing continuity of service in a bigger risk pool.
4. A JPA is a formal, legal agreement between two (2) or more public agencies that share a common power and want to jointly implement programs, build facilities, or deliver services. Officials from those public agencies formally approve a cooperative arrangement to jointly negotiate these services and other programs.
5. The use of cooperative contracts improves time, efficiency, and enables the City to acquire products of equal or superior quality, along with value-added services, at competitive consortium-negotiated pricing.
FINANCIAL SUMMARY
There is sufficient funding in the General Liability Internal Service Fund (GL ISF) Account No. 2530-000-630015-520-000 to authorize a COOP with Benchmark Solutions LLC, in the amount of $120,960. Future funding will be allocated through the Police Department’s annual budgeting process.
