ADOPT RESOLUTION TO AUTHORIZE THE GRUPE PARK PICKLEBALL COURTS PROJECT

RECOMMENDATION

 

It is recommended that the City Council adopt a resolution to:

 

1.                     Approve the Notice of Exemption No. NOE52-25 under the California Environmental Quality Act for the Grupe Park Pickleball Courts, Project No. WP25033.

 

2.                     Approve the plans and specifications for the Grupe Park Pickleball Courts, Project No. WP25033.

 

3.                     Award a Construction Contract in the amount of $281,862 to Swierstok Enterprise, Inc., dba Pro Builders of Orangevale, CA, for the Grupe Park Pickleball Courts, Project No. WP25033.

 

It is also recommended that the City Manager be authorized to take appropriate and necessary actions to carry out the purpose and intent of this resolution.

Summary

 

The Grupe Park Pickleball Courts project will remove the three existing tennis courts and install 10 new permanent pickleball courts, new fencing, and new benches at Grupe Park (Attachment A). These courts will be the first dedicated pickleball courts at a City park.

 

On March 26, 2026, the City received four bids for this project.  On April 2, 2026, Frontline General Engineering Construction, Inc., the second low bidder, submitted a bid protest contending contractor could not complete all required work at the bid price with no substitutions to the materials.  After a thorough review, Public Works, in coordination with the City Attorney’s Office, determined the bid protest to be without merit.  

 

It is recommended that Council adopt a resolution to award a Construction Contract to the lowest responsive bidder, Swierstok Enterprise, Inc., dba Pro Builders, in the amount of $281,862. It is also recommended that Council adopt a resolution approving Notice of Exemption No. NOE52-25 under the California Environmental Quality Act (CEQA) and approving the plans and specifications for the project.

 

Construction is anticipated to begin summer 2026 and be completed by fall 2026, weather permitting.

 

 

 

DISCUSSION

 

Background

 

On July 9, 2024, by Resolution No. 2024-07-09-1508, Council allocated $3 million in discretionary funding for various Council priority projects Citywide. The funding provided $302,500 for the Grupe Park Pickleball Courts project. Design of the Grupe Park Pickleball Courts project was completed in December 2025.

 

The project was previously advertised on December 18, 2025, and on January 2, 2026, three bids were received. However, the apparent lowest bidder submitted a bid relief due to a bid error. On March 3, 2026, by Motion No. 2026-03-03-1209, Council approved a motion to reject all bids received.

 

The project will remove the three existing tennis courts and install 10 new permanent pickleball courts at Grupe Park (Attachment A). The project includes removing the existing tennis court posts, installing a new high-galvanized chain-link fence between the new courts, and modifying the existing perimeter fence to create a new entrance to the facility. The existing benches will also be removed, and new benches will be installed. These courts will be the first dedicated pickleball courts at a City Park.

 

Present Situation

 

On March 4, 2026, the Grupe Park Pickleball Courts, Project No. WP25033, was readvertised for bids. On March 26, 2026, four bids were received with the following results:

 

The requirements of Stockton Municipal Code (SMC) section 3.68.090, Local Business Preference, apply to this project. Frontline General Engineering Construction, Inc. is located within San Joaquin County limits and is entitled to a two percent bid preference. Application of the Local Business Preference has no effect on the bid order. The Local Employment Ordinance, SMC section 3.68.095, also applies to this contract.

 

The base bid from Swierstok Enterprise, Inc., dba Pro Builders, the lowest responsive bidder, is regular in all respects and has the proper license to perform the work. On April 2, 2026, Frontline General Engineering Construction, Inc. submitted a bid protest. Public Works staff, in coordination with the City Attorney’s Office, reviewed the protest and determined that Swierstok Enterprise, Inc., dba Pro Builders, could complete all required work at the bid price with no substitutions to the materials. Therefore, it is recommended that Council approve the plans and specifications, and award a Construction Contract to Swierstok Enterprise, Inc., dba Pro Builders, in the amount of $281,862, which includes the base bid and alternate bid, for the Grupe Park Pickleball Courts, Project No. WP25033.

 

The project is in conformance with the City’s General Plan, pursuant to California Government Code, section 65402, and is categorically exempt from the requirements of CEQA as specified under Section 15301(d) of the CEQA Guidelines. As a result, the project has been granted a categorical exemption. The activities related to this project constitute a discretionary project under the City’s jurisdiction and qualifies as a project that does not have a significant effect on the environment. The resolution will approve the filing of Notice of Exemption No. NOE52-25 under CEQA.

 

Construction is anticipated to begin summer 2026 and be completed by fall 2026, weather permitting.

 

FINANCIAL SUMMARY

 

There are sufficient funds available in the Grupe Park Pickleball Courts, Project No. WP25033, to award a Construction Contract to Swierstok Enterprise, Inc., dba Pro Builders in the amount of $281,862.
