APPROVE MOTION TO AWARD A PROFESSIONAL SERVICES CONTRACT FOR THE STREET RESURFACING ON FEDERAL-AID STREETS FISCAL YEAR 2024-25 PROJECT

RECOMMENDATION
It is recommended that the City Council approve a motion to:
1. Approve findings pursuant to Stockton Municipal Code section 3.68.070 in support of an exception to the competitive bidding process.
2. Award a Professional Services Contract to R.E.Y. Engineers, Inc. of Folsom, CA, in the amount of $282,922 for design of the Street Resurfacing on Federal-Aid Streets Fiscal Year 2024-25, Project No. WD25006.
It is also recommended that the City Manager be authorized to take appropriate and necessary actions to carry out the purpose and intent of this motion.

Summary
The Street Resurfacing on Federal-Aid Streets Fiscal Year (FY) 2024-25 project will resurface four street segments located on Dr. Martin Luther King Jr. Boulevard, Mariposa Road, Rosemarie Lane, and Pershing Avenue, for a total distance of approximately 1.9 miles (Attachment A). The project was included in the 2024-29 Five-Year Capital Improvement Plan (CIP).
On February 12, 2025, the City advertised a Request for Proposals (RFP) for the design of the Street Resurfacing on Federal-Aid Streets FY 2024-25 project. On March 5, 2025, three firms submitted proposals for this project. The Selection Committee evaluated the proposals and found R.E.Y. Engineers, Inc. to be the most qualified and highest ranked firm.
It is recommended that Council approve a motion authorizing the City Manager to execute a Professional Services Contract, in the amount of $282,922, with R.E.Y. Engineers, Inc. (Attachment B). It is anticipated that the design will be completed in December 2025, and construction will begin in summer 2026 and be completed by fall 2026, weather permitting.
DISCUSSION
Background
The City of Stockton receives an annual allocation of federal Surface Transportation Block Grant (STBG) Program funds. The project was included in the 2024-29 Five-Year CIP. These funds must be used on streets classified by the Federal Highway Administration as arterial or collector Federal Aid Urban (FAU) routes. The City typically uses STBG funds to resurface FAU street segments that have a poor pavement condition rating. This rating is established by the City’s pavement management system, which rates the pavement condition of all streets on a scale ranging from poor (Pavement Condition Index (PCI) = 0) to excellent condition (PCI = 100).
The City’s pavement management system identified the following roadway segments that warrant resurfacing (Attachment A):
Dr. Martin Luther King Jr. Boulevard (0.16 Miles)
• from Turnpike Road to Center Street (PCI = 58)
Mariposa Road (0.59 Miles)
• from Silva Street (County Limit) to State Route 99 West Frontage Road (PCI = 58)
Rosemarie Lane (0.50 Miles)
• from Pershing Avenue to Pacific Avenue (PCI = 43)
Pershing Avenue (0.65 Miles)
• from Robinhood Drive to March Lane (PCI = 32)
Resurfacing preserves the pavement structure and improves driving conditions and roadway aesthetics. Resurfacing at appropriate intervals will prevent severe deterioration from occurring, resulting in maximum infrastructure duration at the lowest life cycle cost. Resurfacing is a multi-step process that may involve the following preservation techniques: crack seal, base failure repair, slurry seal, micro-surface seal, rubberized cape-seal, and pavement overlay. Resurfacing projects also typically include other ancillary improvements such as the installation of wheelchair ramps (as required by the Americans with Disabilities Act); curb, gutter, and sidewalk replacement; adjustment of utility covers; removal and replacement of existing pavement striping; and installation of traffic signal detector loops. The street segments identified are heavily trafficked and have received numerous AskStockton requests for repair. Having a complete design plan will help ensure that efficient budgeting is captured prior to construction.
Present Situation
On February 12, 2025, the City advertised an RFP for the design of the Street Resurfacing on Federal-Aid Streets FY 2024-25, Project No. WD25006. On March 5, 2025, three proposals were received from the following firms:
• R.E.Y. Engineers, Inc. (Folsom, CA)
• CSG Consultants, Inc. (Sacramento, CA)
• BKF Engineers (Sacramento, CA)
The Selection Committee, comprised of Public Works’ staff, evaluated and ranked all proposals based on each firm’s understanding of work, experience with similar kinds of work, staff qualifications and technical ability, project approach, and familiarity with federal transportation funding procedures.
R.E.Y. Engineers, Inc. received the highest ranking, based on the noted criteria, and was determined to be the most qualified firm for this project. R.E.Y. Engineers, Inc. demonstrated a clearer understanding of the project approach, including the most experienced team, and provided an appropriate schedule to meet the project’s milestones. Staff negotiated a fee in the amount of $282,922 with R.E.Y. Engineers, Inc., which is reasonable for the scope of work being provided.
It is recommended that Council approve a motion authorizing the City Manager to execute a Professional Services Contract, in the amount of $282,922, with R.E.Y. Engineers, Inc. for design of the Street Resurfacing on Federal-Aid Streets FY 2024-25, Project No. WD25006 (Attachment B). It is anticipated that the design will be completed in December 2025, and construction will begin in summer 2026 and be completed by fall 2026, weather permitting.
Findings
Pursuant to Stockton Municipal Code (SMC) section 3.68.070, Council may approve findings which support an exception to the competitive bidding process. These findings include:
1. The City does not have sufficient staff and expertise to perform the scope of work for this project.
2. The scope of work requires an engineering firm experienced in pavement design.
3. Use of the RFP process is appropriate for this Professional Services Contract because it relies on the evaluation of professional qualifications and performance as the basis for selection of a vendor. Use of the criteria helps ensure selection of a vendor that will provide the highest quality professional service, which is in the public interest.
4. The City negotiated a contract following solicitation of competitive proposals in accordance with SMC section 3.68.070.A.3.
FINANCIAL SUMMARY
There are sufficient funds in the Street Resurfacing on Federal-Aid Streets FY 2024-25, Project No. WD25006, to award a Professional Services Contract to R.E.Y. Engineers, Inc. in the amount of $282,922.
There is no impact to the City’s General Fund or any other unrestricted fund as a result of taking the recommended action.
