It is recommended the City Legislation and Environmental Committee review and discuss the draft resolution to approve the annual display of the Juneteenth Flag and provide direction to staff and forward a recommendation to Council

Summary

 

Council Policy 2.07 - Flag Display Policy, was adopted by Council to ensure that the City could exercise control over any commemorative flags raised on City flagpoles (Attachment A - CPM 2.07).  The policy ensures that the raising of such commemorative flags is an act of government speech subject to the full discretion of the City Council.

 

A draft resolution (Attachment B - Juneteenth Flag Draft Resolution) to approve the annual display of the Juneteenth Flag is presented to the Legislation and Environmental Committee for review, discussion, and potential direction to staff and forwarding to the City Council.

 

DISCUSSION

 

Background

 

Prior to the adoption of the Flag Display Policy, the City of Stockton displayed only the United States Flag, the California State Flag, and the City of Stockton Flag on the flagpole located at Stockton City Hall.  There are both Federal and State regulations which dictate how the United States Flag and the California Flag must be displayed.

 

On May 13, 2025, the City Council passed two Resolutions, 2025-05-13-1201-01 and 2025-05-13-1201-02 approving the annual display of the Pride Flag and United States Military branches respectively.

 

Present Situation

 

Vice Mayor Lee has requested the annual display of the Juneteenth Flag to be brought forward for consideration.  Attachment B, the Draft resolution for annual display of the Juneteenth flag, is now presented for discussion, direction to staff, and possible forwarding of a recommendation to the City Council.

 

Staff asks for direction to establish how long the flag shall be displayed starting on June 19th.  Currently, Resolution 2025-05-13-1201-01 authorizes the Pride Flag to be flown the first week of June and Resolution 2025-05-13-1201-02 authorizes the United States Army flag to be flown on June 14th which extends to the weekend should the date fall when City Hall is closed.
