RECOMMENDATION

 

It is recommended that the City Council adopt a resolution to:

 

1.                     Authorize the grant of temporary construction easements to the California Department of Transportation (Caltrans) for the Stockton Channel Viaduct Bridge Improvements Project, for the areas depicted in Exhibits 1 and 2 of the resolution;

 

2.                     Authorize the filing of Notice of Exemption No. 11-26 under the California Environmental Quality Act (CEQA) for the grant of easements to Caltrans;

 

3.                     Authorize the City Manager, or designee, to receive, deposit, and appropriate revenues from Caltrans approximately $225,600 to the Marina Fund to address construction-related impacts;

 

4.                     Authorize the City Manager, or designee, to sign the temporary construction easement deeds, the right of way contract memorializing the just compensation from Caltrans, and the payee data record for the receipt of payment from Caltrans;

 

5.                     Authorize the City Manager, or designee, to take whatever actions are necessary and appropriate to carry out the purpose and intent of the resolution.

Summary

 

The California Department of Transportation (Caltrans) is proposing to rehabilitate the Stockton Channel Viaduct bridge to ensure the safety and reliability of the Interstate 5 (I-5) corridor. As part of the project, Caltrans has requested the City of Stockton grant a series of temporary construction easements necessary for the construction of the project (Attachment A - Vicinity map and Attachment B - Aerial Map).

 

DISCUSSION

 

Background

 

Interstate 5 (I-5) traverses the west end of Stockton, with the structure spanning a segment of the Stockton Channel, known as the viaduct bridge. Over the past ten years, Caltrans has been planning to make improvements to the viaduct bridge, including addressing structural deficiencies and improving load rating. The project is now nearing the start of construction, and Caltrans has requested the City of Stockton grant a series of temporary construction easements to Caltrans to facilitate construction activities.

 

Present Situation

 

For the Project to commence construction, Caltrans is requiring temporary construction easements (TCEs) over a portion of City property located in the Stockton Channel. The TCEs are needed to provide space for materials, equipment, and general access for bridge construction and other activities necessary for replacement of the viaduct structure. The TCEs shall be in place until September 28, 2035 through the duration of Project construction, unless terminated earlier by Caltrans.

 

Since the construction activities will impact the Morelli Boat Launch, Caltrans has agreed to provide compensation to the City for the granting of the TCEs.

 

Staff recommend that Council authorize the City Manager, or designee, to receive, deposit, and appropriate the revenues from Caltrans, totaling approximately $225,600 one-time payment to be appropriated to the Marina Fund balance to address unforeseen construction-related impacts, should they arise, as project construction is not anticipated to end until September 2035. 

 

ENVIRONMENTAL CLEARANCE

 

It has been determined by the Community Development Department that this action/project is Categorically Exempt under the California Environmental Quality Act (CEQA) and is granted a “general rule exemption” under Section 15061(B)(3) since there is no possibility that the activity in question would have significant effect on the environment and the activity is not subject to CEQA. In accordance with Section 65402 of the Government Code, the Community Development Department further determined that this activity/project conforms to the City’s General Plan Policy Document, as amended.

 

FINANCIAL SUMMARY

 

This action will not impact the City’s General Fund. However, the temporary closure of the Morelli Boat Launch associated with the granting of the easements to Caltrans may result in temporary revenue loss to the Marina Fund.  Any impact to City Marina operations will utilize the compensation fund from Caltrans, as outlined below.

 

Caltrans is providing compensation to the City of Stockton in the amount of $225,600 to acquire the temporary construction easements. These funds will be placed in the Downtown Marina Fund, Account# 6050-417-470007-640-000-60-00-000-000- and used to address construction-related impacts resulting from the project.
