RECOMMENDATION

 

It is recommended that the City Council approve a motion to:

 

1.                     Approve findings pursuant to Stockton Municipal Code section 3.68.070 in support of an exception to the competitive bidding process.

 

2.                     Approve findings and ratify the City Manager’s approval to execute an Emergency Purchase Order to Maita Chevrolet of Elk Grove, CA, in the amount of $154,804.40, for the purchase of two 2500 Chevrolet Silverado trucks for the Police Department.

 

It is also recommended that the City Manager be authorized to take appropriate and necessary actions to carry out the purpose and intent of this motion.

Summary

 

On March 18, 2025, the City Manager approved an Emergency Purchase Order (PO) to Maita Chevrolet of Elk Grove, CA, in the amount of $154,804.40, for the purchase of two 2500 Chevrolet Silverado trucks for the Police Department.

 

It is recommended that Council approve a motion ratifying the City Manager’s approval to execute an Emergency PO with Maita Chevrolet of Elk Grove, CA, in the amount of $154,804.40, for the purchase of two 2500 Chevrolet Silverado trucks.

 

DISCUSSION

 

Background

 

On November 19, 2024, by Resolution No. 2024-11-19-1501, Council adopted a resolution proclaiming a Local Emergency on Homelessness. Following this adoption of the proclamation, the Police Department submitted a request to the City Manager for the purchase of two new vehicles for the Field Operations Division and the Strategic Operations Section. The purchase supported enhanced enforcement efforts, in alignment with expanding the City’s Critical Infrastructure Ordinance and responding to the Grants Pass and State Orders.

 

The Police Department requested the purchase of two three-quarter-ton trucks to assist with the transportation of an arrestee's belongings and to aid community clean-ups. The Police Department currently uses patrol vehicles that have limited space and do not currently meet the needs to conduct day-to-day activities, such as moving of unsheltered persons' property and towing Police Department equipment.

 

On March 4, 2025, Public Works located two identical Chevrolet 2500 HD Z71 Silverado trucks at Maita Chevrolet of Elk Grove, CA. Police and Public Works staff inspected the units and confirmed that they meet the requirements of the Field Operations Division and the Strategic Operations Section.

 

On March 18, 2025, the City Manager approved an Emergency PO to Maita Chevrolet of Elk Grove, CA, in the amount of $154,804.40, for the purchase of two 2500 Chevrolet Silverado trucks for the Police Department.

 

Present Situation

 

On April 10, 2025, an Emergency PO was issued to Maita Chevrolet of Elk Grove, CA, for the two 2500 Chevrolet Silverado trucks from Maita Chevrolet. The Emergency PO was processed in accordance with Stockton Municipal Code (SMC) section 3.68.070, which provides an exception to the competitive bidding process under certain circumstances, including cases of emergencies. It was the goal of the department to bring emergency procurements to Council by the next scheduled Council meeting following the City Manager’s execution. However, workload, assigned priorities, and staffing shortages have caused delays in the timeline.

 

It is recommended that Council approve a motion ratifying the City Manager’s approval for the total expenditure of $154,804.40 for the emergency purchase of two 2500 Chevrolet Silverado trucks from Maita Chevrolet of Elk Grove, CA, and the appropriate findings that support an exception to the competitive bidding process.

 

Findings

 

Pursuant to SMC section 3.68.070, Council may approve findings which support an exception to the competitive bidding process.  These findings include:

 

1.                     The use of an Emergency PO procurement is appropriate for these procurements due to supply chain issues in receiving vehicles.

 

2.                     Public Works sought out multiple resources for the supply of vehicles. Only one source was available for the requested vehicles.

3.                     Other agencies were competing to secure the same vehicles, and any delay would have resulted in the City not being able to readily secure the needed vehicles.

 

4.                     The use of the Emergency PO procurement is appropriate for this purchase because it allows the City to be more competitive in acquiring equipment in current industry conditions, as vendors struggle to honor quoted pricing through the duration of a traditional government low-bid procurement process.

 

 

 

FINANCIAL SUMMARY

 

There is sufficient budget in the Police Department’s Equipment Acquisition, Account No. 3516-000-800004-100-000-20-35 for the purchase of two 2500 Chevrolet Silverado trucks for the Police Department.
