ADOPT RESOLUTION TO AUTHORIZE THE CHANNEL STREET CORRIDOR IMPROVEMENTS PROJECT

RECOMMENDATION
It is recommended that the City Council adopt a resolution to:
1. Approve the plans and specifications for the Channel Street Corridor Improvements, Project No. WT23031.
2. Authorize the City Manager to execute a Cooperative Agreement between the City of Stockton and the San Joaquin Regional Rail Commission for the Channel Street Corridor Improvements, Project No. WT23031.
3. Appropriate San Joaquin Regional Rail Commission funds in the amount of $8,600,000 to the Channel Street Corridor Improvements, Project No. WT23031.
4. Appropriate Affordable Housing and Sustainable Communities funds in the amount of $202,020 to the Channel Street Corridor Improvements, Project No. WT23031.
5. Award a Construction Contract in the amount of $6,284,667.20 to Azul Works, Inc. of San Francisco, CA, for the Channel Street Corridor Improvements, Project No. WT23031.
It is also recommended that the City Manager be authorized to take appropriate and necessary actions to carry out the purpose and intent of this resolution.

Summary
The Channel Street Corridor Improvements project is funded by the federal Active Transportation Program (ATP) and local Measure K grant funds. The grant funding for this project was secured by the San Joaquin Regional Rail Commission (SJRRC). The Channel Street Corridor Improvements project will install various measures including crosswalks, bicycle lanes, bulb-outs, sidewalks, curb and gutter, pavement, and lighting to improve the project area's safety and aesthetics. The project is located along Channel Street between Aurora Street and Stanislaus Street, and on Aurora Street, Grant Street, and Stanislaus Street between Miner Avenue and Weber Avenue (Attachment A)
SJRRC took the lead in designing the project, and the City will take the lead in construction of the project.
On September 26, 2024, the City received five bids for this project. It is recommended that Council award a Construction Contract to the lowest responsible bidder, Azul Works, Inc. in the amount of $6,284,667.20. It is also recommended that Council adopt a resolution approving the plans and specifications for the project and a Cooperative Agreement between the City of Stockton and the SJRRC. Construction is anticipated to be completed by summer 2026.
DISCUSSION
Background
The Channel Street Corridor Improvements project is sponsored by the SJRRC and is funded by federal ATP and local Measure K grant funds. The project will install various measures including crosswalks, bicycle lanes, bulb-outs, sidewalks, curb and gutter, pavement, and lighting to improve the project area's safety and aesthetics. The project is located along Channel Street between Aurora Street and Stanislaus Street, and on Aurora Street, Grant Street, and Stanislaus Street between Miner Avenue and Weber Avenue (Attachment A).
The SJRRC is funding this project and took the lead in completing the design of the project to enhance the area near the Cabral train station. The City will assume the lead role during the construction phase, as the project involves improvements made within City-street right-of-way. It is recommended that Council adopt a resolution approving a Cooperative Agreement between the City of Stockton and the SJRRC.
On February 5, 2019, Council approved Resolution No. 2019-02-05-1107 authorizing the City Manager to execute a Disbursement Agreement with Visionary Home Builders to access Affordable Housing and Sustainable Communities (AHSC) grant funding designated for the East Channel Street Corridor Improvements project. On September 6, 2022, the City Manager executed an AHSC Disbursement Agreement that allows the City to access funding in the amount of $202,020 for the East Channel Street Corridor Improvements project.
This project was previously advertised on July 19, 2024, and on August 22, 2024, five bids were received. However, the Notice Inviting Bids published in The Record inadvertently stated that the Local Business Preference Ordinance, Local Employment Ordinance, and Community Workforce and Training Agreement (CWTA) applied to the project. Unfortunately, the project is funded, in part, with ATP funding which does not allow use of the Local Business Preference and the Local Employment Ordinances as well as the CWTA. After consulting with the City Attorney’s Office, it was recommended that all bids be rejected. On September 17, 2024, by Motion No. 2024-09-17-1214, Council approved a motion to reject all bids received.
Present Situation
On September 5, 2024, the Channel Street Corridor Improvements, Project No. WT23031, was readvertised for bids. On September 26, 2024, five bids were received with the following results:

The bid from Azul Works, Inc., the lowest responsible bidder, is regular in all respects and has the proper license to perform the work. It is recommended that Council approve the plans and specifications for the project and award a Construction Contract to Azul Works, Inc. of San Francisco, CA, in the amount of $6,284,667.20.
FINANCIAL SUMMARY
With the appropriation of funds to the Channel Street Corridor Improvements, Project No. WT23031, there will be sufficient funding to award a Construction Contract to Azul Works, Inc. in the amount of $6,284,667.20.
There is no impact to the City’s General Fund or any other unrestricted fund as a result of taking the recommended actions.
