RECOMMENDATION
It is recommended that the City Council approve a motion to accept findings and ratify the emergency expenditure of $237,174.40 to Rain-for-Rent Inc. of Stockton and Pipe and Plant Solutions Inc. of Oakland, for emergency bypass pumping and repair services for sanitary sewer maintenance hole and pipelines along March Lane.
It is also recommended that the City Manager be authorized to take appropriate actions to carry out the purpose and intent of this motion.

Summary
On May 30, 2020, during routine sanitary sewer assessments, the Municipal Utilities Department (MUD) staff determined a maintenance hole and pipelines had been infiltrated by groundwater and sediment.
On June 1, 2020, staff further assessed the condition of the maintenance hole and pipelines and determined maintenance hole and pipelines had catastrophic failure.
On June 9, 2020, the City Council, as required by Stockton Municipal Code (SMC) Section 3.68.070, approved Motion 2020-06-09-1115, accepting findings and justifying an exemption to the competitive bidding process for emergency contracts for the pumping and repair services for sanitary sewer maintenance hole and pipelines along March Lane.
At the time City Council approved Motion 2020-06-09-1115, the final cost was not known, and it was indicated that the staff would return for final ratification of expenditures for this work.
If approved, this motion will ratify the final expenses associated with the emergency bypass pumping and repair services performed, respectively, by Rain-for-Rent Inc. and Pipe and Plant Solutions Inc. The emergency bypass pumping and repair services were completed on June 18, 2020, and the cost of services provided by Rain-for-Rent Inc. and Pipe and Plant Solutions Inc. was $237,174.40.
DISCUSSION
Background
The March Lane sanitary sewer pipelines are part of a network of 830 miles of the City’s sanitary collection system, which conveys wastewater from the northwest areas of the City to the Regional Wastewater Control Facility (RWCF). The sanitary collection system along March Lane receives flows of six to seven million gallons per day.
On June 1, 2020, the MUD staff identified a catastrophic failure of one maintenance hole and associated sanitary sewer pipelines. The cause for the maintenance hole and associated sanitary pipeline failure was unknown.
On June 1, 2020, due to the urgent need to maintain sewage flow along March Lane, the MUD retained emergency services from Rain-for-Rent Inc. and Pipe and Plant Solutions Inc., in accordance with Stockton Municipal Code (SMC) section 3.68.070, which provides an exception to the competitive bidding process under certain circumstances, including cases of emergencies.
On June 9, 2020, the City Council, as required by Stockton Municipal Code (SMC) Section 3.68.070, approved Motion 2020-06-09-1115, accepting findings and justifying an exemption to the competitive bidding process for emergency contracts for the pumping and repair services for sanitary sewer maintenance hole and pipelines along March Lane.
Upon completion of the work and a determination of final costs, staff would present the City Council with a final report requesting ratification of the actual expenditures and funding appropriation from the Wastewater Utility Fund balance.
Present Situation
An alternative temporary pumping system was installed and repair services on the sanitary maintenance hole and associated pipelines were completed on June 18, 2020, restoring normal sewage flow along March Lane. In accordance with Stockton Municipal Code (SMC) section 3.68.070, which provides an exception to the competitive bidding process in cases of emergencies, staff is now presenting the final expenses for ratification.
In July 2020, Pipe and Plant Solutions Inc. submitted the final cost of $193,388.65 for repair services and Rain-for-Rent Inc. submitted the final cost of $43,785.75 for the emergency bypass pumping for the for sanitary sewer maintenance hole and pipelines along March Lane.
Staff recommends that the City Council, by motion, ratify the total expenditure of $237,174.40 for emergency bypass pumping and repair services for sanitary sewer maintenance hole and pipelines along March Lane.
Findings
The findings for this emergency construction, in accordance with SMC section 3.68.070, are as follows:
1. The March Lane sanitary sewer collection system is a vital component of the City’s wastewater management.
2. The failure of the maintenance hole and associated pipelines made the collection systems unable to convey the necessary sewage flows to the RWCF to prevent significant sanitary sewer overflows.
3. An alternative temporary pumping system maintained service for the time necessary to replace and/or repair other damaged maintenance hole and associated pipelines.
4. The competitive bidding process would delay putting the emergency bypass pumping and repair in place and could have resulted in a significant sanitary sewer overflow if the remaining collections system along March Lane failed.
5. Rain-for-Rent, Inc. is a local contractor that was available and capable of completing the necessary bypass pumping, which was in the best interest of the public.
6. Pipe and Plant Solutions was available and capable of completing the repairs.
7. Replacement and repairs of the manhole and associated pipelines were completed June 18,2020.
8. Final expenses have been identified in the amount of $237,174.40.
FINANCIAL SUMMARY
There are sufficient funds in the Wastewater Utility Fund (431) for the emergency bypass pumping and repair services provided by Rain-for-Rent Inc. and Pipe and Plant Solutions Inc. Sufficient funds are available in the following account:
431-4332-571 Wastewater Utility - Maint. & Repair Services $237,174.40
There is no impact to the General Fund or any other unrestricted fund, from this action.
