RECOMMENDATION

 

It is recommended that the City Council adopt a resolution to:

 

1.                     Approve findings pursuant to Stockton Municipal Code section 3.68.070 which support and justify an exception to the competitive bidding process.

 

2.                     Award a three (3) year contract to West Yost & Associates, Inc. (West Yost), in the amount of $169,153, to complete a Risk and Resilience Assessment and Emergency Response Plan to satisfy American Water Infrastructure Act 2018 requirements. (Exhibit 1 to the Resolution).

 

It is also recommended that the City Manager be authorized to take appropriate and necessary actions to carry out the purpose and intent of this resolution.

Summary

 

The American Water Infrastructure Act of 2018 established a requirement for community water systems that serve more than 3,300 people to complete a Risk and Resilience Assessment and Emergency Response Plan for the U.S. Environmental Protection Agency. The City of Stockton Municipal Utilities Department (MUD) is responsible for the potable water supply of nearly 200,000 customers and is required to complete this planning activity. The law specifies the components that the Risk and Resilience Assessment (RRA) and Emergency Response Plan (ERP) must address, such as responses to natural hazards or malevolent acts, facility and infrastructure resilience, and chemical storage. The law also establishes deadlines for communities to certify the completion of these plans to the U.S. Environmental Protection Agency.

 

If approved, this action will award a three (3) year contract to West Yost, in an amount not-to-exceed $169,153, to complete a Risk and Resilience Assessment and Emergency Response Plan to satisfy American Water Infrastructure Act 2018 requirements.

 

DISCUSSION

 

Background

 

On October 23, 2018, the American Water Infrastructure Act (AWIA) was signed into law to improve rivers and harbors, water conservation, and water pollution control in the United States. Section 2013 of the AWIA requires community drinking water systems serving more than 3,300 people to develop or update risk assessments and emergency response plans. The law specifies the components that the Risk and Resilience Assessment (RRA) and Emergency Response Plan (ERP) must address, such as responses to natural hazards or malevolent acts, facility and infrastructure resilience, and chemical storage. The law also establishes deadlines for communities to certify the completion of these plans to the U.S. Environmental Protection Agency (Attachment A).

 

On April 11, 2024, the City advertised a Request for Proposals for Risk and Resilience Assessment and Emergency Response Plan Services, Project No. PUR 24-034. By May 30, 2024, two firms submitted proposals, IMEG Consultants Corp. and West Yost. Proposals were evaluated based on each firm’s experience, quality of work, staff qualifications, cost, and ability to meet the requirements of the AWIA. West Yost received the highest ranking based on the noted criteria and was determined to be the most qualified firm for this project.

 

Staff recommend the City Council award a three (3) year contract to West Yost for a total contract price not-to-exceed $169,153. (Exhibit 1 to the Resolution).

 

Findings

 

Pursuant to Stockton Municipal Code section 3.68.070, the City Council may approve findings which support and justify an exception to the competitive bidding process. The following findings support and justify an exception:

 

1.                     Use of the RFP process is appropriate for this Professional Services Contract because it relies on the evaluation of professional qualifications and performance as the basis for selection of a vendor.

 

2.                     Use of the criteria helps ensure selection of a vendor that will provide the highest quality professional service, which is in the public interest.

 

3.                     The City negotiated a contract following solicitation of competitive proposals in accordance with SMC section 3.68.070.A.3.

 

FINANCIAL SUMMARY

 

Funds are available in the Delta Water Administrative account to cover the procurement of this service for FY 2024-25.

 

This action has no impact on the General Fund or any other unrestricted funds.
