RECOMMENDATION
Stockton Municipal Code establishes the process by which political campaign signs may be displayed. It is recommended this code be reviewed and discussed for potential direction to staff with changes.

Summary
The Legislation and Environmental Committee will review and discuss any potential changes to the Stockton Municipal Code as they relate to the posting of political campaign signs.
DISCUSSION
Background
Under the First Amendment, as Freedom of Speech, people may post political campaign signs on their private property. Municipalities may place content neutral restrictions on their placement.
Common restrictions, as seen in the Stockton Municipal Code (SMC) regulate size, placement, and timeframes.
In general, under SMC 12.80.010, signs on public property or within any public right-of-way are unlawful, unless placed by a public officer or employee in performance of a public duty.
Present Situation
The Legislative and Environmental Committee requested the SMC related to political campaign signs be brought to the Committee for review and direction to staff if change is desired.
