RECOMMENDATION

 

It is recommended that the City Council adopt a resolution to authorize contract Amendment No. 1 in the amount of $1,182,929 with Robertson-Bryan, Inc. of Elk Grove, California, to provide National Pollutant Discharge Elimination System (NPDES) Wastewater Discharge Permit compliance and program support services over the next two years.

 

It is also recommended that the City Manager be authorized to take appropriate and necessary actions to carry out the purpose and intent of this resolution.

Summary

 

The Municipal Utilities Department (MUD) operates the Regional Wastewater Control Facility (RWCF) under an NPDES Wastewater Discharge Permit (Permit). The Central Valley Regional Water Quality Control Board (Regional Board) issued the current Permit and Waste Discharge Requirements Order (Order) in 2020. The permit includes criteria for effluent limitations and discharge specifications, receiving water limitations, standard provisions, reporting and monitoring program, numerous special provisions, and compliance determination. The RWCF is currently undergoing commissioning and acceptance testing for the new Modifications Project processes. It is expected that work will be complete and all processes in service in early 2025. However, negotiations with the Regional Board for the new NPDES permit are ongoing and have required the addition of tasks not included in the current contract.

 

If approved, this action will authorize contract Amendment No. 1 (Exhibit 1 to the Resolution) with Robertson-Bryan, Inc. (RBI) of Elk Grove, California, in the amount of $1,182,929, for Wastewater NPDES Permit Compliance and Program Assistance. The extension increases the contract not-to-exceed amount to $3,617,423.

 

DISCUSSION

 

Background

 

The RWCF is permitted to collect, treat, and discharge wastewater up to 55 million gallons per day. The collection system conveys all wastewater from the City’s service area to the RWCF through approximately 1,484 miles of sanitary pipelines. Wastewater generally flows by gravity (east to west) to the sewer pump stations located throughout the City where it is then pumped to the RWCF. Currently, 28 sanitary pumping stations operate in the sanitary sewer collection system. Wastewater is treated at the Stockton RWCF and discharged into the San Joaquin River. The RWCF processes wastewater in three steps: primary, secondary, and tertiary (advanced), which are required to meet environmental standards.

 

Over the past five years, the RWCF treatment processes were modified or replaced through the RWCF Modifications Project (Modifications Project) to comply with effluent limitations established by the NPDES Permit. These processes include new tertiary treatment with activated sludge, nitrification and denitrification, disk filtration, and an ultraviolet disinfection system. The Modifications Project also included the construction of a new outfall on the east bank of the San Joaquin River.

 

On November 19, 2019, by Motion 2019-11-16-1106, a five-year contract in an amount not-to-exceed $2,434,494 was awarded to Robertson-Bryan Inc of Elk Grove, California. The contract allows for two one-year extensions and provides for the following compliance and program support services:

                     Groundwater

                     Pollution Prevention Plans

                     Pretreatment Program

                     Characterization Studies

                     Title 22, or Equivalent, Disinfection Requirements

                     Toxicity

                     Whole Effluent Toxicity

 

Present Situation

 

The RWCF is undergoing commissioning and acceptance testing for the new Modifications Project processes. It is expected that work will be complete and all processes in service in early 2025.

 

Based on RBI’s understanding, expertise, and ability to meet the regulatory requirements, staff recommend a two-year contract extension for Wastewater NPDES Permit Compliance and Program Assistance in the amount not-to-exceed $1,182,929. With this amendment, the total contract not-to-exceed amount will be $3,617,423. Approximately $300,000 in funding is expected to be available in the current contract and applied toward tasks completed in the first year.

 

Negotiations with the Regional Board for the new NPDES permit are ongoing and have required the addition of tasks not included in the current contract. The cost proposed is fair and reasonable considering the expertise of RBI, knowledge of current operating and permitting conditions, and performance history with the City.

 

 

 

FINANCIAL SUMMARY

 

The cost of $1,182,929 is for consultant support services during the two-year contract extension. With this amendment, the not-to-exceed amount will increase to $3,617,423.

 

Funds are available for Fiscal Year 2024-25 from the Wastewater Plant Operations Special Services account. Costs for the subsequent years will be budgeted in the same account and subject to approval during the annual budget development process.

 

There is no impact to the General Fund, or any other unrestricted funds, from this action.
